[redacted] Hello MrPollock, GJ Gardner homes went under contract with Ms [redacted] and Mr [redacted] in December of We began construction in April of after making extensive re-designs of the home in order to meet the HOA design guidelines and meet the preferences of the homebuyers We did not charge anything for these redesigns, which resulted in lengthy delays in getting the home started In fact, we provided substantial sales concessions such as converting the home to a full basement at no additional charge in an attempt to make the project work for the buyers who apparently did not have any additional money available in their construction financingThe lot selected by Mr [redacted] and Ms [redacted] was severely sloped and required extensive structural fill and extra foundation work These costs were not able to be recouped from the buyers and were covered by reductions in money due to GJ Gardner In addition, the Initial Construction Deposit was never paid to GJ Gardner as agreed upon and stated in the Home Construction AgreementAt all times from permit application and approval throughout construction, a GJ Gardner representative was a license holder and the licensed construction supervisor in full compliance with City of Fort Collins requirements This is documented There was no deceit or misrepresentation ever made to the homebuyers or the City of Fort Collins We did receive notice from a City of Fort Collins representative indicating one of our primary subcontractors insurance has expired and they needed proof of insurance before any inspections could be issued The subcontractor promptly replied with updated insurance certificate and there were no delays as a resultUnfortunately Mr [redacted] and Ms [redacted] hired legal counsel on this matter so I have had to respond in kind We will need to let the legal representative resolve the matter but am confident in our position as we acted within the terms of our Agreement [redacted] President - Certified Green Professional | G.JGardner Homes | È+970-567-| É +970-669-| Ê +970-667-| www.gjgardnernortherncolorado.com G.JGardner Homes - Larimer Co.| Fall River Drive SteLoveland, CO GetTheFactsEmail

Complaint: [redacted] I am rejecting this response because: We have complained to the builder for over a year now about concrete issues and we have been repeatedly promised resolution of the issue with no follow throughThe driveway surface began to chip off less than six months after we moved in and it has increasingly worsened over timeThe builder has promised action and has failed to follow through including missed appointments to evaluate the condition of the concreteWhen confronted about the missed appointments the builder has blamed the subcontractor and promised follow upNOTHING has been doneThe concrete walkway leading from the driveway to the front door has sunk several inches and is cracking up at the joints and chanting to the sideThe front patio has a crack through it so wide I can stick my finger in it and it has sunk about three inchesThe rear patio cracked in half and one side has sunk over an inchAccording to the builder warranty those are all warrantable conditions not to mention poor workmanship issues The builder stopped responding all together to any attempts at communication until his response several days ago to a separate septic issueWhich I only received after waiting a month after the warranty company contacted him Apparently this is a surprise? I am rejecting this response because:We reject Mr***’s response because he remains unwilling to engage in any meaningful or productive dialogue or mediation to address and resolve our grave concerns and significant financial damages incurred as a direct result of his unlicensed work on our home and mismanagement of materials, labor, and costs for the project.We tried for months to resolve these issues with Mr*** directly with no successWhen we discovered that Mr. *** had filed our home permit under a different contractor’s name and discovered that the City had placed a hold on our project when GJ failed to provide a license, we had no choice but to hire a lawyer to terminate GJ Gardner as an unlicensed contractorA couple of unproductive letters were exchanged by our lawyers this fall and then Mr*** and his lawyer stopped communicating months agoWe then turned to the Revdex.com in the hopes that a non-legal, public forum would lead to meaningful mediation and a successful resolution of our issues and financial damagesOnce again, Mr*** has stonewalled and refuses to engage in mediation or seek a resolutionHe claims that his lawyer is working on this matterIf that is the case, we wonder why Mr*** and his lawyer stopped communicating more than three months ago (we last heard from them on November 18, 2014).The fact remains that GJ Gardner completed less than 50% of our home in months, they grossly mismanaged materials, costs, and customer service, and they did not remedy the hold the City placed on our project when it was discovered that our permit had been filed under another contractor’s nameAs part of our fixed price contract, Mr*** needs to pay for the significant overruns on this project and he needs to honor his commitments to pay for the construction mistakes, closing costs for our newloan, and our construction loan payments until our home is complete (we have written documentation from Mr*** for each of these commitments)We have provided public records, invoices, and clear documentation supporting our complaints and financial damages against GJ GardnerWe feel deceived by Mr*** and GJ Gardner and sincerely hope that no one else is subjected to this horrific experienceWe appreciate the Revdex.com’s attempt to resolve this issue and we also appreciate an opportunity to share our experience in a public forum in the hopes that it will help others avoid the same pitfall we have fallen into

