February 16, Dear [redacted] ,I had the chance to review the information on [redacted] She did come into Jackson Hewitt for a NO FEE cash advance which is being provided by [redacted] , Many times the banks and companies send out a cards or letters stating you MAYBE qualified for a cash advanceThis is not in any way a guarantee from them that you will get the advance.The reason the banks are offering this advance is because refunds are going to be delayed by the IRSReturns that contain Earned Income Credit child credit or educational credits are being held until 2/17/ [redacted] for Jackson Hewitt is not running a credit check for our customersThey do however run a report to see if there is a chance that a return would be offset by child support, tax bills federal, state and local, welfare, food stamps and unemployment debt and student loan default.The bank also looks at your general circumstances, like total income and your ability to pay them backThe decision to get the advance is controlled by the bank and they do not share the reason they didn't with Jackson Hewitt as governed by law.Our fees are broken down in sections, the first one is our professional fee which is based on time it takes to complete the return and how complex returnA person with or Wand does not itemize without any dependents can file a EZ, so this federal return would be around 50.00, that fee does not include state and local retunes this fee would be about 150.00.We do not choose who can file a 1040EZ the IRS sets the rules of who can file this form not Jackson HewittPeople having anything other than that are required to file a returnAs you add dependents and itemize the fees go up from there.The second part of our fees are bank fee meaning if you would like your fees to be withdrawn from your return the bank charges you to do thatThis is processing feesIf you would like to pay your fees at time of service you can, then the banking fee does not applyThis is no fee to apply for the cash advanceThe only time a fee is generated from the bank for the cash advance is if you don’t complete your return with usIn that case the bank sends you a letter asking you to [redacted] ’s return was complex she stated that she totally supports a niece that live with her and she is singleHer return fee was as follows:Federal State/local Doc storage15.QQ Bank fee 49.95Total [redacted] pro gift -25.00Total 555.95She requested the bank to take her fees from her returnWhen we come to the end of the return the screen is turned towards the customer and the fee are explained fullyThe customer is allowed to ask question or make comments about the feeThere is no pressure to have us complete the return if they are not happy with the fee they can stop the returnTheir Wand paper work is return to them, I did review the paper work that has to sign off on, each page of information and also the page with the fee, they all contain her signature and well as our tax preparers., I am sorry she did not get the advance on paper she should have, her return was above the required amount of her actual amount was 2700.00.The only issue I could see is that she states she supports her niece and she is single with a gross income of the bank may have felt that it was not possible to support people on that incomeI will not know the reason but the bank does send a letter to her with the reasonI am sorry she did not like our fees however she did sign off on them and she only became unhappy when she was not approved by the bank which I have no control overThis was explained to her I cannot give my manager calls when they don’t like the answer however this was discussed with her as well.Please call with questions Sincerely, Peter ** K [redacted] General Manager

August 11, 2016Dear [redacted] ***,In response to your letters dated 6/and 6/First this is office season for our business which means I am in the office day per weekAs per the complaint from [redacted] , she was demanded us to pay for a penalty from the IRS in the amount of 1,Our policy is that if we made the error we pay the penaltyThis error was made by us and the first thing I did was correct this form her.I am willing to pay her claim, however the company must get the paper work that is sent to her with the dollar amount on itI can't just take her word that it was 1,I asked her to provide me with the information So I could process her claimShe took that as thought she was lying.Once I received the paper work I wrote to the IRS a letter of appeal which they declined by the IRSSo we will be refunding to her the amount of 1,So I will be closing this caseHad the paper work been provided Sooner we would have been able to get her the money back soonerAs for her claim that she Submitted the paper work times I have found no record of it being submitted other then the most recent requestI took over this area in April and I can say that the first time heard from her was May 2016.Sincerely,Peter KGeneral Manager

policy is that if we made the error we pay the penalty. This error was made by us and the first thing I did was correct this form her.I am willing to pay her claim, however the company must get the paper work that is sent to her with the dollar amount on it. I can't just take her word that it was 1,124.00. I asked her to provide me with the information So I could process her claim. She took that as thought she was lying.Once I received the paper work I wrote to the IRS a letter of appeal which they declined by the IRS. So we will be refunding to her the amount of 1,124.00.
