This email is regards to the complaint from Kadant ***We did work for them in August of this year in the areas they mentionWe had our estimator go there on a couple of different occasions to meet and talk about what needed to be doneIn all of these meetings there was never anything
mentioned about the railroad switchWhen we had our crew on site prepping the lot for paving their rep was on site the whole time and again never told them about the switch area and again when our paving crew was there same thingOur guys would not have been told something like this and blatantly disregard what needed to be done like thatAs far as the area on the other side of the tracks when our estimator was there times we said that water drainage was going to be a problem and also noted this on our proposalWe did say we would try to get the water to drain as best as possibleTo do this we had water running ways, towards the road and to the back of the building which is where they have concrete sloping to drain to this same areaWe then received a large amount of rain and they had a puddle in this area...nothing by the switchI met them on site and we tried to figure out the best course of actionOur contract clearly states that excavation was not included in the price and again that water drainage was going to be an issueI suggested that they should have a drain installed in the low spot and this would take care of the problemI then had an excavator we work with go there and meet with them to discuss placementI told *** and the excavator to work directly with each otherThe excavator then gave them a price that they were not happy with so Quality Asphalt offered to pay the excavator $directly and to come in and pave the areas that needed to be patched after this work was completed*** then hired a different company to do the workThe company that ended up doing the work put drains in one of them being in a high spot...our agreement was to patch the area that was cut out which we didWe had no say with the excavator they hired on where they were putting the drainsIf the excavator we recommended would have put the drain there we would have had them move it or dig down so water could flow to the drain. Everything that was in the contract was followedEven with noting that water could be a problem so we would not be responsible for all of this on the back end we still worked with them to alleviate that problemWe covered patching as well as ripped out an area by the switch to put a swale in for water to pass through the area even though it was not brought up to try to salvage the working relationship. In conclusion we did everything we said we would and more

We know we did not damage their property so we are not willing to bend in our initial response in saying we won't pay for the repairsIf it was damage we had caused we wouldn't be having this conversation because we would have already had it repairedOur name is important to us and we are proud of our reputationWe would never walk away from a mistake we made without remedying the situationWe await your decision, and hope our name will be cleared of these claims. There response is just nuts. *** came saw the damage and made no attempt to correct the situation in any shape or form, just said they didn't do itSince they are not wiling to accept ownership in this matter there is nothing we can doThey got the money that is all they are worried aboutThe owner never came to look at the problem or call to discuss itHe just took the word of Jesse and that is thatWell I now a lot of people and I will tell each and every one about the work that they do