I am rejecting this response because:The claims Mr. [redacted] makes in his response are not accurate – we have documentation from the city as well as our bank that clearly demonstrate the falsehoods. The facts are outlined below:Mr. [redacted] claims that we did not pay for three “redesigns” on our home that GJ needed to make to meet HOA requirements. This is simply not true. We paid $1,500 to the draftsman for these changes. There was no architect on this project so the draftsman was solely responsible for revisions to the plans. It is also important to note that GJ had the full HOA requirements six weeks before their first HOA submission so they were fully aware of the requirements and they failed to meet them on two separate attempts requiring a third submission. This was entirely the fault of GJ but we still paid the draftsman for the revisions. Mr. [redacted] claims that the full basement on our house was a sales concession that we paid nothing for. This is simply untrue.  We never asked for a full basement and GJ influenced us midway through the foundation process that it would be a cost savings on construction, a benefit to our property and a free upgrade.  Nothing could be further from the truth.  In reality, extensive overruns related to the full basement (concrete, labor, etc.) were charged to our construction loan. There are also long-term financialimpacts as the additional, and mostly unused square footage for our home is now significantly larger than we ever wanted and it will permanently increase all future taxes and insurance costs. GJ Gardner’s response claims that the costs of structural fill and extra foundation work on our home were not recouped from us. In reality, more than $44,000 in overruns were charged to our construction loan at time of termination including all costs for structural fill and foundation work (our bank has clear documentation on these overruns). These charges were a direct result of poor planning on GJ’s part. They were the ones that suggested the neighborhood that we built in and they visited the lot before we purchased it and told us it would work. They had seven full weeks to create a budget and plan for that lot before we closed on our home construction loan. As part of our Fixed Price Contract with GJ Gardner, all underbids and overruns were the responsibility of GJ Gardner to pay and no overruns should have been billed to our construction loan. If the lot was too challenging for GJ or they didn't feel they could appropriately budget or plan for it they should have turned down the job rather than telling us it would work and taking it on.Mr. [redacted] claims that we never paid a deposit. That is untrue. We wrote check #[redacted] for a $4,000 deposit on October 3, 2013 to get our house project started. When GJ asked us to sign the Home Construction Agreement on November 19, 2013, he had a second deposit written in that we declined to pay as we had already paid a deposit. Mr. [redacted] agreed and crossed it out and wrote verbatim “Payable from first draw of construction loan” and initialed it. We have the original copy of this Agreement.  Mr.[redacted] failed to submit that payment request in any of his draws. By the time he demanded payment 10 months later (September 4, 2014), the significant overruns he had charged to the construction loan had eaten through any dollars that may have covered it.Mr. [redacted]’s most serious claim is that, “At all times from permit application and approval throughout construction, a GJ Gardner representative was a license holder and the licensed construction supervisor in full compliance with City of Fort Collins requirements.” The city has documentation on public record that clearly shows GJ Gardner filed our home permit under the name [redacted] of [redacted] – we had never heard of [redacted] or [redacted] and certainly never agreed to have him listed as our general contractor. To us, that is a clear case of a deceptive trade practice. The hold that the city placed on our home project on July 14, 2014 is also a public document that can be viewed online.  It states verbatim, “According to [redacted], he is not the Contractor. Monica Sweres [GJ Gardner Superintendent] will be in to update the license and insurance. Project on hold until completed.” At the time of termination on September 30, 2014, more than ten weeks later, GJ had failed to provide either a license or insurance and we had no choice but to terminate them and hire a reputable, licensed contractor.  Mr. [redacted]’s claim that this hold was related to a “primary subcontractor” is patently false, as is evidenced by the public record. The fact remains that GJ Gardner completed less than 50% of our home in 11 months, they grossly mismanaged materials, cost, and customer service, and they did not rectify the hold the city placed on our project. As part of our fixed price contract, Mr. [redacted] needs to pay for the significant overruns on this project and he needs to honor his commitments to pay for the construction mistakes, closing costs for our new loan, and our construction loan payments until our home is complete.
