Paid rental application fee for property listed on company webpage. Property turned out as unavailable but agency refused to refund application fee.On Saturday, Dec. 13, I paid a $75 application fee online via debit card to hold a property listed by the Glenwood Agency on their website. The application specifically asked for details about the address, rental price, and unit number of the desired property. I called to follow up and schedule a showing for the property applied for on Monday 12/15. Agency representative, [redacted], scheduled the showing for Wednesday, 12/17 afternoon. Upon arriving at the unit building, I was shown a different property than the one applied for. [redacted] then informed me that she had already noticed the address applied for was not available through their agency, but was showing me a unit they had available in the same building. This was a unit that I was not interested in and did not fit the same criteria as the desired property applied for. When I asked her why she didn't mention discrepancy in addresses when we spoke on Monday, she said that she "figured it was just a mistake". She then informed me that the only properties the Glenwood Agency shows/accepts applications for are those listed under the "Featured" section of their webpage. However, there is no mention of this on the webpage or way to know that only a select number of the advertised webpage listings are available through the Glenwood Agency for application. I did not want the property I was shown and specifically put the property I intended to apply for on the application. I had no reason to believe this application wasn't valid based upon [redacted]'s review of my application and the available website information. When I asked for a refund of my application fee since I wasn't shown/couldn't rent the property I applied for, I was told by [redacted] she would only refund $25 of the $75. She said this was because they ran my credit report. However, they ran the credit report even though they knew the property I applied for wasn't available through their agency. This was a mistake on their end, as communicated by [redacted] at the showing. They were aware that the property I applied for wasn't available through their agency, but accepted the application, showed me a unit I wasn't interested in, and ran the credit check anyways. Lastly, there is no way of knowing from the website information that some rentals aren't available and should not be applied for ($75 fee!). This is very misleading. [redacted] offered to refund a small portion ($25) rather than the full refund requested. Due to the negligence of the Glenwood Agency to communicate that some property listings on their website should not be applied for, and the fact that they still collected the fee and ran a credit report for a property they were aware I did not apply for, I feel like I deserve a full refund. [redacted] was extremely demeaning, abrupt, and inappropriate when spoken to about this situation. She merely informed me that there was nothing she would be willing to do and hung up the phone. Typically, anyone who submits an application on our website will call and talk to over property manager about a property before paying the $75 application fee and applying online. On our rental website, it says in bold capital red letters "WE REQUIRE A NON-REFUNDABLE APPLICATION OF $75.00 PER APPLICATION." On our rental web site, our listings are listed at the top of our rental website as "Featured Rental Listings." We have a condo listed at [redacted] which is a two bedroom two bath condo for $1,595. The application submitted was for [redacted], which is not one of our listings. On December 15, 2014 [redacted] emailed me saying "her roommate has decided to hold off on filling out the 2nd application until seeing the property just in case it is not what we were looking for." According to her email [redacted] must knew that once an application is submitted and the $75 fee is paid that it is non-refundable. Once I met [redacted] and her friend on December 17, 2014 at the [redacted] I realized they wanted to see another condo another agencies' condo. The condo listed at [redacted] is a listing by [redacted], Inc. and happens to be the same exact unit and the same price. They seemed to think the unit [redacted] they had applied for was a different unit but it is the same exact floor plan and price. [redacted] was very irritated that the condo I showed her at [redacted] was not the same floor plan as [redacted]. [redacted] demanded a refund for her application and I told her our application fees are non-refundable per our company policy like it says on our website when applying for a property. I told her I would ask my broker in charge about the possibility of a refund anyway and let her know as soon as possible. On December 18, 2014 I left [redacted] a voicemail that I cannot refund her application fee. On December 18, 2014 [redacted] called back and wanted to speak to someone in charge about the application fee refund. She spoke with the broker in charge [redacted] of which she was offered a refund of $25. We are charged by [redacted] when running the background and credit check on applicants. [redacted] refused the $25 and hung up the phone on [redacted]. We incurred the expense of the credit check already and have to pay that invoice hence why we offered to send her the $25 which is our profit in the application fee after expenses. In conclusion, [redacted] submitted an application on our website for a property that belong to another real estate office therefore we could not rent the property to her because we are not the managers of that property. We offered her as a courtesy a refund of our profit of $25, and we had been charged the $50 from our credit company and she hung up the phone on us. We are still happy to refund her the $25 at this time if she would like.
