premises was after consistently showing up late with materials while sub contractors waited on that particular day I questioned [redacted] Gonzalez what had happened to the 20,he had been providedThis conversation happened in front of [redacted] when [redacted] responded he informed us that he had used our money for other projects and given that we didnt understand the Construction industry this is how this was doneAt that point it was blatant that he had stolen our moneyEarlier that day the sub [redacted] who did the sheet rock and tiling had informed me that he was still owed 5,and if [redacted] was not going to pay him he would have to leave the jobAt this time given my time restraints I informed him I would pay him if he would finalize the jobPlease find the statement from [redacted] verifying you stated you had used our money on other jobsDuring the permitting process you informed me that you had called and lied to the licensing office and told them you were building a tmobile office across the street and that is when they told you, you didn't need permitsAgainst my better judgement I proceeded doing business with you as I was hoping that this was done out of ignorance and not maliceAs for the tiles, I was in North Carolina and you stated you HAD no Money to purchase the tiles I would not jeopardize my project due to funds, since there was a balance still on the project I paid for the tilesI have provided text messages to this email were I asked if you would be present to handle additional subs you stated yesHaving telephone and internet installed is part of a construction projectThey needed to work with you to define were to put the lines, you and your team were not present for them days in a rowI have in addition provided copies of text messages to my manager asking her to stop by days in a row when you stated you or your team would be there and no one was thereAs far as the keys [redacted] asked you to make copies and you kept saying you would get a lock box after the 3rd time of asking you about the lock box and it not happening I took it upon myself to make copies when you asked me about the lock box I then said to disregard it since you had never met you agreement and I had already made keysAs far as the tile and your pictures that is me in the pictures working on cleaning since you were not meeting your required jobAs far as products being purchased that were not needed not once did I ask for you to reimburse me for them since I returned themThis is a flat out lie not once have I asked for you tor reimburse me for any of the items I purchasedIn regards to your subs they informed me you were not paying them not only on this job but other jobs as well so since I was on the job they wanted to know if I would be paying you since they had not been paidYour subs reached out to me due to the fact that you had not paid themAgain your electrician and Plumber decided to walk off the job if I did not agree to pay them directlyAs far as me coming to you directly you will find in my attachments the text messages were I tried consistently to try and get you to even respondAs far as my accusations of [redacted] please find their statement attached.The reason I hired [redacted] is because they are a reputable plumberYour fix to the situation was to find a plumber that we would pay to use thier license without them even looking at the workyour statement was "let me look on craigslist thats were I can find shady as people"Again I took it upon myself to remedy the situation in a legal and professional mannerPlease show me when you mentioned cameras or alarm systems to me because this is the first time I have ever heard of this statementAs far as the damages I meant you not knowing how to read the installation plans and not building adequate Holds for the equipment to hang correctlySo you had to cut my furniture and there is a big white spot on the wall were you nail glue didnt work and you TORE it off because of the makeshift hanging you were trying to do of our furnitureI never informed anyone I was pressing charges until the job was completedSo them walking out of the job was their efforts to ensure they got paid for the job they had already completedAs far as the detailed issues with sinks, countersunk trim etcThe job was sub par and there was no effort in completing it correctly the fact that your crew did not work with metal stud walls has nothing to do with the job not getting done that is WHAT your job should have beenDuring our conversation in [redacted] presence you recommended to pain the grate on the ceiling tile since it would give it a nice liftAgain something you promised and did not complete.During the last week of construction you and I sat down at [redacted] and discussed to phases of the job (which I have attached) Painting and floors completed on date etcNone of these deadlines were metduring this VERBAL agreement you stated you could still meet the deadline but you didn'tAs far as the pictures of the progressThat is me in those pictures cleaning which proves I was there everyday after you failed to meet you deadline I cleaned I hammered I painted I didn anything I could do to help limp the project forward instead of you saying [redacted] we have this under control we can get it done You would ask me to move cardboard boxes or clean or reorganizeI am guilty of not holding you accountable to your time frame But I did what was best for my salon and ensuring that the people that worked on it were rightfully compensatedAs you will find in the text messages I constantly reaching out to you asking you to hurry people are sitting aroundTelling me items flew off your truck and you had to buy them againetcI still feel you owe me the balance that was not used on my project Attached you will find email from city official, letter from [redacted] , Text messages between you and I as well as a written schedule that you and I wrote up at [redacted] while eating lunch one day as I was trying to keep the project on timeYOu committed to this schedule and failed to complete it Regards, [redacted]

