the agent elected to pay the plumber to take care of turning on the water knowing that any expense that was incurred by the buyer was just that, part of the inspection process as spelled out in our contract, it took a month to order two appraisals, one came back high and one came back low, plus the one that we had performed based on a 30 day quick sale value, vs traditional sale, making that 3 appraisals performed on this house+ plus my bpo, when things got tough I suggested switching financing or Lenders since the initial lender knew very little about the process or tried to accept the things I was sharing and instead mocked me to her client & on one call asked me how my lender partner could get it done in such a short time and I explained to her that I heavily depend on them and have high expectations for my lender partners. in my opinion, I would have worked harder for my client after he spent so much on all the inspections and appraisals, but its easy to quit when its not your money, may 8th our contract was executed, then 14th finally inspection, may 15th the buyers agent said all inspections were completed and were good and they were moving forward with ordering appraisal 15 days later still no appraisal, june 1st still no appraisal! almost a month later! ( I use lender partners that I depend on and this to me was unacceptable and my answer back from the lender was pointing blame on others and not addressing or taking accountability for the situation at hand) The agent asked me to send her a change of finance addendum so they could pursue other options after a month and I sent it within minutes, then I hear back that the buyer is backing out because of costs and code defects that were never shared with me and I'm curious if the buyer knows what they are either, I never met this man but was actually trying to get this deal completed, no fraud would be committed by switching lenders to people who understand timelines and perform within accordance with the law, all appraisers are independent and I have no contact with them but I too put a value on the home and my wife is a licensed appraiser so after three positive values coming back I would have been confident in switching to my lender who has vast knowledge in our current market. I would be interested to know what code defects were on this house(and asked the agent what they were and was told no) and who discovered them ? surely not the first three appraisers or inspectors, maybe it had to do with the $10,000 the mortgage company offered for an on time closing, copy and pasted from an email from the lender below
( As you know, my company is the only one that offers a $10,000 Close on Time Guarantee.
This means that if we do not close on time the seller gets $10,000.
We have never paid that out because we always close on time.) The agent also told me in our last communication by phone that she was reimbursing her client. in a closing statement, I too am confused how we went from this email sent from buyers agent
(Inspection, including well and septic have been completed on this property and are acceptable to my clients.
The lender was notified that the buyers wish to proceed and will be ordering the appraisal. I will notify you as soon as that has been scheduled.) to this from buyers agent
(My buyers have explored their financing options; they will not be changing the financing/signing the addendum. Based on the low appraisal and sizable work order, they no longer are acceptable borrowers.)
