First of all I don't want to sound ungrateful for this customer awarding us this landscape project; and I recognize that she spent her hard earned money to have us do the work she paid us to do I feel and she also mentioned that we did a professional job She was very pleased with the way everything looked regarding the retaining walls, and landscape plantings
originally She informed me that the piping she already had in place that we tied our pipe into was adequate to handle the water coming from her neighbors yard In fact it is not big enoughthe estimate I gave and that we agreed to do was to tie our pipe into her pipe as part of the original estimate We later can back at no charge and installed a catch basin, and rock a value of $to help resolve the issue We feel we have exhausted what I feel we can give without any further charges; further more she should have someone other than myself look at the project to advise her with a solution We talked about what we were going to do and did what we said we going to do Something more nothing less

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear belowDuring heavy rains, the water runs over the retaining wall (see
pictures), not just “flow through the individual segmental blocks” as stated by
contractor. I went out of town for a
week during this project’s construction with my son and when I returned the
drainage pipes were buried. The
contractor later told me he connected all his pipes to the single old 6”
pipe. He suggested I consult the city
for recommendations for a solution after his initial solution of adding the
catch basin at the top still could not handle the water run off. When I told him the city employee’s remarks
regarding needing a much larger pipe size, he balked. I suggested he disconnect his pipes from my
6” pipe and run his own drainage. This
contractor then wanted me to specify a size of drain pipe for him which, of
course, I was unable to do with my lack of expertise in this area. He then said large pipes were too expensive
and suggested the dry creek bed drainage along the fence. If he went this route, I suggested using the
old concrete pieces discarded from this project (still in my yard) as some of
the fill in drainage rock.
He then sent me an estimate for me to pay more money for him to fix this
drainage problem when I already paid him 22K for his project. I was expecting him to fix the problem as
part of the project. His solution will
also only address the water flowing down one side, but does not address
directed the water flow across the top fence line into the catch basin or this
new dry creek bed

We did install a retaining wall, sod and plantings for this customer.  The type retaining wall we agreed to install and the construction practice we used was to ensure that the wall has structural integrity.  The wall has gravel and drain pipe behind the wall to allow water to escape so as...

to minimize hydro-static pressure.  during heavy rain water will flow through the individual segmental blocks and out onto the sod below.  We never gave this customer a guarantee that we would stop rain water from entering onto her property from her neighbors property only that we would put in a drain system to address the situation.  When we first talked she explained that the rain water was directed to a catch basin already in place and piped out to the lower part of her property.  It was simply agreed that we tie our piping into her piping that was already in place  to allow water to escape.  It is obvious that  the piping size that was and is in place before we started work is not big enough to handle the flow of water she would like to direct underground.  It would not matter what size pipe we installed for when the water reached the pipe already in place it would not be big enough.  We have given this customer what we think is a solution but explained that there would be additional charges.  She refuses to pay us for the extra work to address the situation.
