I am rejecting this response because: I would not be filing this complaint had Mr*** provided and ethical and value provided service as he advertised What he provided was simply a bait-and-switch making claims that simply were clearly false He did reimburse me for one day of service he did not provide but at a minimum should have provided reimbursement for the day he provided guide services as these neither achieved the result he stated nor did he attempt to rectify - this is above and beyond his insults to myself and my year old daughter He is one of the absolute worst business men I have encountered and even wile his partner was attempting to apologize for his rude behavior another customer called and complained about their treatment by Mr*** He cost me two airline tickets to Colorado, rental car and hotel fees as well as a terrible three days with my daughter I will never accept any explanation from him unless it's accompanied by a full reimbursement and a written apology to my daughter I have stated this from the beginning of this process an need this complaint to stand to warn others of what they can and will expect from Mr*** I am also filing a complaint with the Federal Forestry Services under the Rehab Act section title III of his discriminating treatment of my disabled daughter whose disabilities did not affect her ability to hunt

To Whom It May Concern, A gentleman named *** booked a hunt with us for the 2nd rifle season for the first days, for people, for the amount of $per person per dayI had gone back and forth with *** about this hunt for a
yearHe booked this hunt with us based on several references I providedAnd the assumption, that a guide service would help him better their chances of filling their tags, since no one knew anything about the hunting area or hunting elkI must state for the record we were not contractually obligated to bring ***’s daughter inI let her come out of the kindness of my heartShe came along as an observerOur contract was for hunters for daysI am happy to provide the signed agreement upon request
*** * was one of the hunters who would be attending the days of day huntsI spoke very briefly by conference call, with *** and ***, about a week before the hunt*** had stated that he would like to bring his daughter as an “observer” ( something we do not like to do as it is another person for the elk to see, hear, smell) I stated “we could try it “and see how it goesThere was no mention of any handicap with the girlAlso *** had said he did not like to sit at all and would like to stalk hunt only, I said again “I would see what we could do”We have not had good success stalk hunting for elk with guests on rifle seasons,( better success stalking on archery and muzzleloader hunts) and I have found over the years we have had better success, during rifle, if we just sit a while here and there, on their migratory paths, and wait for them to come to usElk are not like deer, they will not stand by a trail and just wait to be shot, Elk are much more intelligent than thatI’m sure elk hunters will agree, elk are very crafty and their sense of smell, hearing, and sight, are incredibly sensitiveMost times stalk hunting we will see elk, but cannot get them because they will position themselves on strategic points and see you before you see them
Day We met early, about an hour before sunrise , we have found there are certain times of the day elk will move the most, usually the best hunting is early am and late pmSo it is imperative we try to get to these certain spots where we have shot them before, at the right times, for the best success We drove up to the ranch and got ready to go***’s daughter seemed a bit reluctant to go into the woods, I asked what was wrong? She said she was scared of bears, and being attacked by themApparently the guys were telling stories, about bear attacks, the night before, is what she saidI told her there are no bears in the area that would want to cause her harm, and her dad had guns which would protect usShe went with itWe proceeded into the woods, it was dark, we like to move without headlamps as to not scare the game, I noticed right away something was not right, she was tripping and almost falling right away which made me nervous, I did not know what was up, so I stopped and we looked at the stars for a while, till it got bright enough to seeWhen we could see better, we moved on to a spot I had seen elk two days before and hoped they would be backWe got to the spot a tad bit lateI moved *** and his daughter about every hours hoping he could take sitting for a bit, apparently not, as I will explain laterWe moved from spot to spot, the weather was fantastic, it was a good thing because she had on sneakers and cotton pants, usually the weather is much worse this time of the year, snow, I did think to myself if it gets bad, I hope they have the right gearAs we moved throughout the day from spot to spot, via trail, I noticed the little girl was having trouble with things like crossing mud puddles, going over logs, etc *** was like a prince, helping his daughter all the way*** is obviously a very caring and loving dadHe was so focused on his daughter, he could hardly concentrate on anything else, let alone hunting for elkWhile trying to help her over a mud puddle he dropped his rifle in the waterI was nervous about this, that a man who should know about guns and gun safety would let this happenI thought to myself if we go off trail (which is usually what we do) things could be very tough with gun safety As evening approached us we sat in what I thought was a really good spot but saw no elk at that timeWe loaded into the truck and didn’t even go yards and there were the elk A nice six by six and some cowsI said to *** “ well I know where we are going in the morning and laughed” He said he did not want to go back to any of the spots we had been that day, and that all he saw were birds and squirrelsI told him that’s usually all you see, until you see the elkHe said in a very loud stern voice “I told you I did not want to sit at all, and I will not sit tomorrow” I told him we are not a babysitting service, that we were elk hunting guides, and that if he left his daughter at home the next day, we would try to hunt that way he wanted the next day, I just didn’t think she could handle too much moreI saw no tears from his daughterI did not call her a baby I said we were not a babysitting service
Day *** went with my guide ***, *** said they hiked miles and he was exhaustedWe usually do not hike this farThey did not see any sign of elk, not sure what was going on here, but it was hard on my guide, who did not want to guide the next day with himThat evening I heard from my guide *** would like to come back a 3rd day and bring his daughter againI sent *** the trip leader some texts shortly thereafter, because his phone number was the only one I had, and he was the group leaderI said we would not take *** the next day if his daughter was to come I felt the liability risk was just too greatI got a text from *** stating *** would not be attending day and would just like a refund for that dayI sent one back saying OK
The reasons we refused to take *** and his daughter on day is because,
*** did not want to hunt the way we wanted/needed, he did not want to sit at all, I felt if we just hiked around all day it would tire his daughter out too much, and she was having trouble navigating the easiest of trails alreadyAlso with his daughter there helping her all the way, he could not concentrate on gun safety
I decided to not take them on day and give him a refund for day in the amount of $He did use days of our guide serviceHe did not have to come for a second day if day was so bad, or then want a 3rdI did not want to be the one to push this little girl over the limits
I probably did not have to go through doing this big a letter hereHere is the clause F in the signed contract by the group leader, the contract was drafted by The Colorado Division of Wildlife and the State of Colorado and it is the one we useIf requested I have a copy of the signed agreementI will also add that the other members in the group are not requesting a refund
FEach Client understands that notwithstanding any other provisions of this contract the
Outfitter may, at his sole discretion, return any fees paid and decline to accept Client
for any reason

