At that point, it was obvious that the best solution was to cancel the one year lease she had signed and to refund the rent for August, Both of those were done on August 4, 2016.The security deposit was withheld for the following reason; Page 1, line of the lease agreementSECURITY DEPOSIT Tenant agrees to pay a refundable security deposit before occupying the premises in the amount of $in the form of check or money orderWe will not accept cash at any timeThe security deposit shall be returned within days after proper termination of this agreement along with a written accounting of disposition of said deposit after Tenant completely vacates the premises provided: the return of keys to the Landlord, inspection by the Landlord of the leased premises showing the premises to be in a clean condition with no damage, ordinary wear and tear excepted, all utilities that are the Tenant’s responsibility have been paid for in full and utility providers have been properly notified of the Tenant’s departure, and all other conditions and terms of this agreement have been satisfactorily fulfilledIf Tenant defaults under this lease in any way your security deposit will be forfeited and you will be liable for liquidated damagesThe security deposit shall at no time be applied as rental payment by the Tenant The security deposit may be used by the landlord as reasonably necessary to: remedy Tenant’s defaults in payment of rent, clean premises and/or to repair damages caused by the TenantShould damages to the premises exceed the security deposit, Tenant agrees to reimburse the Landlord for actual expenseIf any portion of the security deposit is used during the term of the tenancy to cure a default in rent or to repair damages, tenant agrees to reinstate deposit to its full amount within days of written notice delivered to Tenant by Landlord in person or by mail Any reservation fee Tenant pays to Landlord prior to occupancy is non-refundable. A reservation fee is not a security deposit. However, Landlord may, at Landlord’s discretion, apply the reservation fee of Tenant to the security deposit Tenant owes under this Lease. But such reservation fee will not ever be considered a security deposit until Landlord declares such amount a security deposit and Tenant actually occupies the premises.

Mr***, Your daughter was offered a clean unit and you declined that offerOur company did everything in our power to respond to the pest control issue as soon as it was discoveredThe rent payment for August was refunded immediately and your daughter was allowed a release from the one year lease agreement that was signedNo further action will be taken in this matter. Furthermore, I request that you stop your harassing phone calls, foul language and posting on the internetI have been very communicative and responsive throughout this entire process, however I will not tolerate harassment. Thank you

The issue was discovered by my cleaning crew on 7/30/and reported to me the next morningOn 7/31/I sent the attached email to the incoming tenant, alerting her of the issueThe entire building (which is standard practice with a pest control issue) was treated by my pest control vendorUnfortunately, these types of pests require numerous weekly treatments to completely exterminateAfter a few weeks, the building was pest free.? The cause for this particular unit to have such a problem was due to the previous tenant not reporting the issue which allowed the problem to worsen.? Please let me know if I can provide any further information.? Thank you
