We have attached Ms [redacted] 's signed agreement, which was a month agreement beginning August We have also attached the cancellation requirements In September 2016, Ms [redacted] 's account became delinquent At that time, numerous attempts were made to contact her by [redacted] from member services (see notes attached) At no point during this time period did we speak directly to Ms [redacted] When an account goes over days delinquent and no attempt to pay the debt or contact is made by the member, these accounts are sent to our collection agency (see agreement terms) On January we received a voicemail from Mr [redacted] expressing her frustrations [redacted] returned her phone call and left her a voicemail requesting a return phone call back to discuss the matter Ms [redacted] called back demanding to speak to a manager (Eric Sparks) who also immediately called her back but whom she cursed at and hung up Ms [redacted] then came into our Carbondale facility where she spoke to myself She was not willing to discuss this matter as we continued to request and she stormed out

Mrs [redacted] came in and completed a cancellation request on 12/16/ As per the terms of her membership agreement, all cancellations require a day notice We attempted to contact Mrs [redacted] on 12/21/and again on 12/29/to confirm this cancellation The cancellation was completed with 12/27/being her final payment (due to the day notice) We have spoken to Mrs [redacted] since this complaint, apologizing for her cancellation experience at the gym As a courtesy to Mrs [redacted] , we have reimbursed the last month dues of $back to her account

I am rejecting this response because: this inaccurate as to what was discussed with me when I signed upThe fact that I was told I was signing up for a student membership that was cheaper and months longAfter months I paid to have my Membership cancelledThe attendants were very rude and out of line when I was trying to discuss the matterThe fact that I actually paid to have the membership discontinued all they said was we called youPhone calls mean nothingCharging someone when they already paid to have it cancelled is the pointAs a PhD student, I do not understand why they feel phone calls make their arguementbcorrectAs stated, I am not a member of their gym so why am I being charged since This business is a scam and I got lawyers involved now.

Per the agreement we require an updated drivers license as proof of relocation.  By law you are legally obligated to update your drivers license within two weeks of relocating.  If you have any further question please contact Member Services at [redacted].

Mrs. [redacted] came in and completed a cancellation request on 12/16/2016.  As per the terms of her membership agreement, all cancellations require a 30 day notice.  We attempted to contact Mrs. [redacted] on 12/21/2016 and again on 12/29/2016 to confirm this cancellation.  The cancellation...

was completed with 12/27/2016 being her final payment (due to the 30 day notice).  We have spoken to Mrs. [redacted] since this complaint,  apologizing for her cancellation experience at the gym.  As a courtesy to Mrs. [redacted], we have reimbursed the last month dues of $107.49 back to her account.

I am rejecting this response because: I'm waiting to see the credit hit my credit card and am meeting with my attorney today to get his take on the legality of Gold's cancellation policy. My attorney's advice will determine what I do next.
