Complaint # [redacted] Yes, we are aware of this customer's complaint, and the customer is correct in that we missed the scheduled date of September to pave the neighborhood roadsHowever, this was not intentionalIt was, unfortunately, an error made in scheduling the jobs for that day.Our office received a call from the customer around 9:00am stating that he was still waiting for the crews to arrive, and he was given the phone numbers of the Project Manager and Operation ManagerThey both talked to him and apologized for the errorWe were willing to reschedule the job, but by this time the customer did not want to work with us or reschedule the job.The Job never got started and no money was paid to usSince no money changed hands, we feel no money is owedOf course we understand the customer's frustration, and we were willing to work with him to get the job done, but he chose to cancel the contract

There are two items in Neyra Pavings response that are factually correct:
The *** ** *** did not pay anything to Neyra for the paving work
The *** ** *** cancelled the contract due to Neyra Paving not doing the work as promised on September We can not count on Neyra's promise to do the work on a scheduled future date.
The rest of Neyra's statement is totally fabricatedThis is more than a simple scheduling error. MrKeith Y***, Vice President of Operations, advised me in writing on September (copy enclosed) that the paving work would be started on September On September 11, MrY***
sent an email (copy enclosed) confirming the work would begin on September at 7:AMFurther, *** *** (*** ** resident) and myself had a planning meeting with MrY*** on September at the *** ** street location to review details of the projectThis meeting was one week prior to the work start dateThere was no mention by MrY*** in the meeting of a change in the scheduled start dateI also had a telephone conversation with MrY*** on September 29, the day before the work start dateMrY*** indicated that Neyra would be starting the work first thing the following day. When no Neyra workers showed up on September 30, I called MrY*** and I was informed that Neyra would not be able to do the work until November sometimeAt a minimum, MrY*** is incompetent in that he did not communicate from September to September the scheduled start date of September to the appropriate people in his organization who do the workAt a maximum, MrY*** repeatedly lied to me regarding Neyra's intent to start the work on September I suspect the latter
By way of background, *** **is private street of landominiumsThe Homeowners Association had signed a contract with Neyra to repave the private streetSince the street would be shutdown for two days, none of the homeowners would be able to access their drivewaysParking was available on an alternate street within 1/mileMany of the people in the neighborhood are elderly and were not able to walk that distance to their carsOne of the homeowners has a daughter that is handicapped requiring a special school bus for pickup each daySeveral of the homeowners left town during the proposed work time due to the inconvenienceSeveral households incurred additional costs associated with leaving their homes during the planned workAdditionally, much planning needed to be done such as stopping the US mail, notifying the city of Montgomery and police, stopping landscaping work, etc
Neyra has offered to reschedule the workAt this point, I doubt that they would keep their commitment on another dateThey are not trustworthyWe do not intend to do business with them in the futureSince we did not pay Neyra anything, I can offer an alternative settlement of this issueI would like Neyra’s owner to write a letter of apology to each homeowner in the neighborhoodI would like to review and approve this letter before it is sentI am also requesting that all communications regarding this complaint be posted on the Revdex.com website under the Neyra Paving web page

From Neyra's answer, I gather that they rejected my offer for them to apologise in writing to the *** **residents to settle this complaintNeyra claims that they verbally apologized to meThis is not trueA written apology to each of the residents is the least they should do considering the cost and inconvenience they caused I am again requesting that Neyra agree to my offer

Neyra Paving Management will write individual letters of apology to each resident and is sorry for any inconvenience this caused. Please provide names and addresses so this can be completed
