August 10, 2017 Dear MsCarmona, I am writing this letter is in response to a complaint (ID 12297477) submitted by our previous tenant with regard to the refund of his cleaning depositTo begin, the tenant claims that he filled in nail holes with plaster and then painted over them with
the original paintIn fact, the holes were much larger than nail holes, and though he filled in the holes with plaster, he did not in any way match the texture on the wallsIn addition, there were obvious discolored paint streaks and roller marks on the walls in every room of the house and the tenant clearly used paint that did not match the wallsFurthermore, there was significant damage done to doorway entry trims that needed to be repaired and repaintedAs we did our final walk-through together, I pointed out these very obvious damages, and the tenant did not at any time disagree with my assessmentIn fact, he admitted that there were issues with his paint jobHe never called and asked permission to repair or paint the walls before doing soHe did it on his own, and did a very poor jobHe signed the final walk-through paperwork that listed all of the damages, and he understood that we would be keeping his cleaning deposit to cover the cost of having the home repaintedFurthermore, I explained to him that his cleaning deposit of $1,would most likely not cover the entire costWe had a pleasant departure, and I am happy to share the signed paperwork at your requestWe had the home repainted and the trim repaired and re-painted for a very fair price$2,is a reasonable price for painting this spacious home that includes bedrooms, bathrooms, a family room, and a living roomIf you have any further questions, please contact me at ###-###-####I would appreciate your help with this matterSincerely, Bill Gilardi Gilardi Farms

To Whom It May Concern:For the tenant to determine that the color of the paint was off due to smoke damage was never discussed with the Landlord prior to or during the final walk-through. If the tenant felt the color was off, he should have discussed it with the Landlord, and he should never have attempted to paint large portions of the walls using the original color. More importantly, the Tenant does not have the right to paint or make any modifications to the rental without the express permission of the Landlord.Our final decision is that we will not return any of the deposit because it is going towards the necessary repainting of the home. Here are copies of the final walk-through paperwork showing his agreement and signature that the home needed repainting.Respectfully, Bill GilardiGilardi Farms

I am rejecting this response because:My contention is simply this; the fire in the house 3 months prior, is the csuse of the  paint being off color. That issue was not brought up in the walk through inspection, for what ever reason. Had it been brought up this discussion would hsve taken place. My contention is simple, because the fire in the house was due to the owners faulty AC/heating unit, causing smoke stains on the interior walls of the home. It is the owners resposibility to pay to re- paint, not the tenants.
