When Ms*** joined our program in July 2015, we went through a lengthy interview to determine if our program was a good fit and ensure her commitment to our program. She was informed that we do not offer refunds because our program is adaptable to each members’ health
conditions. Within the first month in our program, Ms*** added another six months to her membership. In October 2015, Ms*** informed us that a medical issue was preventing her from exercising. We were not given an opportunity to modify her program after her doctor’s visit. Rather, she placed her membership on hold. We honored this request immediately, and we offered to continue to help her with nutrition consultations and weekly weigh-ins while her membership was on hold. Ms*** did not take advantage of this offer.We reached out to her again in November 2015, again offering to help hold her accountable to her fitness goals with nutrition consultations and weekly weigh-ins while her membership was still on hold. Again, she declined.In February 2016, Ms*** informed us that her medical condition had not improved, and she requested to cancel her membership, despite our no refund policy. This policy is stated in writing on every membership invoice, and we have members initial next to it to ensure they have read it and understand. When medically necessary, we freeze memberships until members are cleared to return to the program. Because we are a coached facility with certified fitness professionals, we offer customized workouts and can adapt the program to accommodate members’ disabilities. We explained this to Ms***, but she refuses to return. We have offered to keep Ms***’s membership frozen until she wishes to return, even though we believe she is able to return now with program modifications. We were not given an opportunity to modify her program, nor work with her on nutrition and accountability coaching. Please let us know if you need anything else. I have reviewed Ms***'s rebuttal and Ma Law she referencesThe law applies to health clubs rather than our business model which offers nutrition and accountability services to our membersadditionally, Ms***'s letter from *** *** does not state that she is unable to workout, but rather that she needs a low impact workoutWe work with many members with similar disabilities as Ms***, and we provide a modified workout to accommodate themThe letter Ms*** provided from Dr*** ***, her Gastroenerologist, does not state that she needs to cancel her membership with usRather, it specifies that she had medical issues that require a restricted diet, as do many of our current membersWe have successfully worked with many individuals taking medications and following restricted dietsTo resolve this ongoing dispute, I have converted Ms***'s membership to our month package, which she admits to usingthe cost for months, 2x/wk is Ms*** paid a total of for a longer membership, which qualifies for a lower membership rateAlthough Ms*** had a 3x/wk membership initially, I have refunded based on months, 2x/wk usageThe unused portion of her membership, 622.00, has been credited to Ms***'s credit cardPlease see attachedI hope this closes this case to Ms***'s satisfaction and wish her well with her future health and wellness

I submitted 3 specialist doctor letters to [redacted] at Get in Shape for Women. Despite this, [redacted] erroneously continues to insist that I am able to return. I have spoken to [redacted] at the Get in Shape Headquarters. She suggested I get a new letter that restates cancellation to include - MA Law chapter 93, section 82: ‘the buyer may cancel if he becomes significantly physically or medically disabled for a period in excess of three months’ in order to receive my refund. My doctor is providing this letter. Again, I am requesting a refund of $1010 for the balance of my membership. I signed up 7/21/15 and sent the first doctor's letter 10/15/15. My last session was 9/29/15. I went to the ER on 8/27/15, and remain under doctor’s care to date.

In addition, my credit card company has no record of the credit you are referencing. In any case, I am owed $1010, therefore $388 is still due to me, if in fact the $622 is going to be credited. My initial letter in October 2015 requests a cancellation of my membership as does the additional letters from Dr. [redacted] and Dr. [redacted]. Your club is not above the Massachusetts laws. I have spoken with your corporate headquarters and they agree I am entitled to a refund. They suggested I have my doctor use that language in order to convince you to refund me since you have chosen to make this process extremely difficult and laborious.
