Complaint: ***
In response to Mr***’s rebuttal to my complaint, I agree that we did not sign a legal
contract prior to the building of my new home.
And by law, Mr*** was legally required
to have a contract that conformed to the statutory requirements for a new home
construction signed by both parties. I
can also point out other specific items about his business practices and refute
each of his claims. However, rather than
do so in this forum, I have decided to seek legal counsel. I am rejecting his response since it has not come to a resolution

Mr. [redacted] has contacted me via text message in an effort to resolve
outside of the Revdex.com.  I have indicated
that I am willing to discuss this with him and am hopeful that this can be
resolved.  I am choosing to leave this
matter open at this time until all items are completed.
Kind Regards,
[redacted]

I do remember at the signing of the spec sheets I had also mentioned that we needed to sign the construction contract.
[redacted] had a copy of this contract which I had given to him at a meeting on his property when I handed him copies of preliminary spec sheets. This gave [redacted] plenty of time to review before the signing of the spec sheets
The construction contract I use was recommended by the State of Connecticut.
According to [redacted] he is all about signing contracts. I'm having a hard time understanding why [redacted] would not sign my contract
[redacted]

Review: [redacted] of Golden Hammer Builders was contracted to complete construction of my home in [redacted]. He signed my document, which included all of the specifications of the job on September 11, 2012. He began work even though a Golden Hammer Builder contract was never signed by both parties. He has not completed all of the work that he was contracted to do. [redacted] will not communicate with me about this issue. The following is a list of all the remaining items that need to be done at my house:

• Install aluminum railing for deck

• Install stairs for deck

• Secure any loose boards on deck

• Plug all remaining holes on deck

• Paint/coil deck posts and header

• Add rubber drip edges under deck walkway between deck and garage

• Finish installation of hangers under deck

• Inspect chimney for gaps along ridges

• Clean off shingles around chimney due to staining

• Add coil between stone and siding on closet window wall and on the garage walls to hide stone work/cement/metal…or fix another way

• Finish pointing stonework on garage

• Finish pointing stonework above front entrance

• Resolve/fix leaks and cracks in foundation

• Finish installation of radon fan in the basement

• Fix leaking radon pipe due to incorrect installation

• Finish shelving in laundry room

• Build laundry room pedestal

• Install concrete ramp for lower garage

• Install concrete hot tub pad

• Finish installation of rubber tiles in upper garage

• Install garage drip edge on garage doors

• Adjust garage door from mudroom

• Adjust office door and bathroom door

• Provide all warranties and paperwork

• Provide the one-year new home construction warranty

In addition to all this, [redacted] also received $15,000.00 on April 18, 2014 to cover the remaining materials and labor cost. This check was cashed, but no work was ever completed. On October 19, 2014, I visited [redacted]'s home in order to resolve this matter. He acknowledged the $15,000.00 and its intended purpose. He agreed to get in touch with me at the end of the week to discuss his return to finish work at my house. Again, [redacted] did not reach out and communicate with me about this.

Also, although the town issued a certificate of occupancy, I have never received a certificate of completion from [redacted], since the job has not been completed.

I have an unfinished house, no new home construction warranty has been provided, I have to pay out of pocket for any issues that come up in my new house rather than rely on my builder to rectify them, I do not have any of my warranties or paperwork regarding things in the house, and I am requesting that my $15,000.00 be returned.Desired Settlement: The desired outcome of this is to have [redacted] refund my $15,000.00 and cover any costs I have incurred during my one year new construction warranty.
