I received a letter from you guys about a customer I did work for, Her Name is *** ***. I would like to tell you my side of this story. We started the job on July 20th 2017. We were to grade and seed an area where she had an over grown mulch bed. Also to REPAIR a
patio install she had done. When I went to give the estimate I had told *** that we would need to remove the square foot mulch bed and refill with screened top soil, and slope it correctly, and re seed the area. I also went to the side of the home to look at the patio job. I did advise her that she needed it re graveled and re set, and that she would need a complete new job done. She understood everything I said to her before giving her a quoted price of $3500.00. She said she could not afford that and that she would wait. After talking to her a little after the quote, she asked me if we could use the mulch bed and just level it out and add grass seed and hay, if that would save her anything there. I said yes (she wouldn't need the topsoil) and she wasn't really to concerned with that area she just wanted grass there. This area also had about square feet of retaining wall block, I also said if I could take those as well I would give her money off the cost about $150.00. She said ok. Then we went over to the walkway pad. I advised her that we could level the low spots where it dips down and use the existing blocks, so they would at least be level to walk on. we would be doing a repair. She already had an existing paver patio laid outside of the sliding doors. They were pretty level except for the outer edge. The paver patio was laid on top of a concrete pad, and the concrete pad corners were crumbling. When I saw this I told her that I would not be touching that patio that was already done due to the fact that if I lifted any of the corner pieces, it could possibly become an even worse situation. So we agreed that all I was to do was level off the low spots and have them sloped for water run off. We agreed to a $2,500.00. When I arrived to do the job on the 20th, I removed the retaining wall block and also began to level the mulch bed. I stacked all blocks off to the toad to be loaded on the truck upon completion of the job. Once I Leveled out the bed I added the grass seed and hay, and completed that project. When I Went over to the patio job I began to removed some of the pavers that were broken and not useable. I graded and leveled the patio with stone dust and sand, and completed the job. After I saw the patio and how bad HER EXISTING patio looked to my work, and that she was an elderly lady and had told me she fell off this patio before, I decided that I would try to level HER EXISTING patio the best I could for her at no additional cost. Upon doing that I made sure she was ok with this and she said it was fine. Doing this made my patio pavers short due to all the broken blocks she already had that needed replaced. Before I purchased this I told her that the cost was $for the material, she was also ok with thatSo I installed them and everything was perfect untill , we had torrential down pour a few days after I installed the walkway, and she had called me to tell me some of the blocks had shifted. I completely understood and told her as soon as I find a day in my busy schedule I would come out and make it right, about 2-weeks. On the second week she called me and left me a message about "coming out to finish the job'? I found that a little strange but figured she meant it by coming out to re lay the blocksI did not get a chance to call her back as I had a booked schedule. about days later she called again. Stating that she was very unhappy with the job and that she was gonna contact the Revdex.com and she wanted her money back, because I have not finished the job. I called her back that following Monday, (It has now been about weeks). Explained that I was busy and that's why I told her 2-weeks. she was very understanding and I told her I would be out to check out the patio that week. In that week we had rain just about everyday and I was not able to make it out. Now we are in September, I had told her that I would be there to replace the pavers on the 25th of September. she was okay with that. When we got to her house on the 25th, I noticed that the patio and walkway was not the problem, her back yard was on a slight hill, and the water was running from the hill and hitting that paver walkway, not the pad because it was up off the ground about 4-inches and had a concrete baseand my walkway kinda followed the slop of the hill but was raised a little so the pitch was ok. So the water would wash out under the patio and leave a couple corner pieces angled. So what I did to fix this problem was added a small wall using matching block, that way it would not wash out the bottom of the patio. I also explained that she would need a foot retaining wall around this patio to completely stop the water from hitting the walkway. She said she could not afford that and that what I did looked much better and that she was happy with the way it was doneShe had not one complaint about the job when I was there to fix it. We walked on it and I even explained that the retaining wall was a 100% fix if she could find the funds to have that done. Again she replied that she didn't feel it was necessary and that it should be fine. I also believed that she would not have any issues with the walkway but just to be safe I recommended a retaining wall. She asked about the landscape edging for her pavers on the side where I built it up with paver block and I showed her that they were not necessary because the blocks that I had dug into the ground would hold them in place. Upon completing the job she stated she was happy with the job and signed a receipt stating soI will add the signed paper in this letter for you to take a look at. So no, I do not feel like I owe her anythingWe completed the job and I feel like if there was an issue when I was there she should have brought it to my attention before I left so I could fix it. Hello ***,I am following up with a complaint that was filed on 9/21/2016, ID number *** *** *** contacted me about her landscaping on October 23, This was all done through *** Messenger.I came to the property located at *** *** ***, Litiz PA, ***, we