The contract terms upon which we agreed state that work is to be completed within business days AFTER the commencement of site workWe began site work on 11/7/Applications for the necessary permits were submitted on 11/14/and permits were issued on 12/5/17, leading us to lose days of workOn December 14, you stated that you no longer wanted me on the project and that you were seeking reimbursement, or in the alternative, legal action, despite the job being approximately 80% completeBecause of this action, it was impossible for me to complete the job in my capacity as the general contractor, fearing that you would call the police on me as you stated, or take some other measure to keep me off the job site Because of the delay with the permits, it was also impossible for us to continue work without breaking city ordinance and until we received those permits from the cityI understand you are upset that the job was not where you were expecting it to be during your site visit on 12/1/2017, but we both looked into whether we would need to obtain permits and we were both told that they were unnecessaryUnfortunately, this confusion caused us to slow down and explains why there was no notable progress during your site visitIn regard to your concerns about having to purchase tile, we came to an oral agreement that you would purchase the tiles and deduct that from the total remaining contract balanceIf you had any issues with this arrangement at that time, I would have surely addressed them and worked with you to come up with another solution In regard to your concerns about missing the phone installation and deliveries, it was my understanding that you would take care of your personal business needs, and as the General Contractor I would supply labor and materials onlyWhen you put me on notice that the phone company was expected, that left me only hours to make sure someone would be at the job site to receive themI tried to do my best to get my crew out there to receive the deliveries and open the door but it just was not possible on such short notice and because of the rainy weather that dayI also suggested many times that we purchase a lock box to avoid either of us having to travel to Castroville to open the door but you stated on several occasions that you would make copies insteadI personally went to let the phone company in a few days after for what was supposed to be a site visit according to our conversationDuring this instance however, I had to wait for him to do his installation and at one point assist him in the installation although this was not in the terms of our contractI am sorry if you felt that my efforts were insufficient In regard to your concerns about the tile not being completed during your visit on 12/9/2017, please see the attached photo dated 12/7/showing tile laid in the main entrance area along with deliveries accepted by us on 12/5/2017, and a screenshot of our conversation on 12/2/where you state you liked the installed tile and that you were hoping permits would be available soon showing that all work that could be done during this time period was being doneWe had all tile set excluding the restroom area and areas where the walls were to be built, because they had to remain open until the plumbing was completedAdditionally, we had all walls painted up until the plumbers’ portion of the work and the hole for the plumbers was excavated and left ready for them to work When you decided to take over and started purchasing materials, items that were unneeded were bought and then I was expected to reimburse you for these unnecessary items In regard to your concern about how much the plumber and the electrician were being paid, that matter concerns my contract with the electrician and the plumber, not the contract you and I agreed toAs a general contractor, I find subcontractors to complete various portions of the work, and upon receiving their bids, I factor in their pricing along with other work completed by my guys to give you, the client, the ultimate turnkey pricingI am not required to disclose how much I am paying the subcontractors, nor am I required to disclose to them the ultimate contract priceThis is industry practice and I was disappointed to hear that, during one of my absences, you disclosed to them the ultimate contract price and persisted to have them disclose to you how much they were being paid as the subcontractorIn regard to your concern about the electrician and plumber only having completed “bits and pieces”, my crew was going to handle the finish out portions not completed by the specialty contractorsYou did not afford me the trust that is typically delegated from client to general contractor that this job would get done on time and spent $1,unnecessarily for additional crew membersI wish you would have came to me directly as far as any issues with the amount of personnel and quality of service, instead of talking to my entire crew while I was on supply runs, and telling them that you planned on pressing charges against me and asking