Review: My dental treatment has been performed by Dr. [redacted] over the past few years. Dr. [redacted] is a great dentist and he decided to sell this practice (Germantown Dental Group) and open another practice ([redacted] Dental Group) in [redacted], MD. Dr. [redacted], the owner of the Germantown Dental Group, has barred Dr. [redacted], from servicing past patients. Past patients, such a myself, were not notified of this requirement. I have a dental emergency and have not obtained a release from Dr. [redacted] or the Germantown Dental Group. It is absurd to stop Dr. [redacted]'s past patients from getting dental services from him.Desired Settlement: I need an email from Dr. [redacted] or the Germantown Dental Group to release me as a patient so I can see Dr. [redacted] for my dental emergency.

Dear **. [redacted]:
**. [redacted] complains that he was a patient of Dr. [redacted] at Germantown Dental Group, that Dr. [redacted] sold (his interest in) the practice to Dr. [redacted] (one of the other partners in the practice), and that Germantown Dental Group is now preventing Dr. [redacted] from treating patients of the practice, including **. [redacted]. I am responding to your letter on behalf of Dr. [redacted], who is my client.
Dr. [redacted] did in fact purchase Dr. [redacted]’s interest in the practice (along with the interest of Dr. [redacted]’s wife, Dr. [redacted]), for a very substantial sum of money. As part of the sale of the practice, the purchase agreement included a customary “non-compete” provision, by which Dr. [redacted] agreed not to see patients of the Germantown Dental Group practice for a certain period of time. This is a normal and customary provision for a sale of a dental practice, since virtually the entire value of a practice is its ongoing relationships with patients of the practice.
While **. [redacted] has every right not to continue as a patient of Germantown Dental Group, Dr. [redacted] has given up his right to treat **. [redacted] as a patient in Dr. [redacted]’s new practice, for the specified period of time, by virtue of the terms of the sale agreement.
I hope this adequately addresses the concerns raised in your letter.