walked the property with *** and her husband *** ***We discussed what they wanted done at the propertyAfter a few days of pricing all the work out, sent her a quote for what she wanted done(I've attached the quote)My quote was valid for weeks from when it was quotedClose to moths later after Christmas, touched based with her, seeing if she would still be interested in our servicesShe replied stating that they were gonna wait til next season, and that I touch base with her later into the season to see where they were atApproximately months later on March 7th touched base on weather or not she would be interested in our services, she did not respond back to my message until March 23rd, 2016, stating she was not financially readySo I waited about a month from that last message, and touched base again, This time she wanted a new estimate at her property due to her removing a very small section of flower bedI agreed to this and we set up a time to meet We had to reschedule this date due to scheduling, and one of my two trucks were in an accidentWe were unsuccessful on coming out and physically looking at the property because got extremely busy, and made that clear to herSo on 5/4/2015, *** earthed her property, and I was able to get her an estimate that waynoticed the property was not in the same condition as it was when we showed up almost a year ago, so gave her a new quote for strictly cleaning up the flower beds, and mulchingThat was itI did not give her a new quote for monthly service as well(that quote is also attached with this document)The total price for this was $She was ok with the price just wanted to confirm it with her husband ***Once confirmed she had called me on Wednesday August 17th, to tell me that she needed the job complete by Saturday August 19, due to a anniversary her parents were having, and she made it clear the property needed to be complete Saturday August 19, I assured her that I would work all day into the night if needed as long as they were ok with itShe Agreed and showed up at the property with my foreman on Thursday August 18th to collect the 50% down payment, and to walk the property again and let them know what was getting doneOnce I got there *** *** was home, ***'s husbandHe had a check ready for me at the door, before I took any payment from him I asked him to walk the property with me and I wanted to go over with him what was getting done for the quote sent to themWe walked the property and stated that his wife wanted the trees trimmed up about feet from the ground, and also told him that I would not be doing that due to the amount of work that was already there, and I was not insured for tree services, He was completely ok with that and stated his wife already trimmed them, and he know how insurance is because of his line of workI also told him that his beds were more over grown than the initial time we came out last year in October, He again stated that he knew they were bad and he was appreciative that we were there to take their minds off of getting it done.Now the beds around the property are in a horseshoe design, so I made it clear to him that I was only doing inside the horseshoe, which was all the flower beds around the house and the flower beds on the front of the houseHe again said yes that was fine, we walked to a hedge row that they have along the far outside of their property, outside the "horseshoe" and told him that would not be doing any hedge row work with this quote, that is was the mulching and clean up around the house, but said would pull the two large sumack weeds out, since we were hauling debris away from the property anyway, He stated that he wasn't worried about that getting done and that he wanted the "horseshoe" done and the front of the propertyAfter he said that I mentioned about doing a monthly clean up, to lock in more business and he agreedSo I said that we would have no issues trimming up the hedge row on one of our monthly visits, he had no issues with thatOnce we agreed on what needed done for the job we shook hands and he wrote me the deposit of 50% ($1,300.00) and we leftOn Friday August 19th, I had guys with my foreman (who was with me for the quote), show up at her property at 6:AM, They started pulling weeds, weed whacking the edging, cleaning up sticks, spraying a weed preventer on the flower beds, and using a backpack blower they began to clean out all leaves in the bedsAt 9:20, arrived on the property with another workerMaking it guys on her propertyAt 12:one of my workers had a doctors appointment and left, he did not return for the dayLeaving guys total, including myself on the jobOnce we got everything cleaned up *** *** came out and said that he did not want the mulch under the pine trees, which was ok because we had estimated that not to be mulchedI had my foreman mulching the property closest to their barn; there was a kiwi tree that was kind of behind/ to the side of the pine trees, that was not mulched, it was almost hidden, if your were not looking for itOnce we got everything complete, we walked the property to make sure everything was covered with mulch that needed to be and gather all of our tools on siteOnce that was complete, we asked *** if we could mow his grass, we were trying to really make the property stand out and since he was having a family gathering f thought it would be a great idea and possibly get me more businessHe had no issues with that and we mowed the grass as wellOnce that was complete walked to the door and told *** was finished with the job, and would like to walk it again with himHe said no, you guys have been really working hard and he was absolutely satisfied with the work, he also said he came out and looked at it while we were going and everything looked goodHe was so satisfied that he was excited to have us come again next seasonAfter that conversation we talked about Lawnmowers for a good minutes, and how his brother in law has the fastest lawn mower you can buy a *** ***Then after that he wrote me the final payment and we shook hands and was on my wayThe next day, August 20th, She contacted me and said that we missed a small area to mulch, she also stated that if my estimate did not cover that bed due to the amount of mulch had quoted, she would pay for