them to break off from Gonzalez Contractors and start separate contracts with you According to your statements on 12/9/17, you were going pay the electrician and plumber separately, because you guys came to a personal, separate agreement while I was on supply runsAt this point I did not argue with you, nor did I try to interfere with said agreementsAt this point, ***, my original plumber, became YOUR plumber, and was no longer under my direction or supervisionThe plumbing issue on 12/10/stemmed from the type of pipe which apparently had been discontinued about years agoWe had no way of knowing this until the pipe was actually cut for a coupling-fitting by ***’s crew memberUnfortunately, not everything that occurs over the course of such a contract goes according to plan, and you took this mishap to mean that things were not going to get done on time and demanded we get all the plumbing completed by that very same night without giving us time to consider our options In regard to your concerns about [redacted] ’s license, please don’t accuse me of doing anything illegalThese are serious accusations that have no basis and I will not discuss it with you In regard to your concerns about having to hire [redacted] I am sorry that you felt the need to make this out-of-pocket payment, but again, it would have been best if we spoke about our options instead of hiring the first contractor you found despite how much the company chargedIn regard to your concerns about having to purchase additional materials during the “entire time,” I have receipts for all the supplies purchased by me and can provide them at your requestIn regard to your concern about damaged stations, I did not damage any stationsOn the contrary, I take great measures to care for my clients’ property and took care of your items in the same wayMy daily concern was leaving that site at night knowing you had no alarms or cameras, and I mentioned this concern to you from the startIn regard to your concerns on 12/14/about one of my subcontractors not getting paid, I was present when you inquired about his paymentYou asked him, “Has [redacted] paid you?” He responded, “Yes.” “How much,” you asked, and he responded, “$7000.00.” I remember this clearly because I heard him say it once in Spanish and then again in English when you translated for JohnI told you before you asked the subcontractor that what was still owed to him was $5,Furthermore, the subcontractor never threatened to leaveHe said, “You two,” referring to you and I, “resolve your problemsI want no part of itI don’t care if he (myself) pays me or if you (***) pay me.” The only reason money became a contested issue was because you told everyone you wanted to press charges against me, causing them to wonder what was going to happen with them and the remainder of their payAgain, these concerns would have been best brought up with me first, so that we could resolve any issues without getting the entire crew involved and detracting from their progress on the job.In regard to your concerns about the bracing in the sink, it is unfortunate that you will have to redo them, but if I can remedy this issue in any way I willMaking this patch is not complicated, nor expensiveSame for the issues with the grout; re-grouting on missing points is an easy and quick resolution which I am willing to do.Regarding your concern about the vinyl flooring, that was installed to the manufacturer’s instructionsThis style of flooring you chose is floating floors which are not typically glued downThey interlock and remain braced around the tile and wallThey may just need a tapping with the rubber hammerAdditionally, all stations where installed in their correct locationI showed you prior to their installation and you agreed to their proposed locationI didn’t have the opportunity to fasten them all because you asked me not to return to the job siteIn regard to your concern about the cabinets, the only cabinets with doors that I was present for installation were the ones installed over the sink bowlsAnd the individual who installed the cabinet was hired by you; I did not feel that it was my place to direct or supervise him because he did not worked under you.In regard to your concern about the countersunk trim on doors, the trim had to be screwed into the metal then back filled with puttyI stated to you in advance that my crew did not work with metal-stud wallsThe attachment method is different than what they’re used to working withI was the only one who had previously done this type of framing, however you let me go before I could complete this portionIn regard to your concern about the ceiling tile, it was brought to your attention that replacing the tile would have been completely unnecessaryYou had brand new ceilings in placeThey just needed a cleaningI explained this to youBroken tiles would have been replaced, but again it was impossible for me to complete as you told me not to return.Sealing floors is a five minute process and definitely could not be done when we had everything else going onFloors were yet to be cleaned and it would have ruined floors had they been sealed prior to thisThis process should have taken place the night of 12/15/ You asked me not to return two days prior to your anticipated opening, meaning that you had me finish the bulk of the work before you let me goI stayed late nights organizing, installing shelves, installing cabinetry, assisting every trade, performing supply runs, and metal framing all the walls thereI am also attaching a few pictures showing the progress made on the job from 11/07/17-12/14/in my capacity as the general contractor It is true, things didn’t go as originally plannedUnfortunately this is a common aspect of this type of workI am sorry that we could not work together as a team and work together to reach solutions to the issues that did ariseBut that doesn’t mean they cannot be resolvedIt doesn’t mean that you have an entire project to re-doI am still willing to go in and fix the issues mentioned to the best of my ability if that is what you would like, but I cannot imagine a situation where, having done all of this work, and completed approximately 80% of the project, it would be fair that I pay you back 65% of what has been paid on the projectI hope you understand, and that we can cordially come to an agreementAs always I am available via my cell at or email

