Gold’s Gym in Camp Hill is where I have been going for couple of years now. I workout with my friend who happens to be this huge looking guy, I mean he is a bodybuilder. The owner sees us working together, mind you there is plenty of people who are working out together, but he chose to focus on us comes over and tells us we can’t workout together because he can’t personally train me. I’m explaining that he isn’t personally training me and that we are actually working out together which of course he dissmises me like I’m not even there and continues to insist that he is. I get he wants to make money on his personal training but that wasn’t the case. So my friend switches gyms and I was shipped for military training. I come back home and my friends Gym was closed due to weather so he came to Golds to workout, again we worked out together. He paid the $5 fee for two hrs of gym and the owner happens to be there again. So we are done with the workout and he comes over again, harassing us and saying “this arrangement will not work” and I was like we worked out together which is allowed yet he chose to single us out outta all the people there that are working out together. Continues to harras and acts completely rude. Needless to say I will be looking for other places to join. He shouldn’t even own a gym with that type of attitude.

We have no problem refunding the complainant’s money (and have already done so) althoughtechnically we don’t have to when people violate written and stated gym rules. I just wanted tostate the remedy to this has been completed.

There were three instances involving the complainant’s situation. The ?rst was last year whenshe was being trained by the individual she refers to in her note to you as her friend. He wasn’teven working out with her during this time (just instructing her, taking her weights off themachine, etc.) and I was told they do that often from members of my front desk team. Iapproached them and said that was not permitted in our club and that he would no longer bepermitted to come i.nto the club. They clearly didn’t like that ruling but as she stated in hercomplaint we have in-house personal trainers and we protect their livelihood by not allowingoutside trainers to train people in out club.

The second incident which prompted this complaint to you was a couple of weeks ago when Icame in the club and he was in the club with her again. I didn’t accuse him of training her, justthat he wasn’t permitted in the club based on my previous conversation with them. That isviolation number 2.

The third was the complainant’s use of profanity when completing an in-house customer servicereport. Profanity is not permitted in the club. It is in the gym rules document every membersigns and clearly stated on our “Gym Rules” signs which are very prominent in the club.At no time did I bring any type of attitude to either of them. They clearly didn’t like the messagethey received nor do most people who break rules and then are held accountable for that. Theywere talked to in these two cases based on their behavior which was clearly in violation of therules.

Cancelled gym membership nearly one year ago. Received a notice from a collection agency stating my membership was never cancelled. Was forced to pay $155 to avoid having a negative remark on my credit report. I am requesting a refund from Golds Gym of $155 that was paid to the collection agency for gym membership I previously cancelled.

Since moving to a different area, I wanted to cancel my Gold's Gym membership. At the time, I wasn't sure where I'd be living so I kept the membership for a while after I had moved. In July 2017, I called the gym to see if I could cancel without driving back to Camp Hill. The person who had helped me said that he would email me a cancellation form and I would just need to fill it out and email it back to them. I did this and never heard anything back, so I figured that everything was ok with the cancellation. I also printed out the form, signed it, and mailed it into the Camp Hill location, since it would contain my actual signature.
However, the gym was still taking my monthly dues out via automatic payment. I called the gym twice, trying to correct the problem, and each time I was promised a return call which never happened. Finally, I emailed again asking about the payments/cancellation. The finance person, called me, and we tried to figure out what had happened. Apparently, they received my return email but for some reason my cancellation form didn't go through. No one had ever told me about this not going through, and apparently thought that someone who was trying to cancel would just send an email back saying "Thanks" with no form attached. When I received the email from the finance person saying only, "Carson never received the form and we did not receive one in the mail either.", I called to speak with her. She was gone for the day, even though I had clearly stated that I needed the matter resolved by today. The receptionist had her call me from home, and she was very rude to me and was not budging in helping me out in any way to resolve my issue. She stated that it's a privately-owned franchise and that no one else could help me to get my refund.
I feel that this is very poor business practice and that the gym is apparently under-staffed if they cannot follow up on these important matters.

Dear ***:

This is written on behalf of Gold's Gym Camp Hill, in response to complaint number *** that was recently filed against us. In short, the customer's account of the events in question and for which she is complaining is inaccurate, and she is not owed any money. The customer wrongfully alleges that we incorrectly withdrew fees from her bank account to satisfy her monthly membership dues.

The customer initially contacted Gold's Gym Camp Hill on July 6, 2017, requesting to cancel her gym membership. Pursuant to the legally binding contract that she signed on December 31, 2016, a member may only cancel their membership agreement by providing written notice of Member's request at least thirty (30) days prior to the Member's next billing date, if the notice is postmarked less than (30) days prior to Member's next billing date, one more billing will occur, in either case the last month's prepaid dues will extend the membership expiration by an additional thirty days, which will enable Member to use Gold’s Gym during that time. Member may either complete and sign a cancellation questionnaire at Gold's Gym or send written notice to ATTN: Customer Care, Gold’s Gym Camp Hill, ***, ***, Camp Hill, PA, *** . Such notice shall be accompanied by a copy of any membership cards or other documents or evidence of membership previously delivered to Member. Member's account must be current and in good standing before Gold's Gym will process any such request to cancel. Certified mail, return receipt request, is recommended.

In response to the customer's telephone request to cancel her membership on July 6, 2017, our sales representative emailed her a copy of our standard cancellation form, having additionally offered to allow her to return the document via e-mail, which would both expedite the process and avoid unnecessary traveling for the customer now living out of the area. The customer finally responded to the email on July 20, 2017, with a simple, "Thank you!" The signed cancellation form she had requested was neither mentioned within the text of the email nor was it attached to allow us to process the cancellation. Gold’s Gym Camp Hill does maintain a copy of that email exchange, which is available upon request. Gold's Gym Camp Hill has not received any additional email or written correspondence from the customer since the brief email response on July 20, 2017.

The customer is seeking to recoup $49.98, representing her membership dues from both July 31, 2017, and August 31, 2017. However, even if she had returned the cancellation form immediately, the customer still would have been billed for the month of July pursuant to her membership agreement, as discussed above.

Instead, the customer did not return the cancellation form at all, and we were therefore unable to process the membership cancellation without her contractually required written consent.

At Gold's Gym Camp Hill, maintaining a positive relationship with both our active members and our alumni members is of the upmost importance. Part of how we work to achieve that is to treat our members fairly and equally. By signing a legally binding membership contract, our customers are assured that there will be no surprises to their over the membership terms as to both their rights and their obligations as members. We could not make an exception to allow this customer to cancel her membership over the telephone and avoid signing and returning the cancellation form because to do so would be to violate the trust of our other members who expect and deserve equal treatment pursuant to the terms of their membership agreements. While we certainly wish to resolve this issue with the customer in question, she is not entitled to reimbursement of the previous two months' membership dues because she never fulfilled her obligations pursuant to her membership agreement in order to formally cancel her membership.
