Seller (complainant) has been working with us for approximately to weeks, and had consulted extensively with my agent, *** *** *** regarding a listing appointment with Seller Seller had preliminarily agree to list at a certain price, and during the course of the meeting we
engaged in extensive discussions regarding pricing, market timing, the start and end date of the listing, and the price.during the course of our (approximately 3-hour long) meeting, we covered such questions as the listing price, which ultimately they decided they wanted to change slightly; the duration of the listing and start date, which we also changed slightly; the commission rate and how it's applied to the buying and selling sides of the transaction; and we executed a complete listing contract and ost of the disclosures as wellBy the time we left, we had established that the Sellers were going to finish some project that week and that we would be engaging a professional photographer the following week, and then the listing would commence
The next communication was to come from the sellers letting us know their projects were done However, instead, the sellers called me a couple nights later and that they thought they had perhaps tentatively signed a contract with a agent previously, despite having signed on our contract that they had no previous obligation I suggested that I come take a look at the "papers" they had, and Josh, who was the one on the phone with me, said he'd check with *** about that, and hung up Some time later that evening, I received an email from *** that was strongly worded, demanding that I send her a Cancellatuon of Contract Clearly, they knew quite well that they DID sign a contract I have consulted the attorney staff for California Association of Realtors, and we are within our rights to retain this listing I have been cordial, honest, and up front with the sellers, and am happy to continue with a friendly transaction However, the sellers are complaining because they found a discount broker that would undercut our already discounted commission and they want to hire that person strictly because they believe they will save a small sum of money with this other brokerageAs a final clarification, these people are complaining to the Revdex.com because they wish to violate--to breach--a contract with me and I am not agreeing to allow it This is not a reasonable complaint

April 13th was my first encounter with agent *** *** ***April 16th *** *** *** brought a potential buyer to view our homeThere was no ongoing discussion for weeks regarding Gold Rush Realty representing us*** left a voicemail for both my husband and myself several days after bringing her potential buyer, stating she would be happy to represent usTwice after that she stopped by unannounced and there was discussion regarding our plans for moving, as well as her telling me of her open house and her marketingPrice was discussed, and she was told again, we had already discussed using another agent we met with in FebruaryThis was information she was made aware of upon meeting her on April 13thWe met on the 9th of May with *** *** and ***Our meeting to discuss things was set for 4:30pm, and they arrived lateThe discussion was hours long and that includes the time it took to walk the propertyJosh contacted you between 6-6:30pm Tuesday night, that's hours after you left our home, not a couple daysIt's been over a week and I STILL do not have a copy of what was signed that eveningViolation of EthicsYou have exaggerated pertinent facts that can be proven with my emails to our agent, as well as phone records, text messages and emailsThis does not excuse you from feeling it was okay to use simple lingo while speaking to a distracted couple and not offering us time to fully understand it was a contract

This morning, the Seller (complainant) emailed two separate emails which ask for my advice on pricing, strategy, and positioning on the market. We are apparently re-engaged in the process of selling and will be moving forward.
Seller also has confirmed she has a signed copy of the listing agreement as well, so that is now settled

I am rejecting this response because: I asked you to agree to cancel on May 10th, as well as for the copies of the signed documents, later in the evening (9:32pm). There was nothing left on my doorstep that evening, or the following day. I requested the copies quite a few times, and not once did you mention leaving them at my doorstep. May 11th you asked for my patience after sending an unsigned original copy, and I did not hear from you again until May 19th where you sent your threat to sue us with a Failure to Comply form filled out with blatant lies. I have no yard signs or advertisements that we have requested you remove. There has been no potential buyers or agents you have made us aware of that we have refused. We have not failed to respond to any attempt on your behalf to contact us. 
May 23rd is the first time you emailed the signed copy. Upon reviewing the pages, I'm aware you added a beginning date where we had initialed to okay crossing it off. It was crossed off because we were unable to give a beginning date as we don't know when we will complete our projects. This is the main reason we did not want to sign a contract...we aren't ready to list our home. 
I have emailed you just prior to this response, asking for the SELM  form to temporarily suspend listing in the MLS. we are continuing to work on projects as time permits.

Review: This regards the Broker/Owner ([redacted]).

The purpose of meeting with [redacted] and her agent, was to reiterate what her agent had talked with myself about over a few weeks (randomly stopping by).

-She did not clarify her paperwork as being anything other than a "standard form", when in fact it was a listing agreement (contract). My husband and I were under the impression it was a proposal of terms, as her agent was made aware on multiple occasions we had previously verbally agreed to use another agent. We had been finishing up our home projects as well as our agent's To-Do List when [redacted]'s agent first came knocking at our door.

-There was no explanation of the paperwork in terms we understood, while being distracted with our children being rowdy.

-She left us no copy of the papers with the changes that were made. I have asked multiple times for these papers and she has only sent me a blank copy.

-I have asked for a Cancellation of Listing (a full release of obligation) within 24hours of her leaving my home. She has incurred no advertising or marketing costs as of that time. She has refused to agree to canceling the contract, but has not given any reason as to why.

-She asked for my patience when I asked for the copies of what was signed...she has not sent, or responded to my emails since then. It's been a week since I've heard from her.

-We had planned to move out of the state after the school year so our children could be closer to family, our plans have changed as we are firm that we do not want [redacted] representing us. It seems she would rather hold us hostage to an agreement we feel we were deceived into signing.Desired Settlement: I want a full release of obligation from this agreement immediately.
