Initial Business Response /* (1000, 5, 2017/11/01) */
The satisfaction of all our clients is our highest priority. We have deep regret that [redacted] had a poor experience with us. Master Al has been teaching over 30 years with 1000's (thousands) of positive testimonials. In the following paragraphs...

and attached documents we will demonstrate how we have more than fulfilled our end of the agreement.

When the hitting incident was brought to our attention, the boys were sat down and spoken to in regards to hitting. There were no marks on [redacted] neither of them was upset or crying. [redacted] is older and twice [redacted]'s size. Regardless, Master Al spoke with [redacted] in front of [redacted] on this occasion about bullying and standing up for himself. Master Al also spoke with the class and [redacted] on other occasions about bullying specifically to address some issues [redacted] was having in school. Done for a local police department, see attached document, Master Al's Bully Speech.

The class policy allows Extreme Martial Arts to close for 3 weeks per year without make-up classes given. Although, EMA still provides make-up classes for any and all students who wish to make them up. Please see attached document "Class Policy" signed by [redacted]'s husband.
We don't believe anything is misrepresented on the website and we offer classes for children up to 5 times per week. An 11yr old has never been lead instructor for any classes at EMA ever. If the 11yr old is referring to Master Al's daughter, as a 10-time jiu jitsu champion she is more than qualified to teach a class but as mentioned it has never happened. All instructors at EMA have gone through a five figure ($10,000) training program in Miami.

If they did not receive the free equipment it should have been brought to our attention. Anytime we did a drill that required shin pads or mouth guard he had shin pads and a mouth guard. Otherwise, [redacted] would not be able to participate in class.

It was suggested to [redacted] for [redacted] to try a different class and time to help him improve. This shouldn't be confused with an attempt to put him in a more advanced class where some of the students were actually younger, smaller and less experienced. At times students are weighed to better match their training partners. Please see attached document, Sign in Sheet.
[redacted]'s son was given a notice of intent to promote and he was asked "do you feel more developed in your attitude, behavior and character?" To which he replied "yes" and in his own words "I have confidence". He also writes a paragraph stating he is "stronger and more confident... given me the confidence to defend myself". Please see attached document, Intent to Promote.
Initial Consumer Rebuttal /* (3000, 7, 2017/11/06) */
(The consumer indicated he/she DID NOT accept the response from the business.)
I do not accept the response from Extreme Martial Arts.
Al [redacted] may have been teaching for over 30 years and has positive reviews but there are negative ones too. If you check online at various websites you will see just that. All but one review for this year has been negative. The only positive review I found is from a [redacted] and I know she works for the business so that may be biased. On the Yelp website you will find a review from a gentleman dated April 10, 2017 that expresses the same complaints that I have. He even states there was a preteen teaching the class. He goes on to say that Al is rude and disrespectful which I agree with. Another man posted on Facebook two years ago a positive review, but then three months ago wrote on Google review that the business went downhill. Most past reviews are dated 2012- 2016 and talk of employees no longer working there today. My point is the business seemed good years ago but now has dissatisfied customers.
In regards to the bullying my son was faced with, yes Al talked to me and [redacted] I do not know what he said to my son. As for me, Al told me he would not yell nor discipline his son due to the fact his ex-wife and her boyfriend do that. Al admitted his son must be acting out due to his divorce. Al went on to say in our conversation how his business is not doing well because he can't focus on it due to his divorce. He then went on to slander her and tell me inappropriate details for which has nothing to do with his martial art class, me, or my son. I take offense to stating my son is bigger than his so he couldn't be bullied by him. [redacted] was upset by this whole situation. I had to answer [redacted] when he asked "what did I do to him?" [redacted] is intimidated by Al and is afraid to speak up. I witnessed every incident with my own eyes and not one adult took action till I spoke up. The other incident happened with [redacted] own grandson. That class [redacted] was repeatedly smacked in the face while adults stood around not saying a word. [redacted] told the kid to stop and tried to get away from him. I stood up told [redacted] to get his stuff and we were leaving since no one wanted to reprimand him. Till this day Al has never spoken to me about this incident. Not one class we attended has Al ever spoken about bullying to everyone. In a text message we asked how Al was going to handle the bullying plus kids class and his response was "what would we like to see happen?" We told him to have an intro kid's class and [redacted] needs to learn the basics; Al responded the next day by just stating classes would start July 10. After that conversation by text we never spoke to Al again due to him not coming to business or just ignoring us.
As stated before I am not the only one who witnessed a child teach class. I am not referring to his daughter; I will not say the name of who I am referring to. I will say I have had conversations with this child's parent and they also said Al wanted her to teach others. Extreme Martial Arts seems to expect students to teach other students when they did not sign up to do that, if so why hire instructors. In our whole time there we have never been offered classes up to five times a week. I still have the paper we received stating intro kids class was to be Mondays and Thursdays at 5pm. Yes [redacted] had shin guards and a mouth guard because we purchased it when the business failed to provide it after we did ask.
In regards to the claim they suggested [redacted] try a different class and time to help him improve is 100% false. He was given a letter that states how much Al is impressed with how much he has learned and is ready to go into the high intensity Combat Athlete Program. We did not want him in that program but Al stuck him in that anyways. [redacted] was not ready to be in a higher class he only had done a couple months of martial arts and still had a lot to learn. Al put him in that class because there was only one other kid in the intro class. That child also was put in the Combat Athlete Program when they didn't sign up for it. That letter was only given to [redacted] because he didn't have enough students for an intro kid's class. Yes [redacted] was weighed and Al told me to put my child on a diet. Al only paired up [redacted] with kids who were green and orange belt, which means they were more experienced than [redacted] During this time Al was oblivious to what was going on in class because he only focused on kids who were in competition. Al would talk to parents about upcoming competitions instead of conducting class. My son not being a competitor was usually left sitting against the wall while the kids practiced for their competition. This is why we didn't want any other class but the intro class. The instructors would try to help students get better at moves and Al would stop them. Al's way of conducting a class is to tell students to practice a complex move and then go sit in his office. In the one hour class there are more games being played than actual martial arts. We signed him up to learn martial arts not play dodgeball.
When [redacted] was given the intent to promote that was given by the instructor Jason. Jason had been teaching [redacted] since kids intro class started for second time and worked one on one with him. Jason did have the patience for kids. [redacted] letter stated he can do anything after completing breaking the board which Jason helped him do. Jason watched the kids practice and corrected their mistakes; I cannot say that about Al's teaching. It was Jason's idea to promote him, for he saw [redacted] progress in just that short time he worked with him. [redacted] did deserve to be promoted he worked hard and through all the negative situations there. We paid a lot of money and were determined to come to class and not let Al win by keeping our money with no student. I told Jason numerous times we would not stay signed up as long as Al was involved with business. We hoped Jason would take the business over because he knows how to conduct a class. Without Jason that letter would never have been written. When a person is promoted the class congratulates them. [redacted] had a total of 4 people to see him get his belt, myself and Jason included. In a sense it was sad because there were no classmates to see and Al couldn't be bothered to see it either.
In the attached documents one was a makeup class dated September 23, 2017. That is a false document. We never attended a Saturday class. I know exactly where we were on that day and it was nowhere near the place of business. On occasion [redacted] would sign in class only to be told the paper that was out was for the wrong day. They obviously kept the wrong sign in papers and now are using it against us as if they really did a makeup class. EMA states they provide makeup dates but as November 3, 2017 we have never been contacted with any times to do so.

I do not accept their proposed agreement due to my beliefs. The agreement does not meet my expectations.