In response to Quality Asphalts letter dated 12-22-16. He stated in his letter that we never mentioned the need for the railroad switch to be open for water to flow out yet he admits to being at our location several times to talk about the project and he admits stopping by times to look at the area on the east side of our tracks. The area to the east of our tracks is 20' away from the RR switch so if this guy does this for a living then why didn't he see the swell in the old asphalt that he walked over while doing his measurements? See attached picture called “RR Switch”. Kadant *** did make it clear to him during several conversations between June 14th, and Aug 2nd the importance of water running through the switch. If this switch were to freeze during the winter months we would not be able to ship our railcars so it is very important that we kept this switch open. As far as his comment about us not stopping his crew to confirm what needed to be done one would think that after conversations with the guy he would have been able to relay the instructions to his own crew This estimator is just making excuses for his mistakes. We originally decided to go with Quality Asphalt for our paving project because of the good reputation this company had. We found out since then this company had been sold and the quality of workmanship isn't close to what it once was and that all starts at the top. The owner of Quality Asphalt had never made contact with us after 2-1/months of emails and phone calls asking for him to stop by so he could see firsthand how his estimator handled our paving project and the way he was trying to cover up his mistakes. You would think the owner would be concern for a customer that had paid them $53,over the last years. They never mentioned during any conversations that this wasn't their problem since *** contacted them about the water problems on Aug 22nd. Why would the estimator offer to reseal both the and the asphalt at no cost when we asked to be compensated for having our $35,driveway cut up after months if he didn’t know they made the mistakes? Knowing how the new owner handles a customer’s complaint there is no way they would have come back and fixed this switch area at no cost to us if this wasn’t their mistake. Their letter said that when they paved the area to the east of our tracks they ran the water in two directions, towards the road and to the back of the building onto some concrete which sloping towards a drain. There is not a drain near the concrete slab. There is a trough in the ground with grating over it that used to allow water to flow towards the road and in to some gravel. See attached picture called “Trough”. This is part of the gravel area we hire Quality Asphalt to pave and now that trough is plugged because of the new asphalt. That concrete he mentions is an area between our plant and gas house and it actually slopes away from what they assumed was a drain. See picture called “Concrete Between Building And Gas House”. If the estimator would have used a transit during any of his visits he would have realized that water cannot flow uphill towards this non existing drainAgain he is trying to come up with excuses for his mistakesAs I mentioned in our first letter the estimator did stop by with one of his crew to shoot some elevations across the asphalt to the east of the tracks. It was determined that they raised the new asphalt 5" higher than the grass it runs next to. They told us that they need a minimum of 1" for every 10' of pavement, we have 50' which falls right into their specs had they sloped the asphalt to the grass. Now he is telling us that per their contract which states that they will get the water to "flow the best possible way", his plan all along was to have the water flow onto the existing concrete between our plant and gas house. This 20’ of concrete doesn't have a 1" per every 10' of pitch. As I mention before it has a slight slope away from the direction he says they "planned" on going, again see the attached picture called “Concrete Between Building And Gas House”. Please explain how that is getting the water to "flow the best possible way"? The last thing we want to address is the failure to slope the patch they put down over the new sewer that *** had to pay for. When the crew showed up I walked them over to the concrete between the plant and the gas house and told them that we needed the asphalt to start at the edge of the concrete and slope towards the new 18" sewer and they could feather in the small 8". When the estimator showed up I walked him over to the same area and told him the same thing. Now if they had any problems with the pitch they could have mentioned it while they were standing around waiting for their dump truck to show up with the asphalt. We figured that we left the new sewer low enough for them to slope the patch work towards it. They did as little as they had to and got out. Quality Asphalt mentions that his excavator (which was $higher than the other estimate we got) would have put the new sewer in the location where both *** and Quality had talked about. Had the owner returned any emails or phone calls they would have been told about some underground utilities from the old business that was in our building before us. After discovering the old utilities we decided to add the small 8" drain in the location we originally wanted and another 18" sewer a few feet away. See picture called “New Sewer”. Their excavator would have had to do the same thing but for another $moreWe have proved the mistakes in Quality Asphalt’s plan to get the water to “flow the best possible way” per their contract and how they did not allow the water to flow through our RR switch. The new owner of Quality Asphalt needs to step up and admit they made mistakes and then address them instead of hiding in his office. For those future customers of Quality Asphalt who may read this complaint - pictures don’t lie, people do to cover up their mistakes!

This letter is in regard to a complaint filed against Quality Asphalt, [redacted], by [redacted]. They are claiming that we damaged their sidewalk and pavers in the process of completing a job they contracted us to do. Their claim is that we cracked two sidewalk blocks with our paver...

as well as pushed their decorative pavers down. I was on site to examine the property previous to the work being done as well as after it was done personally. One of the blocks they are claiming we damaged had the whole corner broke off and cracks spider webbing off of it before we ever set foot on the property. They claim that we caused one additional crack on that block which appeared to have been there for quite some time. So they want our company to pay for that block even though it was clearly and by Mr. [redacted] own account damaged previous to our work being done. The block next to it has a thin crack through it that also spider webs off in different directions and was also there before we did our work. As far as the pavers are concerned, our foreman has stated to me that we did not drive over them. The way the pavers sit in comparison to the concrete it is butted up to, it's clear that those have either been sinking or the concrete next to it has been heaving for some time. This also is not an issue we caused. We can not be held liable for issues that were present when we began our work. Beyond that, I have attached a copy of Mr. and Mrs. [redacted] contract that they signed in agreement with our terms in order to do the work. Highlighted is the section where they granted permission for us to drive across their concrete with our equipment and releasing us from liability for any damage done in the process of completing our work. So in short, they released us from liability by signing that contract, which is standard in our industry, for damage we did not create. I spoke with both of them and explained we were not liable, at which point both of them became very agitated and aggressive. I was verbally assaulted with vulgar language and insulted for my personal appearance. At which point I chose to leave the situation before it escalated any further. It was at this point Mrs. [redacted] told me that if we didn't fix the problem they would attack our company through complaints to the Revdex.com and online reviews. We told the workers to put down ply wood, they did not, we have pictures to show they did drive over the pavers'  This response from Quality asphalt is totally unacceptable. They need to repair the damage. We did state one corner of the block of sidewalk was cracked but now the  whole block has several cracks in it along with the another block of sidewalk.To be told we want  this fixed because we can not afford our driveway is just bad customer service.  I wrote a letter to the owner and he did not respond at all.  Dealing with Jesse will not work.  They did not offer a solution to the problem just got a lot of attitude.  The response they wrote to you is full of lies.  What do we do now?[redacted]
