This is written in response to a complaint forwarded to me regarding a puppy purchaseThe purchaser alleges that
I sold her a defective puppyI strongly dispute that claim
The puppy, a purebred Shih Tzu, was sold to the buyer in a healthy, conditionThe sale contract required the buyer to have the puppy examined within hoursThis was not doneDays later, the buyer took the pup to a veterinarian and it was found to have a "cherry eye"The buyer now wants to keep the puppy but also get her purchase price refunded, claiming that this condition is hereditary
In Essentials of Veterinary Ophthalmology, ed., by Kirk Gelatt, a Diplomate of the American College of Veterinary Ophthalmologists, a "cherry eye" is defined as a prolapse of the gland of the nictitating membraneGelatt writes: "The pathogenesis of this disorder has not been determined" and states that it is common in the American Cocker Spaniel, Lhasa Apso, Pekingese, Beagle, and English BulldogIn these breeds it is thought to be hereditary
In Breed Predispositions to Disease in Dogs and Cats, ed., by Gough and Thomas, there are ophthalmic conditions" considered to be hereditary for the Shih Tzu or for which the Shih Tzu is considered to be predisposedProlapse of the gland of the nictitating membrane ("cherry eye") is not one of those conditions listed
"Hereditary" means that a condition is passed down from the parent or grandparent of an animalNeither parent, nor all four grandparents, of this puppy had the condition or have it in their backgroundsNone of these animals have ever produced a puppy with cherry eye, other than this one, and this one happened while in the care and control of the buyer
A cherry eye may develop in any breed as a result of trauma, including trauma from rough play with a littermate or other dogThe buyer also has another dogSince the puppy was when sold but the cherry eye occurred after it was allowed to play with the adult dog in its new home, and since the cherry eye condition is NOT considered hereditary in this breed, the most likely explanation for its occurrence is from rough play
When first contacted about this I assumed the buyer wanted to return the puppy to me as she called it "defected"I offered the buyer a 75% refund, because I would be getting a damaged puppy back that I would have to pay to fixNow the complainant wants to keep the puppy but still wants a refund, to correct a medical problem that developed while the puppy was in her careThis is not right

If the buyer now wants to keep the puppy I am willing to refund half of the purchase price so the buyer has funds to use to fix the problemThis is being offered only as a gesture of good will

I am willing to accept the offer from the breeder for $375.00, however, continue to feel cheated as that amount is not half of what the surgery fee will be, plus a doctor visit of $that already occurred with the Veterinary OphthalmologistI've been quoted a price range from $- $for one eyeThe doctor indicated that it is not unusual or uncommon for the same thing to happen to the other eyeSurgery is scheduled out until March 15, because of the puppy's ageIf surgery has to occur in both eyes than the surgery will increase to in between and Her payment of $does not come close to paying halfI've tried to attach a copy of the estimate, however, am unable to do so at this timeI can send a copy to her email address if she would like, however, as noted above, the surgery cannot occur until March 15thAs I said before, I am not happy with the outcomeIf the breeder wants to offer a "gesture of good will" than she should pay half
