My company purchased 3 greenhouses on May 7 2018 with a deposit of 6021.09. We were hoping to get them in first part of June. The company was 2 weeks late on delivery, after insuring us to choose them over the other companies we went to. We have the signed agreement. On June 12 2018 GGS called for the final payment before delivery of $11182.04. They were shipped on June 18 2018. We hired a crew to put them up. They laid the one out and the bolts would not fit.We had to take one piece of the frame and the bolt down to them. GGS confirmed that the holes were drilled wrong. It is late to put our crop in, we had the crew here and paid them for the minimum time. We have $8000 worth of plants that are getting ruined. We wanted them to take the greenhouses back with a full purchase refund or fix just one of the greenhouses and set one up for this season, at GGS expense, as we can not get any crew back for quite some time. The other 2 can be drilled at there convenience. We will have to use the other 2 next year. After speaking with the owner several times, she stated they would take them back with a restocking fee of $5000 or take them back, re drill the holes and bring them back. The owner also stated to me that she would re sell them. This is not acceptable. They were made wrong through no fault of our own.

Desired Outcome

Other (requires explanation) We would like them to be returned with a full credit of the purchase price and we will absorb the extra cost of our losses. Or they take them back, fix one immediately assemble it on our property asap and the other 2 can be done when they have the time. We will use the other 2 next year. I think we are being more than fair.

1. The contract the customer signed required a deposit and the balance to be paid prior to shipping. The contract signed specified that delivery would be 4-6 weeks after the deposit was received. The 3 greenhouses were delivered to their site exactly 6 weeks to the day the contract was signed. The order was not late.

2. The customer claimed that there was a product defect on some of the material. The customer had only checked a few of the parts. We offered to pick up the parts they claimed had a problem in order to inspect them and rectify the situation if there was an error. We told them they would have the corrected parts the next morning. They did not want this solution instead suggesting we should now assume responsibility for the installation which was not part of our contract.

3. On a construction site buildings like greenhouses first require foundation posts to be installed. The structure is then built on top of these posts. In trying to understand the real issue with this customer we were told that the posts were still in the strapped bundle that we shipped and had not been even placed into position for installation. Construction effectively had not yet started and it was clear that the real issue for them was not getting material fixed.

4. The customer ordered 3 greenhouses to be manufactured specifically for their configuration. To produce the bill of material and provide construction drawings requires time. To package and wrap the many components requires time. To deliver from our factory to their site requires time. To pick up the material they wanted to return takes time, to inspect and unpackage all the materials so they can be returned to stock takes time. Because they would not let us pick up the material in question, we agreed to accept returned product provided it was in good condition and returned to us complete and they were advised that a $5,000.00 restocking charge would be applied in order to cover our costs.

5. The material has now been returned to us with a few bolts missing and some poly roofing material damaged. We will be issuing a credit less the $5,000.00 restocking fee.
