To whom it may concern,

I am writing to ask for your help. I have tried several times to return a vacuum cleaner to a Kirby Distributor located in Roseville, CA ([redacted], Distributor of Global West Solutions LLC located 1803 Cirby Way Suite 1, Roseville, CA, 95661).

1- The Global West Solutions LLC Company is a distributor of Kirby Cleaning Systems. On 11-4-2014, two sales people from Global West Solutions LLC showed up at our house unsolicited. I was not home, but my wife let the sales people in and she allowed them to demo their vacuum cleaner in our home. I got home later when they were half way through their demo. My wife said that she wanted me to purchase the p[redacted]uct. I knew nothing about Kirby Vacuum cleaners, neither did my wife, but we decided to trust the strangers and let them pitch us their p[redacted]uct. I was not able to agree to some of their contract so the sales person did some negotiations which was great. An example of something that we agreed to was that they first monthly installment would not be due until February 2015. I found out later that he was writing the terms like this one that we were verbally agreeing to down on a piece of paper that was a different piece of paper other than they security agreement. The security agreement I signed prior to reading the fine print was much different than what the sales persona and I discussed. I found out later after researching the Kirby p[redacted]uct that the salesperson charged me about three times the amount that the p[redacted]uct was selling online. So, my first issue is that they misrepresented what I purchased. He was not jotting down the purchase terms on the actual contract, he was deceptive and tricked us. My wife and I looked online and discovered after the fact that Kirby has thousands of complaints from consumers like us online that are also reporting deceptive sales tactics.

2- The nest issue is that according to the contract, we are entitled to a three say cooling off period. By law, we are supposed to be able to ask for a return and refund if we are not satisfied with our purchase. Well, Global West Solutions LLC would not return our calls and respond to our request to return the p[redacted]uct while we were within the three day cooling period. I’ve tried correspond with them several times since and they do not respond to me. I sent them certified mail several times and both letters got returned weeks later because [redacted] was not accepting of them. Very dishonest to promise a three day return and then do a disappearing act. More misrepresentation and deceptive sales tactics. 3- Next, these guys had a third party contacting me and trying to collect payments from me. I have told them about how we were lured into entering a contact that is different from the one that we thought we were signing. We were told by Global West that we wouldn’t have to start making payments until February, and we were also told that we would not need to pay interest on the loan during the first year, and also that we would have three days to return the p[redacted]uct. This information fell on deaf ears. This company, Merchant Acceptance Corporation, said that they want my money, I signed a contract and I have to pay my debts-they said. I haven’t made a payment since that first meeting when we had to make a $150 deposit, so they called many times and would not really sympathize or help me try to get the p[redacted]uct returned back to Global West Solutions and be refunded for the money that these people were aggressively trying to collect from me. I finally told them that they were not allowed to contact me anymore.

4- The Kirby Company website states that they have a cancellation procedure based on Golden Ager/Disabled Consumer Purchase Cancellation Procedure which is available up to nine months from the date of purchase. I have a disability and I suffered so much from my disability that I lost my job in December. So, I clearly, should be able to refund this Kirby p[redacted]uct under the disability procedure. So I contacted Kirby Consumer Relations and was told that I need to provide verification from the Social Security Disability Administration which would verify my disability is a real thing, which was no problem because I can get a letter to them very easily. All I had to do is log into my account at the Social Security website and print this letter out and fax it to them. Kirby required that I provide them with a doctor’s note that states that my disability restricts or prevents the consumer’s use of the Kirby Vacuum System. My doctor at [redacted] is not allowed to mention a company name like “Kirby” or their p[redacted]uct information in the letter because of company policy. But she said that my disability when I’m depressed because I am so fatigued can restrict my usage of these vacuum cleaning p[redacted]ucts. So I provided these needed documents to Kirby Consumer Relations and they said they would provide them to the Global West Solutions LLC distributor and let him resolve the issue with me. So, on 5-8-15 I finally hear from this man that has not made himself accessible to me, [redacted], who sent me a letter which said that my disability was not qualified as something that would fulfill his requirements for what he considered was a disabling quality. He said that my disability was not a physical disability so it does not count. The Consumer Relations people at Kirby never said that the disabling quality had to be a physical impairment nor does the verbiage of how they described the cancellation policy in writing. [redacted] is not qualified to diagnose whether or not someone is disabled or is disabled enough to fulfill this Disabled Consumer Purchase Cancellation. I think my doctor has already cleared me of this with his note to the company.

This whole ordeal started with a unsolicited door to door salesman who worked for Global West Solutions LLC and this man [redacted] who I would like to refund the $150 down payment that I paid to Merchant Acceptance Corporation and I insist that he makes arrangements to have me released from all the late fees, penalty fees and debt, If they try to hurt my credit or retaliate in anyway, I will pursue legal action. When I read his denial letter, I felt like he was proud to deny me. He sent out his people to my house to take advantage of me and my family in our home and it is a trap they set. They sat at our dining room table and lied to us and every step of the way, we have jumped through hoops and they either don’t respond at all or it’s to make us jump through more hoops, some that I haven’t even mentioned here.