it to get done as an extra chargereplied back with absolutely not, we would come out and get it covered right awaytold her it wouldn't be able to come out till the following week, and that I would get it done with no charge to herWithin a couple days noticed that I would not be able to make it till about weeks from when we spoke last, and she contacted about a week later and said that we never touched her hedge rowreplied back that would do that at another time since we were busy could not just drop my jobs I have scheduled to do her hedge rowShe was ok with that and then replied she was asking since it was part of her quoteThat's when I said no its wasn't but ill get done for you, and also told her that made it clear to *** that wasn't touching that hedge row and we had an understanding, she continued to say that *** has no idea what he was talking about and that she wanted it done with the quote, again said to her that talked to *** about what was getting done and we had an agreement, and he and I had an understanding on what was getting done wit the job, didn't hear anything back for a couple days and then she said she wanted to talk to me in person with ***, said that ok we can all meet up, My two weeks turned out to be weeks till came out and talked to her and ***, She said I did a great job and that she had people asking her about who did the mulch, and that she was sending work my wayI was very happy they were happy, When I got there she showed me the kiwi tree that was not mulched, and then she pointed out the hedge row, told her I would get it done for her, but it was not part of the estimate had messaged her, and she insisted that it was, it was almost back and forth at one pointAgain told her that I told *** this wasn't getting done and he was ok with everything told him was gonna get doneShe replied with her husband is clueless and had no idea what he was talking aboutShe had more work lined up for me, as well as joined the monthly clean up, so I was gonna do her shrub line, was getting paid for her monthly clean up so I took the win with the loss and told her, since you have monthly clean up ill get it trimmed for youalso made it clear to *** that was not part of the estimatetold her I would be out that following Friday to trim up the hedge row and she was happy, seemed as if all the problems were because of this hedge row, and 1/a scoop of mulchWell friday came and again had to reschedule for the following Saturday, and she was ok with that, and Saturday came and I was unable to work that whole week, my Best friend passed away in a local car accident, so I had to reschedule for the following week, I messaged them and they were completely understandable, So after that f said was taking a week off, and I would come do their shrubs the following week, well in that week, my father passed away and I had kidney stones, so was out of work for weeksIn those two weeks I didn't have my work cellphone with me, and when returned home had numerous messages from them, one was basically stating was making up stories to avoid the job, and another they had a group text with me and were going back and forth about how im avoiding them, and how bad for business they will be for my businessI was a little upset, then he called and left me a rude voicemail about how there gonna turn me into the Revdex.com, attorney general office, and even legal action with small claimsvery nicely replied back stating that I will come back and finish the mulching the next business day, and I would only be doing that, and would be cutting all ties with them with future workThey again replied back with again calling me a liar, and making it sound like my excuses were just made up stories, they were very rudeI do honestly have scoop of mulch that needs laid down at their property for what was quoted, and that is allThe estimate she is trying to say was the estimate gave her I've attached with this letter, it was only valid for weeks back in October have also attached the quote that was most recent for the jobAs a result of this, she has left a slandering comment on my business page on ***, which in turn cost me a job for $13,along with sending a bad report to Revdex.com she has really stressed me out to where I cannot remove that comment from ***, and advertise with *** that cost me $monthly and I've had to drop that account along with of my residential customers asking me about the comment along with the people on that page who received and update that she left the commentHer comment on ***, that is not even factual cost me a lot of money, they've slandered my business name to the point that I have contacted lawyerThis is all over a hedge row and yard of mulchI would be willing to work something out as to finishing my mulching I received the latest letter in the mail for the paver patio. I am willing to return to the property and lay the custom steps that we have communicated about. I will also put paver adhesive to the steps that will lock them down to the patio walkway. I would also be willing to return to the property to re seed and level out any high spots that may be existing to the back part of the home where we graded and seeded. I have already finished this job and I do not want to have any more issues with this job. I am willing to return and complete the steps as stated, and level any high spots from where we graded and seeded. I will also reseed the area for her at no extra cost. This grading and re seeding would need to be done in the spring due to the weather. The steps can be done within the next weeks. If she would like I can do the steps now, or I can do them upon my return in spring for the high spots in the back area. I am not willing to return any monies as I am already over the expected budget on this job. I also had the customer sign a receipt stating she was happy with the job and it was complete. So this is what I'm willing to offer to resolve this situation. At this point there is nothing else I can do, besides what I've stated I will do to resolve it. If he returns and finishes the job as stated in office voice No*** he stated that the wall would be removed ( which some stones still remain ) regrade the back, no topsoil was used and he puts in the step then this will be over for us both.
