I purchased a 2009 Audi A5 from this dealer on 12/7/19 in Phoenix, Az. I have had nothing but issues with the vehicle since. Two weeks after I purchased the vehicle the fuel pump went out. At that time the was an implied warranty on the vehicle and they came and got the vehicle to fix the fuel pump. On Thursday 5/21/20, I had a local shop that specializes in foreign vehicles pick the vehicle up from my home because the day prior the car was not running right. The shop stated that there were multiple things wrong and that the issues have been going on for a while. The following are current issues with the vehicle, water pump (465.38), brakes & rotors (661.52), Engine mounts (872.32), control arms (1318.32), tire pressure sensors (555.67) for a total of $3873.21 to have the vehicle fixed.

Good morning Tracey Winfiled did purchase 2009 Audi A5 from us. We followed standard Arizona buyers guide warranties like we do with every vehicle. When *** contacted us the first time about fuel pump issue her warranty has already expired. We decided out of curtesy to still help her out and pick her vehicle up from different town, replace fuel pump and deliver it back to her house. This was done out of curtesy not because we were obligated to do so. After this we never herd about nay problems with the vehicle until now. We also do full inspection on all vehicles prior to posting them for sale and this vehicle didn't have any of the issues mentioned above. Things can happen with used vehicle every day which is out of our control. There is a second part of this story which *** is not mentioning. When purchasing this vehicle *** was $800 short to final amount due. We made an agreement (which she had signed and agreed on) that she would pay us this amount in 2 monthly payments of $400. First payment was scheduled for January 23rd 2020 and second for February 23rd 2020. *** failed to contact us on January 23rd so we reached out to her. She didn't have money to pay and asked us to extend her payment for few more day until she gets paid. We gladly did that and 5 days latter *** was able to only make partial payment of $300. We waited entire month for the rest of first payment but it never arrived. We tried calling and contacting *** over 15 times in February to obtain second payment but she never answered and decided to block our phones. *** was warned via text message as well as voice mail that failure to make her payments will result in repo of the vehicle. We never heard back from her nor received any other payments.

In rebuttal to the response, the information provided
is partial incorrect. The vehicle was purchased on 12/7/19. In less than two
weeks of having the vehicle the fuel pump stopped working. I spoke with the
owner on 12/18/19 to which he replied at that time that he would have someone
contact me. At that time the warranty was good for 15 days and was not expired.
I have also mailed in a copy of said warranty as well as additional paperwork.
After not receiving a response back, I had the car towed to a local shop
(***) the next day where they confirmed that it was the
fuel pump on 12/19/19. In doing this it cost me one hundred and sixty-five
dollars for towing and for the shop to diagnose the issue. The same day
12/19/19, I believe his name was Nick came to my place of work to pick up my
car. I explained to him that I had called the owner about the issue with the
car and did not receive a response, so I wasn't sure why he was at my job as I
had already had the car towed to a local shop. He stated that he came to get
the vehicle to drive it back to their (German Auto Az LLC) location in Phoenix
to fix it. Since the car was already at (Breathe Easy
Automotive), Nick then went to that location and retrieved the vehicle to drive
it back to Phoenix. I then spoke with him later that day 12/19/19 to
ask when the car would be finished and was told it would be done the following
day. I also asked if the car could be brought back to Tucson and was told that
the car could be brought back after Christmas the following week. At that time, I told him I would pick up the vehicle
on Saturday 12/21/19. A friend of mine drove me to Phoenix that Saturday
morning 12/21/19 to pick up the car and I can also provide her information if
needed as proof. The vehicle was never delivered back to me. On Wednesday
5/21/20, in driving the vehicle to work that morning it started to sputter and
drive abnormal. After work I drove the vehicle home as usual and called Breathe
Easy Automotive and made an appointment for them to pick up the vehicle the
following day 5/22/20 to diagnose the vehicle.