To Whom it may concern, We have refunded the gentleman [redacted] H who booked the trip, for the cost of 1 person for 1 day. [redacted] L hunted with us for 2 days and missed the last day. Therefore we feel that is an appropriate refund. There are never any guarantees with hunting. Especially if the client wants to take the hunt over and do it their way.
Elk success rates vary from group to group and season to season this year. CDOW stated it was not a very good 2nd rifle season due to different and many factors. Out of the 4 customers that went with us 1  customer got a bull.  So we were at 25% for 2nd rifle. 3rd rifle season was much better for guests we did get some snow which helped the hunting conditions for the day hunts

I am rejecting this response because:Mr. [redacted]'s reply is both disengenious and blatantly fase/misleading.  Prior to this hunt we had several conversations regarding my expectations.  These include a reasonable guarantee of success as well as bringing my daughter on the hunt.  Mr. [redacted] agreed making statements such his success rate was at 70% minimum, that we'd be stalking Elk and as well as complete agreement to allow my daughter to attend even though I clearly stated that she had some minor limitations that would not impact our ability to hunt.  As as a matter of record, after three days of my partners following Mr. [redacted]'s "experienced /expert" guidance, neither of the two other members of my party saw let alone had the opportunity to fill there tags.  As the customer, we were clearly mislead both in his ability to take us to an area where animal populations were present nor did his "expert" guidance lead to a successful hunt - his promise of 70% or better resulted in 0% success.  His is business skills and customer facing skills are abysmal.  He uses deceit to gain agreement then provides a minimal level of expertise let alone any semblance of customer satisfaction skills.  He has no business owning a business that requires and reasonable level of customer facing / problem resolution.  His statements in his response are clearly a falsehood - had he take five minutes with me face to face after he developed his take or leave it attitude we could have resolved but he clearly has anger issues and has no place as a customer facing businessma.
