I appreciate the role taken on by the Revdex.com to help correct the public from unscrupulous businesses and to act as a mediator in resolving complaints or conflictsThis is the second attempt to address the concerns of Ms [redacted] .One of Ms [redacted] ’s complaints is that she has not received her recordsShe was informed that they were available for her pick up directly on July 1, or please tell us where she would like them sentIn our industry, these records are usually sent to the dental office the patient has chosen to see for future careWe never heard from Ms [redacted] When her insurance carrier called to request her records, we assumed that was where she wanted them sent, and it was doneNow that we know from you most recent correspondence that her request is they are to be sent to her home address, they were mailed out on September and 10, 2015.Her remaining complaints center on a perceived injustice in regard to a court custody situation with her ex-husband, [redacted] As originally stated, we do not get involved with our clients personal mattersMs [redacted] has requested termination of one of our employees who is now her husband’s significant other, Ms [redacted] Our employee did not breach Ms [redacted] ’s personal informationWe have no personal information that would not already be in her ex-husband’s possessionWe did not release any information regarding the [redacted] ’s mutual child until [redacted] provided court documents demonstrating that he had the legal right to themI enclose a redacted copy of the court documents he presented which provide: [redacted] ’s legal right to all medical, dental records and, Listing by name of [redacted] being specifically allowed to transport [redacted] and ***’s child, [redacted] .While the court documents are most likely public records, I am redacting them to demonstrate our continued sensitivity to Ms [redacted] ’s privacy, and to also shoe you the legal standing upon which we based our actions.As a business owner for over years I feel we have done everything responsibly in regards to these issuesI would appreciate your review of this information and in doing so, closing this case

We are a dental office providing the best in dental careWe have no desire to be embroiled in the personal affairs of our patients/clients.An internal investigation of this matter and any involvement of our employee determined that the patient/customer in question did not have her privacy/confidentiality breachedThe document released was information regarding her patient/child and was released to the father at his request when he produced proof of legal standing to such documentation.The complainant was notified that her records were available to be picked up on July or she could request they be mailed to herWe never heard back from HER regarding transfer of her health records.A request was received from a representative of her employer's insurance group who stated the patient had contacted her to request the records be sent to that location on 07/06/15.Upon receipt of the letter from Revdex.com, a call was made to her insurance group representative who confirmed they had indeed received the records and had been in contact with the complainant.Thank you

I am rejecting this response because: Although [redacted] had access to our daughter's records the letter in question was part of my record as it clearly states Patient [redacted] with my date of birth up topNowhere on the document does it state our daughter's full name or date of birth.The document clearly notes that it is my phone call regarding personal information being compromisedThe phone call was also about their employee using the dental facility as a tool to intentionally upset me which was selectively not documented in their letterThe document is from my file because the bottom of the page states Note for [redacted] along with the system curvedental.com where the note was storedAccording to curvedental's document filing system the note belongs to my fileIn fact when I called the dental office upset after learning that my document was released their office manager [redacted] apologized to me and admitted that she broke my confidentiality, and the law by giving [redacted] the documentShe said she was just trying to make everyone happy and didn't realize at the time that it was violating HIPPAWhen I told her that making everyone happy is not her job protecting my confidentiality is she agreed and asked how she could make it better and said she would have the owner call meThe owner never called nor did he respond to my multiple emails.I never authorized Hazel dental to release all my records to [redacted] In fact again they violated my privacy by releasing all of my dental information when I only gave written authorization only for a specific tooth, #Also I did not receive the above mentioned letter in their production of my recordsI specifically asked for any and all records including all electronic stored documents, records, reports, memorandum, notes, emails, call logs, etc.that reference my nameHazel Dental has selectively excluded records and I still have not received all of my requested records

I requested a copy of my entire file to include any and all documents including but not limited to films, reports, office visit notes, electronic stored information, memorandum, correspondence, email messages, intake, applications, letters, notes etc in June 2015. It has been over two months and I...

have still not received these documents. I believe my records have been been compromised by another employee and want either all original and any copies of  my records or have them placed in a locked cabinet or storage to ensure they are protected from unauthorized access. Hazel Dental Care had an employee, [redacted], who is my ex husband's current girlfriend. I have been in a high conflict divorce and custody battle with my ex and currently in court. The office knew of this and did not disclose [redacted] worked there nor did they take any precautions to protect my private and highly sensitive information such as health and social security number, date of birth, mother's maiden name etc. which left me exposed for fraud. When I learned of [redacted] working at Hazel Dental Care I called and complained. They assured me that my privacy and confidentiality is their top priority and that it would be kept private. But shortly after, [redacted] removed a document from my file which had sensitive information including other personal identifiable information regarding me and gave it to my daughter's therapist as a means to unfavorably portray me. It was also used again for court purposes in a court mandated mediation appointment which the mediator took under submission and included in her report for custody recommendation.
