I rented from this apartment complex for roughly two years and my rent fluctuated drastically every month. From one to two separate water bills a month. There was never a valid reason or justification as to how they just called it overages. We had no option but to pay it as we had to pay for our water through them. I retired from the ARMY two years ago and decided to recently buy a house here so I asked about the procedures in breaking my lease. The fee went from one months rent to one and a half months rent of which had to be paid within 7 days of submitting a notice to vacate. I paid a cleaning service to clean my apartment until it was spotless of which I have photos and they still added charges for cleaning. They even added charges dating back to November all the way up until February that I had already paid during my months of living there paying rent totaling $300. When I asked if a payment arrangement could be made they gave me a suspense of three days or my account was going into collections. I received a letter in the mail with two separate final amounts due and it indicated that I had 14 days to pay from the date posted on the letter of which was the 21st of February. I emailed them stating that since I was still in my window I would like to pay it. The apartment manager Beth H states that she had already sent my account to collections. I still had roughly a week to make payment of which I was prepared to do but she had already sent up my account and now I have to go through collections and I live on a fixed income as I live off of disability.
Correction to a credit report Remove my account from collections and take it off of my credit report so that I can pay the amount even though I don't agree with the final adjustments. I really feel like I was ripped off as there are other complaints for the same type of activity on the internet from other people.
This firm represents Glen at Alexander Apartments regarding the complaint filed
with your agency by ***. Please accept this letter as my client's position
statement as to the complaint.
In general terms, my client denies any and all allegations of improper conduct as it
relates to Ms. complaint. By way of background, Ms. and Glen at Alexander
were parties to a written lease agreement for the rental of an apartment located at Glen at
Alexander for a lease term which began on August 22, 2019 and which was scheduled to
terminate on August 21, 2020 (hereinafter "Lease"). Pursuant to the Lease, both parties
agreed that Ms. would pay for all utilities for the Premises for the duration of the lease
term. At the time the Lease was signed, the parties also entered into a Utility Addendum
which set forth additional obligations and charges for utilities for the apartment.
Ms. first complains that her "rent fluctuated drastically every month."
Pursuant to the Lease, Ms. agreed to pay monthly rent in the amount of $1,240.00 per
month, which was charged to her each month. Ms. rental amount for the premises
never fluctuated; the fluctuations complained of consisted of monthly water and utility bills
for the premises which naturally would fluctuate based on usage. Furthermore, as the water
bills were based on usage, the water bills were billed in arrears for the previous months' usage.
At no time was Ms. charged any amount in excess of her actual water usage, and
pursuant to the Lease, Ms. agreed to pay all charges associated with her utilities in the
premises.Ms. also appears to complain about the process by which she was permitted to
terminate her lease early. Pursuant to the Lease, all parties agreed that the lease term would
terminate on August 21, 2020 and agreed that except in limited circumstances not applicable
to the present case, Ms. liability under the lease would continue for the full lease term
if she moved out early. In December 2019, Ms. advised Glen at Alexander that she
wished to move out early due to purchasing a house. In response, Glen at Alexander offered
Ms. the ability to buyout the remainder of her Lease by paying an amount of $1,860.00
to be paid with her January 2020 rent. Ms. accepted Glen at Alexander's offer, paid
the fee, and was released from her remaining obligations under the Lease when she vacated
the premises on January 31, 2020.
Finally, Ms. appears to complain that she was charged for damages to the
apartment upon her move out. While Ms. may have hired a cleaning company, upon
inspection of the apartment once Ms. vacated, Glen at Alexander determined that there
were still several items that were not cleaned which required Glen at Alexander to further
clean the apartment. All charges levied against Ms. for cleaning were due to her failure
to return the apartment to Glen at Alexander in the same condition in which it was received,
normal wear and tear excepted.
Accordingly, it is Glen at Alexander's position that it has handled Ms.
complaints and tenancy in accordance with acceptable business practices and in accordance
with the Lease and Georgia law. However, should this response not address any aspect of Ms.
***'s complaint or should you need additional information, my client is happy to further
respond.
