Between January 2015 and February 2015, I paid $289.50 total for cheerleading competitions that were supposed to occur in Nashville and in Southaven, MS. Glory Gymnastics decided not to take the cheer team to either of those competitions. They stated each time that the funds would be applied to a future competition. On Feb 23, they stated that they would not be going to Nationals either and that this was the end of the season ("This is not the way we envisioned ending our season"). On May 28, I requested my cheer fees be returned. The Booster Club's reply was that state laws prevent them from reimbursing money. They did not expound on which laws they were referring to. They stated that they are a nonprofit organization and my payment was now a donation.Their handbook states that they don't give refunds because they forward competition fees to the organization hosting the competition. Once those funds have left Glory Booster Club, they are not refunded back to Glory. Therefore Glory cannot refund them back to parents. However, in this case, the funds were never paid to a hosting organization for a competition (as Glory admits when they state that they are keeping my fees as a donation). I don't have a problem with the Booster Club applying fees to future competitions or classes, but I do have a problem with them converting the fees to a "donation" against my will after cancelling our participation in the competitons (competitions that I was still willing to attend even with an injured daughter who could only observe and support the team). By paying in good faith, I took a risk believing that we would attend a competition. The Booster Club (and its parent company Glory Gymnastics/Top Notch Gymnastics) did not take the same risk, and is choosing to hold my money. If the company never made payments towards a competition, it is unethical for them to cancel our trip to the competition, choose to keep the money, and use it as they please rather than being honest.Desired SettlementI would like Glory Gymnastics Booster Club to refund my fees for which I received no services or products or to credit the costs towards tumbling classes.Business Response As stated in the complaint, our handbook states we do not give "refunds" for competition fee's. This is reviewed and agreed upon prior to competition season by all participants. In the case of the final competition, due to an injury to a key member, the squad was unable perform at the national competition due to safety concerns. The complaint is mistaken and all monies paid remain in the Glory Booster Club and can/will be used toward future competition fee's. The Glory Booster Club is a Not For Profit organization and all monies paid go directly toward competition fee's. In conclusion the paid competition fee's will be applied to future competitions if the athlete chooses to compete. I am not mistaken in this fact.The handbook says under the section "Competition Fees" that the fees I paid for competitions are "paid in advance to the sponsoring organization and not refundable to Glory Gymnastics;" therefore, Glory CANNOT give refunds. In this case, that doesn not appear to be true. Glory Gymnastics never paid to reserve the team's spot in a competition after receiving my January fees, but went on to collect fees from me in February as well. My children were prepared to go and support the team even if one of them could only observe, but not compete due to an injury. I suppose that the several hundred dollars I paid (and we are not rich people) will be given to another child this upcoming season. That appears to be the way this works.I still have a son and daughter taking gymnastics there and I would like the money to be applied to their account instead. This situation is really putting a bad taste in my mouth, and my reviews of Glory will be tainted by this incident. If it were a small amount of money at stake, I would let it go. However, in this case I cannot recommend the Glory Cheer Squad or Booster Club to other parents without warning them of how they may not receive services for the money they invest in this program.