With all due respect, how I run my business and manage my finances concerns meYou contracted with me for a *** ***s, and you received a *** ***sYes, you agreed to pay ***, but you had no idea of my agreement with himYou didn’t bother to even ask me about thatUnder me, he was to handle much more than what you paid himI’m sorry to say he took advantage of youNot II was released two days prior to your successful openingI was there every day obtaining permits, supervising the crew, assisting plumbers run water lines, assisting electricians locate outlet positions, erecting walls, making supply runs, receiving your shipment of supplies, and the likeI at no point disappeared so as to have you believe that I took your money and ran off with it You asked me to callYou very clearly told me that you were told that you did not require permitsYou asked me to call and see if I obtained the same response you did as far as not needing permits to proceedWhich I did and at that point you gave me keys to proceed I agreeI had a balance and that was the reason I mentioned the game plan to proceedAgain if this was not a valid solution I would have found another way I never agreed to handle thatYou coordinated everything in regards to telephone, internet, data, etcI agreed to keep the doors open, because apparently I was the only one with a keyWhere your phone, router, etcwas to be placed was not discussed by usYou know what will work best in your salon and where things should be located, I do not I’m sorry if this was a real inconvenience to the projectI remember that Ms*** had a key as well and copies could have been obtained much sooner from your endI’m sorry if this never occurred to us sooner I never claimed that you were not presentI attached these photographs merely to show my progress Perhaps, I did not explain my previous response wellI am saying that you purchased many supplies that were unnecessary, and despite the fact that you returned them, you are still having issue with having had purchased themThis is evidenced by your inclusion of those issues in this complaint, so I must address them You spoke with them secretly while I was on supply runsYou have no business in what I do asides *** ***sYou offered to pay themI noticed their faces when you explained to me you were in chargeThey couldn’t look at meThey knew they jumped the chain of commandThey were not ready to walk off the jobTheir first day on the job was literally 12/9/and that is also the same day you guys came to a separate agreementOne which I had no part of The only reason you had to seek another plumber is because your attempt to convince Mr***g to continue on the permit failedI know this because you had him come out the next day after our emergency serviceWhere I saw him again checking all the connections and attachment methodsYou let everyone know your planHe said no and took offThis is the reason why I suggested finding plumbers on craigslistObviously only licensed plumbers can pull permits and filtering licensed plumbers was not complicated at allSo I’m assuming you found someone to sign off on the work? In regard to your concern about the electrician and plumber only having completed “bits and pieces”, my crew was going to handle the finish out portions not completed by the specialty contractors. You did not afford me the trust that is typically delegated from client to general contractor that this job would get done on time and spent $1,500.00 unnecessarily for additional crew members. I wish you would have came to me directly as far as any issues with the amount of personnel and quality of service, instead of talking to my entire crew while I was on supply runs, and telling them that you planned on pressing charges against me and asking them to break off from Gonzalez Contractors and start separate contracts with you.   According to your statements on 12/9/17, you were going pay the electrician and plumber separately, because you guys came to a personal, separate agreement while I was on supply runs. At this point I did not argue with you, nor did I try to interfere with said agreements. At this point, [redacted], my original plumber, became YOUR plumber, and was no longer under my direction or supervision. The plumbing issue on 12/10/2017 stemmed from the type of pipe which apparently had been discontinued about 10 years ago. We had no way of knowing this until the pipe was actually cut for a coupling-fitting by [redacted]’s crew member. Unfortunately, not everything that occurs over the course of such a contract goes according to plan, and you took this mishap to mean that things were not going to get done on time and demanded we get all the plumbing completed by that very same night without giving us time to consider our options.   