Glen at the Park

On November 30, Mr*** requested that we hold an apartment for him. He put down a $holding deposit and a $application fee, when doing so Glen at The Park made his selected unit not available. In addition, Mr*** completed and signed the rental application.On the back
of the application in Paragraph 7, If you withdraw before approval (attached) it states,"You and any co-applicants may not withdraw your application or the holding fee. If you or any co-applicant withdraws an application or notifies us that you've changed your mind about renting the apartment, we'll be entitled to retain all holding fees as liquidated damages, and the parties will then have no further obligation to each other."Glen at The Park requires that applicants put down the holding deposit ($400) and an application fee of ($per applicant) in order to reserve an apartment. We require that applicants put down these fees to ensure that if we take an apartment off the market, making the unit not available to other potential renters, they are in fact going to move into the unit. Mr*** contacted our office on December 4th to cancel his reservation as he had changed his mind. Under paragraph of his signed application, we are entitled to retain the holding deposit as liquidated damages. Glen at The Park hopes to rent to all those who are qualified, when applicants ask for units to be held and then back out later, we loose money and opportunities to rent the unit to serious renters.As of today December 6th, per Mr*** request during our phone conversation and his acknowledgement in this complaint, Glen at The Park is still holding his unit for him until further notice

It is known that MS. [redacted] has a German Cockroach infestation.  [redacted] was sent to treat this infestation on 09/05/17, 09/11/17, 09/18/17 and 09/25/17.  All four times pest control was scheduled, it was noted that she was not prepared for service or refused...

service therefor they were not able to treat her home. (service reports from [redacted] attached)  Then after switching Pest Control companies, [redacted] was sent to treat her home on 10/16/17, 11/13/17, and 11/20/17.  Again all three times that [redacted] was sent for treatment, it was noted that they were unable to treat because she was not prepared for service (service reports from [redacted] are attached).  Treatments are scheduled on Mondays and residents receive the preparation guide the Friday before, Ms. [redacted] is well aware of the preparations that are required in order to treat her home.  Per the signed Pest Control Addendum in the rental agreement, Ms. [redacted] agreed to pay $150 each time she fails to cooperate. (Signed addendum attached).  Though Glen at the park is entitled to charge a total of $1050 ($150 x 7 times uncooperative) we only exercised our right to charge this penalty of $150 one time.  Ms. [redacted]s failure to cooperate is not only negatively affects her unit, but since roaches are known to travel to other surrounding units.  It is not fair to those around her that do prepare for the treatment, when they are unable to get rid of the problem because they continue to come from Ms. [redacted]s home.
