involving his vehicleAt no time while he was investigating the same was he acting on behalf of this dealershipHis actions at no time arose out of or in connection with his employmentHe chose to investigate the accident after hours on his own timeAs a result of the fact that he used customer information for his personal purposes, he was disciplined and ultimately discharged from his position with this dealership*** *** was contacted by my Service Manager and offered a 15,mile service maintenance, a $value, free of charge along with our deepest apologies for her inconvenienceThree attempts were made to reach *** *** before ultimately making contact with her, including the night of the occurence

Mr*** purchased a policy from *** ***, the owner of *** *** Insurance Agency, an independently owned agency, in July of for his residence. *** *** is no longer in business as of and GlobalGreen Insurance Agency now owns the policies. GlobalGreen has been
auditing the policies to determine their accuracy and discovered that Mr***'s policy was originally written incorrectly. Mr***'s residence is a mobile home yet the coverage was written on a home-owners policyMr*** was notified that the policy would need to be re-written in order to have his residence properly insured going forward.In response Mr*** responded that he wanted the premium he had paid for the past six years returned to himMr*** was informed that he could contact Mr*** ***) to discuss a return of premium but that we did not assume any of *** ***'s prior actions. He was also notified that had a claim occurred during the past six years that the insurance company would have been obligated to pay the claim since they accepted the policy and the premium paymentsHe was also informed that if for some reason the insurance carrier found a reason to deny the claim because of the incorrect policy form, *** ***'s errors and omissions insurance coverage would be responsible for the claim and that *** ***'s coverage was valid for two years from the close of the agency.In reviewing the information that is available in the file when the original quote was provided, the Agent has hand written notes denoting the *** residence as a one story home, built in and on a walkout basement. The coverage placed on the residence was $117,and the application was signed by Mr*** on July 23, stating that the information was correct.We notified Mr*** of the issue with his policy after our audit, not the other way around and offered to re-write the policy for him. Mr*** had no interest in getting the policy correctedHis only interest was in collecting the premiums he had paid the past six yearsIn fact he stated to me that if we didn't pay him the money he would report us to the BBS (I am assuming he was referring to the Revdex.com)If Mr***'s goal is to have his mobile home protected under the correct policy as stated in the complaint, then we are prepared to place the proper policy on it as we offered to do when we notified him of the situation
