challenging client I have ever done business withOnceconstruction started the plans *** provided us were found to have structural, measurementand design errors*** also chose to participate in purchasing and being directly involved.***'s decisions in how he obtained his building plans and his driving directions on the buildhave contributed to why we are in this situation***'s wife stated that he is "A Driver ofProjects"Although he may find this works in his own industry it is not realistic for him to do soon a construction project as he did not allow me to manage this project.Although we have met directly with *** and his wife to review their project we are at animpasseGonder Custom Construction has opted to initiate the Mediation / Arbitrationclause of our contractGonder Custom Construction whole heartily wants to proceed.*** has delayed moving forward with Mediation / ArbitrationThese legal proceedingshould have been completed and the remedy already in placeBut, after months of* first accepting and giving us names of the Chelan Mediators / Arbitrators that heand his legal counsel approved, he has yet to move forward with available dates.All we want is for *** to release funds to the subcontractors for the work they havecompleted on his project and have a third party who is unbiased review the details fromboth partiesWe feel the outcome will be favorable to Gonder Custom Construction.Below are responses to his email that was sent to B.B.BI have insertedresponses in his original email to you

Revdex.com,I have reviewed the response made by the business in reference to complaint ID *** and have determined that this does not resolve my complaintFor your reference, details of the offer I reviewed appear below.A glaring missing element of Leo's response was the very clear understanding between us, both within the contract and supporting documents and correspondence, that there was a not-to-exceed amount within the contract His response goes on about detail (which this email response cannot go into detail about) but he did not address the clear key elements of the contract, namely being the not-to-exceed amount and the written, approved change order authorization before work began on any changes.The truth is that Mr G*** has three customers that I personally know of, whose business dealings were like ours...Leo spending without accountability and leaving the project well over the budget amount agreed to There is clear mismanagement of this project and with the size of our project, that mismanagement turned out to have a huge financial impact.Additionally, we have the copies of letters that my attorney sent to both Gonders and the mediator we both agreed to asking for a date for mediation, and still do not have a date response from Gonders So we await that date so that hopefully we can schedule that soon, because we want to get on with this painful process to get our house completed We still are daily living in chaos with an incomplete house that will create even more chaos for us.Part of our concern is the very fact that Leo does not comprehend the severity and financial implications of his mismanagement, even as he dismissed the third party bids we received to completing the project His mismanagement has created a huge impact for our family, and rather than addressing the real concern and making it right, he has tried to keep the issue under wraps We chose to seek counsel from others within the industry to be sure that we were not off base in our expectations as homeowners It was these other builders, Leo's peers, who immediately counseled us to seek legal aid because of the gross mismanagement and inferior quality work they observed We had tried to work out these details with Leo without needing to seek legal insight, but he got upset and explosive (long before our friend fell down the stairs) and he has stood firm, alone, in his position We would have welcomed him sending his own builders to review the home build quality and to review the issues at hand, but he chooses to be very private and keep things shrouded Why? We welcome the exposure of the facts Why does he want to keep it all hush hush? We wished he would have brought others of his colleagues into the conversation, because maybe then he would be able to actually glean some perspective outside of his own But as it stands now, his stubborn isolation has made it very difficult for all of us, and we have been forced to drive this project along because he has abdicated his responsibly for the effective quality and fiscal management of this very large project (And even that element of driver that Leo called out in me, he misread and interpreted what my wife had said She was indicating that I drive and manage programs and projects into millions af dollars, and thus, I understand what it means to keep a project on task and I know how to keep projects moving.)So clearly, no, we are not able to accept the response and the excuses he lays out We have vetted our concerns with many others and they have confirmed that Leo violated our contract It is interesting to hear him think that he will prevail in mediation and arbitration When a large cadre of people within the industry and legal profession look at both the contract agreement and clear fiscal understanding, along with the poor quality work he left in his wake, and add to that, those statements his own subcontractors and former customers have made about the mismanagement, and clear randomization they saw from Gonder's decision to start a new tavern while taking on this large project, we are quite confident that the facts will show negligence and failure to fulfill the contract Three separate law firms have reviewed the contract and info, and all three have said we must proceed to hold Gonder Custom Construction fiscally accountable for the mismanagement and damages incurred So no, we cannot say that Gonder Construction has solved the issue We reject his response that fails to address the contract issues.PS It is interesting to note that it took a very long time for Gonder's to respond to this complaint In fact, Revdex.com closed the issue weeks ago as unresolved due to no response from the business Interesting It displays the laissez faire response time to issues...and that lack of timeliness can affect a project incredibly...and that very lack of "being on his game" (as his subs said to me about how they observed Leo on our project) is a huge contributing factor to how our project went off the railsRather than 6-months to complete the job that Leo said it would take, we are now well into months, and there are still months of work to be completed after we come to a resolution