In regard to your concerns about [redacted]’s license, please don’t accuse me of doing anything illegal. These are serious accusations that have no basis and I will not discuss it with you.   In regard to your concerns about having to hire [redacted] I am sorry that you felt the need to make this out-of-pocket payment, but again, it would have been best if we spoke about our options instead of hiring the first contractor you found despite how much the company charged. In regard to your concerns about having to purchase additional materials during the “entire time,” I have receipts for all the supplies purchased by me and can provide them at your request. In regard to your concern about damaged stations, I did not damage any stations. On the contrary, I take great measures to care for my clients’ property and took care of your items in the same way. My daily concern was leaving that site at night knowing you had no alarms or cameras, and I mentioned this concern to you from the start. In regard to your concerns on 12/14/2017 about one of my subcontractors not getting paid, I was present when you inquired about his payment. You asked him, “Has [redacted] paid you?” He responded, “Yes.” “How much,” you asked, and he responded, “$7000.00.” I remember this clearly because I heard him say it once in Spanish and then again in English when you translated for John. I told you before you asked the subcontractor that what was still owed to him was $5,000. Furthermore, the subcontractor never threatened to leave. He said, “You two,” referring to you and I, “resolve your problems. I want no part of it. I don’t care if he (myself) pays me or if you ([redacted]) pay me.” The only reason money became a contested issue was because you told everyone you wanted to press charges against me, causing them to wonder what was going to happen with them and the remainder of their pay. Again, these concerns would have been best brought up with me first, so that we could resolve any issues without getting the entire crew involved and detracting from their progress on the job.In regard to your concerns about the bracing in the sink, it is unfortunate that you will have to redo them, but if I can remedy this issue in any way I will. Making this patch is not complicated, nor expensive. Same for the issues with the grout; re-grouting on missing points is an easy and quick resolution which I am willing to do.Regarding your concern about the vinyl flooring, that was installed to the manufacturer’s instructions. This style of flooring you chose is floating floors which are not typically glued down. They interlock and remain braced around the tile and wall. They may just need a tapping with the rubber hammer. Additionally, all stations where installed in their correct location. I showed you prior to their installation and you agreed to their proposed location. I didn’t have the opportunity to fasten them all because you asked me not to return to the job site. In regard to your concern about the cabinets, the only cabinets with doors that I was present for installation were the ones installed over the sink bowls. And the individual who installed the cabinet was hired by you; I did not feel that it was my place to direct or supervise him because he did not worked under you.In regard to your concern about the countersunk trim on doors, the trim had to be screwed into the metal then back filled with putty. I stated to you in advance that my crew did not work with metal-stud walls. The attachment method is different than what they’re used to working with. I was the only one who had previously done this type of framing, however you let me go before I could complete this portion. In regard to your concern about the ceiling tile, it was brought to your attention that replacing the tile would have been completely unnecessary. You had brand new ceilings in place. They just needed a cleaning. I explained this to you. Broken tiles would have been replaced, but again it was impossible for me to complete as you told me not to return.Sealing floors is a five minute process and definitely could not be done when we had everything else going on. Floors were yet to be cleaned and it would have ruined floors had they been sealed prior to this. This process should have taken place the night of 12/15/17.   You asked me not to return two days prior to your anticipated opening, meaning that you had me finish the bulk of the work before you let me go. I stayed late nights organizing, installing shelves, installing cabinetry, assisting every trade, performing supply runs, and metal framing all the walls there. I am also attaching a few pictures showing the progress made on the job from 11/07/17-12/14/17 in my capacity as the general contractor.   It is true, things didn’t go as originally planned. Unfortunately this is a common aspect of this type of work. I am sorry that we could not work together as a team and work together to reach solutions to the issues that did arise. But that doesn’t mean they cannot be resolved. It doesn’t mean that you have an entire project to re-do. I am still willing to go in and fix the issues mentioned to the best of my ability if that is what you would like, but I cannot imagine a situation where, having done all of this work, and completed approximately 80% of the project, it would be fair that I pay you back 65% of what has been paid on the project. I hope you understand, and that we can cordially come to an agreement. As always I am available via my cell at or email.
