I have reviewed the response made by the business in reference to complaint ID *** and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
This is a rebuttal to the response given by Golden West Law Firm and its employee Mr*** ***One hug point was the fact he stated we did not have a previous modification and were in close chance of foreclosurePlus the fact the money he stated was "dropped" off our loanWe did have a modification which we accepted after Golden West did nothing as promisedThe money was put on the back of our loan not droppedIf in fact he did the mod he would have known thisAnother point disputed was my husbands incomeIt did in fax not change I have included two pay stubs to prove itMr *** wanted me to falsify ***'s income to 'help" us get a better rateI explained and stated to Mr*** I was not comfortable doing that I could only send the checks where ***'s income was cut for the week he was laid off Their company DID NOT save my home or work out a modificationHis own company processor said we should take the modification we already hadI have also included these statements from herMr *** offered to refund only payment to us when I called and told him I wanted a refund when they told me "to take the modification we had." I have tried to reach this company multiple times through email and phone calls ans multiple employeesTheir company did not follow through with what I was originally promised by *** ***, who is no longer employed there and Mr *** ***, who is no longer employed thereMr *** and the company he works for did not deliver the modification that was promised and did not deposit checks according to the schedule which was given to meI feel a total refund is due to me

                I am sending you the correspondence notes from our company to [redacted]...

** [redacted]a in regards to the [redacted]s modification. You will see in the beginning notes as well as [redacted] & [redacted]’s written hardship that they were unable to attain a modification from [redacted]a prior to getting involved with us. Upon their initial financial approval for a modification [redacted]’s income was at a 38% DTI ratio which did so qualify them for a lower payment but as the [redacted]’s continued to submit their updated paystubs through the 2013 holidays [redacted] worked double over[redacted]e hours almost doubling his current income which was the income that [redacted]a used to qualify their new modified payment. Had they kept their income the same they would have been looking at an average $300 dollar reduction on their monthly mortgage payment but sadly their income did increase due to the extra over [redacted]e hours and the programs are built to providing a payment based upon a quarterly gross monthly income average and because of that the payment was not lowered as much as we had initially predicted. But that does not undermine the work we had to provide in order to structure their file to financially approve as well as continue communications and negotiations with [redacted] on the [redacted]s behalf which took several hours of work between case manager, processors, underwriting, and attorney negotiations. Please use the additional information attached to this letter to reference by date our communications and negotiations with our processors and case managers between [redacted] and the [redacted]s. Thank you for your [redacted]e and consideration in this matter. We take pride in our work here at Golden West Law Center and have never  not provided services for our customer-clientele. We obviously are not always able to bring the desired outcome of the modification in terms of lowest payment but we are able to keep our clients in their home and forgive major delinquency balances that would have caused eviction and foreclosure to their property had we not been involved in the negotiations. And lastly even as stated in the [redacted]’s hardship letter which is signed by both borrowers: “neither of them had ever been able to successfully work out a modification with [redacted]a prior to our involvement” which is very contradictory to which the [redacted]s are currently complaining about.
PLEASE SEE ATTACHED DOCUMENTS:
You will see that we not only provided full services, but we were successfully able to keep the [redacted]s in their home and stop the foreclosure proceedings as well as get $50.00 taken off their current mortgage payment with principle balance forgiveness of $30,000+. Thank you for your [redacted]e and review in this process, we understand that not all clients will be 100% happy with the ending results but given their circumstances we here at GWLC were a little taken back by the [redacted]s response for a full refund after we clearly saved their home and have provided all necessary documents to prove this claim. Review: We contacted this company from a mailing that was sent from their office for help in lowering our mortgage with our current bank. When we spoke to their representative [redacted] he told me he could lower our payment by 300 to help us. He said he would qualify us first to make sure. I sent him all documents that was asked for and he called back and said we did indeed qualify and could meet the guidelines for our reduction. After weeks of no contact I kept calling and finally got a second person [redacted] who then asked again for my information. [redacted] was gone. Then [redacted] left the company or fired as they say. Then a fourth person [redacted]. During all this contact I already had send three payments to [redacted] from the beginning to be cashed as stated in the contract as the progress on the modification took place. All three payments were cashed and still no modification from them or help. When I asked my Bank if there was contact they told me the law firm sent a paper I had signed for a third party request that was it. No one could tell me at my bank they spoke with anyone from this law firm. When Mr. [redacted] was called multiple times to ask about my modification he told me his supervisor told me to take the modification I already had months before with my bank because our income did not qualify us anymore for a modification. It had not changed since I sent it at the beginning to [redacted]...who told us we qualified on the same income. Now I have called multiple times to [redacted]...the attorney of the firm. and to [redacted] the assistant with no return calls now that I am asking for a refund. I had already had a modification in place before contacting Golden West for 300 higher but was promised the by the Law firm they could have it reduced by contacting my bank and working for me which did not happen.Desired Settlement: The total amount I paid to this company which was three installment payments of 979.21 for a total of 2937.63. I would have never sent any money to them had I not been promised I could reduce my house payments by 300 and an already for sure modification with my bank which is [redacted]. they did not perform the services in our contract and they cashed checks before the work was done. I am the one who spoke with my bank and reverted back to accepting the modification months before.
