Review: I was contacted by GMAC/OCWEN counselor [redacted] due to my inability to meet my mortgage payment requirements. [redacted] advised me to complete a financial analysis packet to determine if I was eligible for a loan modification. After completing the packet I forwarded to GMAC. Another counselor contacted me shortly thereafter informing me that I had been approved for a three month trial period payment plan. Further stating, that if I followed the terms of the 3 month plan, this payment amount would be my new approximated modified amount. During the three months I made all payments on time. I was contacted weekly by [redacted], updating me on the modification. During this time [redacted] contacted me to tell me that the Title Company had located what appeared to be 2 leans against my title. I informed [redacted] that this information was incorrect and that there weren't any leans on my title. I told him that this had occurred once before when I was attempting to refinance a mortgage. Companies will place leans on titles hitting on the name in stead of the property if in fact you have a common name ie. [redacted]! [redacted] informed me that I need to contact the Recorder of Deeds office have a title search completed to show a clear title. I visited the recorder of deeds office and they showed me that there were no leans against my property. I recontacted [redacted] and he told me that now I needed to obtain documentation from the two companies however he had no contact info for either of them. I researched and obtained phone numbers for them. After making contact I was told by both collection agencies that there was nothing against me. I contacted [redacted] again sharing the phone numbers of the agencies and was told that I needed documentation. I told him that they had no obligation to give me anything on something that doesnt exist. I spoke to several supervisors ([redacted],, [redacted] etc) at GMAC and was rudely told repeatedly that it was not their job to contact these agencies. [redacted] called me and told me that he was sending a form that I needed to sign to verify my claims of a clear tilte were true. I sign the form and returned it to him. I then received a call from [redacted] informing me that he had received the form, however, due to my inability to prove a clear title, my modification was denied due to the trial period expiring! I demanded a supervisor once again begging for the title companies info, and I was finally given the phone number. I contacted [redacted] at [redacted]. who told mew that my title was in fact free and clear! I then contacted GMAC again and was now told that I was too late and the trial period had expired and that my account was now in default, and full payment was due immediately. And then adding insult to injury, I was told that I could always reapply for a modification! I was also sarcastically told by [redacted] "you can afford you mortgage payment anyway according to what I see"!Desired Settlement: I have had numerous "recorded conversations" with various employees at GMAC. I have been promised over and over again that the only thing holding up my modification was a clear title. I have gone through all the frustration steps possible to prove to GMAC that my title was clear all along however my attempts were futile. I requested on several occasions that these collection agencies forward me documentation that there I had no financial obligation to them. I was told by both agencies that if I had an obligation to them they could forward me a letter. However because I never owed them anything there was NO SUCH DOCUMENTATION TO GIVE that they are only a collection agency. I even shared the "public record" website of the recorder of deeds so that GMAC could see the title info themselves! I followed GMACs directives down to the letter! I have gone above and beyond the call of duty to substantiate my claims of a clear title. I honestly believe that when OCWEN took over GMAC (during this modification trial period) that a decision was made to negate my modification and they are using this "clear title" issue as their basis. My title was free and clear from the onset. I am so angry, frustrated and humiliated by this process. I have been lied to over and over again! The proof of my claims can be verified by the recorded phone conversations. If reviewed these calls will proved what I was promised, inconsistent information, extremely rude and degrading customer service by individuals whom GMAC/OCWEN employee to represent them as supervisors! Its incredible how extremely dismissive they have been with the roof over me and my children's heads! Please advise me of my recourse!!!!!
