Complaint: [redacted] I am rejecting this response because Mr[redacted] was not at the residence for the installation and has no idea what his salesman/partner said Mr [redacted] assured us on February 24, that he would be back the next day with the installers to finish the installation and to make sure we were completely satisfied He took the check and leftHe was to bring us a copy of the Paid contract at the same time He did not show up and we haven't heard from him since The installers showed up to complete the job We assumed they would straighten the sinks, fill in the gaps between the wall and granite, repair the gaps between the granite and bottom cabinets, remove the jagged glue in the sinks, etc Instead they filled two chips, removed some glue, and said they didn't have the glue they needed and would be backWhen asked about the problems, they said we would have to speak to Mr [redacted] about them Being unable to reach Mr***, I called Mr***, the owner He insisted on sending the installers back and I insisted HE come and look at the job We talked several times and finally he hung up on me When he received my certified letter dated April 2, about the Texas Deceptive Trade Practices Act, he finally came overWhile here, I showed him the copies of the certified letters I sent as required on his contract He said he didn’t get them; my evidence shows he did not pick them up From then on, he just kept reiterating that we signed the papers so the issue is overI showed him the problems and when I showed him the mirror damage, he accused me of breaking it after the installation I insisted that he should fix what was fixable and settle with me for $for my expenses and having to live with his installation errors His response was that he knew what this was all about now, and all I wanted was "free money" He recorded this conversation, without my knowledge, and that is fortunate because his accusations can now be verifiedHe also stated the same in a text later which I have He left and later texted that he would offer $for the kitchen repair I refused the offer and countered with $so we could bring the issue to a close He refused I contacted my Attorney (since I wrote the checks) who advised me to do what I could to settle this as court costs and his fees will be very expensive I asked Mr [redacted] for the name of his attorney, insurance company and for copies of the signed documents I am still waitingI am trying to give Mr [redacted] every possible chance to settle this matterI have an appointment with the Remediation Board on May 28, at 6:00PM, if Mr [redacted] will agree to that time I will bring all my evidence and hope that Mr [redacted] will do the same and bring executed forms, not blank ones Regards, [redacted]

I have already told the client that I would refund her portion that is leftMaterial has been ordered due to her wanting the counter tops in such a quick fashionShe told me that she has disputed the entire card amount so this has put a delay on the processOur contract clearly states that
(prior to any fabrication may result in a restocking fee of 30% of entire contract.) On a side note, We spent extra money to have material shipped same day to over exceed our customers expectations on our lead times. Now, we are being made out to be a thiefOur business does 6-installs a week and we have honestly never had to deal with the situation

He also stated the same in a text later which I have.  He left and later texted that he would offer $350 for the kitchen repair.  I refused the offer and countered with $1500 so we could bring the issue to a close.  He refused.  I contacted my Attorney (since I wrote the checks) who advised me to do what I could to settle this as court costs and his fees will be very expensive.
I asked Mr. [redacted] for the name of his attorney, insurance company and for copies of the signed documents.  I am still waiting. I am trying to give Mr. [redacted] every possible chance to settle this matter. I have an appointment with the Remediation Board on May 28, 2014 at 6:00PM, if Mr. [redacted] will agree to that time.  I will bring all my evidence and hope that Mr. [redacted] will do the same and bring executed forms, not blank ones.

This is [redacted] of Got Granite. The client that is sending false accusations has signed my contract, wrote me a 50% check. We completed. Then wrote me a final payment. Not only paying in full, but also signed a completion form stating she was satisfied with our work. The woman that is...

complaining isn't even our client. Our client is her daughter..  
 
We have been out there 3 different times. One of those were me personally. [redacted] which again isn't even our client states that she sent the certified letter within 7 days which is false. Even at that we have been there numerous times.
 
Please let me reiterate
 
She signed a contract
She paid 50% down
She paid when job was complete the remaining balance
Then she signed a completion page saying the was satisfied.
 
Even after over a month went by I still addressed all the "issues"
 
Please ask the client about all these bullet points.
 
I will send you a copy of what my contract looks like and also the sign off sheet. I have both the sign off sheet and the contract and will have them to show the judge if she pursues this to court.
 
I have tried to do everything in my power and at this point she will not get anything for free from Got Granite and will end up actually out of pocket on court cost and an attorney and my time!
