From the attorney: "This file is a product of different challenges that occurred in the process of developing the file Unfortunately, this was a real estate transaction without the benefit of professional realtor guidance For instance, the [redacted] wanted their check right after they finished signing in February, Only cash deals, not lender funded deals can pay out immediately This was explained to the customers but they were unable to appreciate the reason for having to wait, such as lender approving the documents, then sending us funding, etc When we scheduled the buyer [redacted] to come in, at the closing table, we discovered that there was an additional $2,in taxes due on the property he was purchasing from [redacted] He had told [redacted] that but she did not communicate this fact to [redacted] What happened at the closing table was the discovery of added tax accounts [redacted] had to update tax certificates and payoffs for the tax suits the certificates reflected, then convey that to the parties and send revised documentation to the parties Although Alamo should have raised the issue of taxes owing, we honestly believe that the status of the taxes was well known by the parties, especially the seller Added to this, the lender doesn’t fund until to hours has passed from the day of closing The other issue that arose was that on the closing instructions, the lender chosen by [redacted] ***, said that they were sending their funds through an “EFT transfer” Our accounting department told [redacted] that Alamo Title has a block on governmental funds, something of which [redacted] was unaware Compass Bank said that it didn’t know about the “block” on governmental funds, a measure to avoid the difficulty of tracking these funds In the future, when there are governmental funds coming in, we should call our accounting department and our bank to let them know that there is going to be a wire and to be on the lookout for these funds Once identified, they will put the money into our account [redacted] was aware that governmental funds were coming in but not aware that Alamo Title has a block on these fundsThe Sellers were [redacted] and [redacted] They closed first and hence, were the most anxious of the parties to the transaction The first time that [redacted] met them was at the closing table It was at this time that [redacted] was being apprised that more taxes were due and owing Because of the Earnest Money Contract, which the parties drafted on their own with our template, the issue of taxes outstanding, how much was owed and who was to pay the closing costs was not clear This naturally added to the anguish The Buyer said he was not going to pay the closing costs to which the Seller responded with a refusal to sign To preserve the parties’ deal, we went the distance and waived our settlement fee of $for the [redacted] One would have thought that our efforts to ease the process and incentivize their signing of the closing documents would be appreciated that was not the case When it comes to their critique about us not communicating with them, we proudly reference numerous emails sent to them on top of the countless phone calls handled with the [redacted] in an effort to respond to their self-drawn agreement." I am rejecting this response because: The attorney failed to account for the months and months they took before we actually closed multiple times because the paperwork was wrong It sounds like he is trying to blame us for the tax mistakes Isn't that the whole reason for the title company? To research what liens there are on the property??? I guess we should have done that for them?? We finally received our money The attorney and his employees can make all the excuses they want The fact is they are completely incompetent I would NEVER recommend this title company to anyone It was a terrible experience.

We have verified with the lender that " There wasn’t supposed to be a Credit Card Payoff, on this transaction their response was "That is correct, just the principle reduction." The customer would have to take this issue up with their lender as we followed the lenders instructions
