We are the neutral third party settlement administrator for the Sprint ETF settlement matterWe mailed a check made out to *** *** for $on 7/17/to an address in ***, **The check was not returned to us as undeliverable
The check went void on 12/14/We will typically run a search on undeliverable checks to find an updated address and reissue the checks when an updated address is foundIn this instance, since the check was not returned as undeliverable, no search was performedAs the third party administrator, we do not have access to Sprint's internal mailing database, other than what was initially provided to us to mail the court approved notice, as provided for in the settlement agreement
It is unfortunate that there was an assumption by Ms*** that we would have access to updated addresses from Sprint or that we could act outside the scope of the settlement agreement to obtain her new address, but she waited over three years to contact us and over two years since checks have gone voidOur administration of the matter is closed and we are unable to reissue her checkWe apologize for any convenience this may cause

Gilardi & Co is a settlement distribution companyThat should include ensuring they had correct address information or at the very least putting a statement in their general responses that referenced ensuring claimant information was up to date to ensure paymentThat information was also not present on thee settlement website managed but Gilardi & CoThis is a classic case of a company trying to pay out as little as possible so they or the attorney can keep the "unclaimed/unpaid" moneys to claimantsThis is fraudulent business practicesI will continue to fight this until the right thing is done

As mentioned in our previous response, the administration of the matter is closed and the terms of the court approved settlement agreement were followedThe check mailed to the consumer was never returned to us as undeliverable by the post office and the consumer did not timely inform us of the change of address

This company again did not do its due diligence and refuses to provide settlement amount in class action case
If I contacted the company multiple times during the case, didn't I do my due diligence? Why, during multiple exchanges with this company, did they not make any statement about ensuring addresses were currentThey purposely misled the consumers who attempted to find status on the suit by not even putting a statement in the emails that they didn't have access to Sprints customer information and parties should ensure their address was current on the site
On 08/11/I filed claim number XXXXXX with Sprint/Nextel as part of a class action suitGilardi & Co, LLC were assigned as administratorsOn 2/4/I sent an email requesting an update and on 2/6/received this email "The Court has approved the SettlementHowever, the Court's approval of the Settlement has been appealed, and benefits under the Settlement Agreement may not be distributed until all appeals regarding the Court's approval of the Settlement have been exhausted or resolvedAt this point, we do not know when this will take place
Please let us know if you have any additional questions and thank you for your patience." but nothing stating I needed to update or change my address if we had movedAdditionally, since this was a suit with a carrier I still have, I again assumed during due diligence review that claimants information would be reviewed and validatedThey had all contact information including emails but no contact came from the administratorsOn 7/14/I sent ANOTHER email and the response I received was "Our records indicate that a check was issued on 7/17/to ***, **, XXXXXThe check was voided on 12/14/At this point we are unable to reissue the check as we are preparing to close the case