German Auto AZ LLC states in their response “We also
do full inspection on all vehicles prior to posting them for sale and this
vehicle didn't have any of the issues mentioned above. Things can happen with
used vehicle every day which is out of our control.” However, when speaking
with *** regarding the vehicle on 5/22/20, I was told that the
current issues with the vehicle had to have happened prior to me purchasing the
vehicle and that I should have been made aware of these issues. Had I known about any problems
with the vehicle I would not have purchased it. I have only owned the vehicle
for five and a half months. I feel as if I was taken advantage of because had I
known about any problems/issues with the vehicle I would not have purchased it.
I have only owned the vehicle for five and a half months.

In regard to the money owed, I do intend to pay the
remaining balance however I have been unable to due to the issues with the car.
The balance owed has nothing to do with the current issues happening with the
vehicle which is why it was not reflected in the original complaint.
Also, I did not receive any text messages regarding repo of the vehicle if the
remaining payment was not made. The vehicle is financed through a different
company that I am currently making monthly payments to.

Attached you will find all supporting document including date of original contract, inspection report before this car was sold, inspection report when car was returned for service as well as invoice for the repair when it was performed (this was covered in house). Tracy's warranty was good for 2 weeks or 500 miles whichever comes first. This is a standard warranty that Arizona is asking all used cars dealers to follow. If you take a closer look at miles you will noticed that car went over 500 miles mark after the purchase when issue occurred. We took care of the problem anyways as we always do for our costumers.
You will also notice that during two inspections we found no evidence of what
Tracy is mentioning. There is no shop in the world that is able to tell you
when mechanical issue took a place. People can only guess that. It is also very surprising that this is the
first time we are hearing about these issues, 6 months after. Based on the facts
stated we take no responsibility of issues that Tracy is having 6
months after the purchase and we know that car didn't have any of the
issues mentioned by Tracy while it was with us. We will be dispatching repo vehicle to this shops location as well since Tracy failed to follow her agreement and is 5 months behind on her payments to us. Thank you

Thursday 5/28/20 @ 8am I received a call from ***
which belongs to the owner of German Auto Az LLC. Call was not answered. At
9:25am, I received a call from *** the owner of *** stating that she received a call from someone named Peter with German Auto Az
LLC. She stated that he requested copies of the estimates for the vehicle to
which she replied that she had already forwarded that information to me. He
then told her that he spoke with me and that I had forgotten what exactly
needed to be done with the vehicle which is incorrect. *** also stated that
the person was very vague and that she felt uncomfortable speaking with him.
At, that time I informed her that she would not have to speak with anyone from German
Auto Az LLC regarding the vehicle. I previously
received all estimates from Breathe Easy Automotive on 5/22/20 and forwarded
that information to the Revdex.com. I have not spoken with anyone at German Auto Az
LLC at any time.

The documents provided by German Auto Az LLC I have never
seen, not even when I first purchased the vehicle. I did not receive any
paperwork after the fuel pump was fixed in December 2019. Also, I understand that the warranty was for
15 days however, I was unaware of the “500-mile rule”. I purchased the vehicle
in Phoenix, Az and I live in Tucson, Az. The travel to and from is a two hour “200-mile
one-way drive” so of course the miles would be over the 500-mile mark due to
the travel back and forth to Phoenix. I
feel like this is retaliation because I am filing a complaint regarding the vehicle.
At no time did I receive any documentation
regarding repossession of the vehicle due to the remaining balance being owed. Again,
the balance owed has nothing to do with the vehicle not performing up to par
and should be a separate concern. This is the first time I have heard of such.
I have also made Westlake Financial the company that vehicle is currently
financed with aware of the issue at hand to which I was advised that German
Auto Az LLC cannot repossess the vehicle as the vehicle is not financed with
their company.

In the response received from German Auto Az LLC it was
stated “There is no shop in the world that is able to tell you when
mechanical issue took a place. People can only guess that.” It is also
very surprising that this is the first time we are hearing about these issues,
6 months after.

Breathe Easy Automotive did state that they will be providing
a statement regarding the current issues with the vehicle. As stated in my previous response, the vehicle
was towed to Breathe Easy Automotive on 5/22/20 to be diagnosed as the car was
driving abnormally the previous day 5/21/20. This is the reason the complaint
was filed after the car was diagnosed on the 5/22/20 almost 6 months after the
purchase date.
