I am in receipt of Ms [redacted] complaint regarding the incident on the home she is currently building with Westport Homes.As a result of the foundation being effected and needing repaired, Westport Homes is in agreement with Ms [redacted] to terminate the purchase agreement and refund Ms [redacted] her earnest money deposit of $3000.Though the foundation is structurally fine, as evidenced by a letter from a third party structural engineer and will be cosmetically addressed, I too feel it is everyone's best interest to cancel the agreement.We will be sending Ms [redacted] a refund of her deposit within the next two weeks.If you have any further questions or need additional information, please contact meRespectfully, Jack M [redacted] Division PresidentWestport Homes, Inc

I am rejecting this response because: this is actually the first time anyone has told me of any stolen cabinets and this goes to show the lack of communication throughout this entire processAlso why do I have to pay for the stolen base?Did the superintendent also tell you that he told us on two occasions that the hood would have its exhaust at the top and then went ahead and did something different? Nobody ever told us throughout this process until the very last day before closing that we would be stuck paying for the oven, stove cutouts and also pay to have a base put in! I am rejecting this response because: The appliances have been installed because we paid to have a new base put in along with cutting the cabinets to fitJosh initially told my wife that Westport would pay for that only for the contractor to show up and inform us that josh told him to take his payment from us! I reviewed the response made by the business in reference to complaint ID [redacted] , and find the resolution is satisfactory to meI understand we need to respond to Westport's resolution but we are hesitant until we actually receive the reimbursementUnfortunately, there is a great lack of trustI emailed MrM [redacted] with an attachment of all the receipts referenced to in the complaint/resolutionI asked for a his response confirming he received the email with the attachment, and as of yet I have not received a responseI understand he could be off or not checking email? Because I have not received confirmation that he received the email I sent a hard copy in the mail todayWe also received a credit from the lender today but it was not the $2,listed in the resolutionWe received a credit for $2,If MrM [redacted] (Westport Homes), refunds us according to the receipts he has received and we receive the amount listed from the lender we can move forwardIf anything positive can come out of this experience we hope that honesty and facts are what is used to sell homesLet families make the best decisions according to their needs with factual information Regards, [redacted] ***

Ms [redacted] entered into a purchase agreement with Westport Homes on 11/1/(see attached).According to paragraph of this agreement, Ms [redacted] had days to obtain a favorable loan commitmentIf she made a good faith effort to obtain a mortgage loan and was not able to obtain such loan within the days of the agreement she needed to notify us in writing on or before the expiration of the day periodUpon receipt of the written notification the agreement would have been terminated and all deposits would have been refunded to Ms [redacted] .In Ms [redacted] 's situation, she not only failed to notify us that she couldn't obtain a mortgage, she continued on with the sales process including giving Westport Homes additional deposit monies and making changes to the home through late March 2016.We began construction on Ms [redacted] 's home on February 18, and completed the home in mid June Only when we attempted to schedule the closing were we informed that Ms [redacted] open additional items on her credit report and she no longer qualified for the mortgage on the home.Ms [redacted] was now in default of the agreementPer the default provision of the agreement,paragraph 14, "Default by the buyer shall be deemed to have occurred upon (a) Buyer's failure (i) to make all payments on or before the specified date herein; (ii) to complete the signed selection sheet within the specified time; (iii) ON THE DATE SELECTED, TO TENDER AT CLOSING THE AMOUNTS CALLED FOR HEREIN AND ACCEPT TITLE; (iv) to comply with all other terms of the agreement;..."Upon default Westport Homes may elect to receive $from the buyer as liquidated damages or pursue the buyer for actual damages (I've highlighted this provision in the attached agreement).In this instance, I've agreed to retain the earnest money as liquidated damages and terminate the agreementWestport Homes fulfilled every obligation under the agreement including finishing Ms [redacted] 's home to her specifications, but unfortunately was unable to close on the home because of her financial decisionsWestport Homes will not refund the deposit nor will we reimburse MsReibelle for any out of pocket expense she paid directly to our vendors or sub contractors.If you would like to discuss this matter further, I can be reached at ###-###-####.Respectfully,Jack M [redacted] Westport Homes, Inc

I am rejecting this response because: westport guaranteed the fountain would be installed by the end of summer Entrance lighting is currently not working, and the community was informed the walking path would be replaced, not considered to be replacedI will accept their response when westport holds true to their commitment of installing the fountain, which year after year have told us it would be installed over the past five years and the mulch path is replacedI also don't agree that the swimming pool and club house were used as selling points (one of the reasons we decided to build here) and now they are stating they don't even own the landCan businesses do this?

Attached is the e-mail correspondence that took place prior to homeowner closing on his houseThere were some concerns noted by his home inspector and Westport response in capital letters to those concernsItem #which I have highlighted in yellow refers to the deckWestport agreed to power wash
and seal the deck which was doneI have highlighted that item in yellowI have also attached his orientation form and there was no mention of staining the deck and it is signed off by homeowner that all items were completedI have also attached his day service request and again there was no mention of staining the deck at that point either. No action will be taken on this matter

I am in receipt of the correspondence from Mr*** dated 10-23-15.Again, the occasional visibility of a drywall seam caused by natural lighting is not a warranty item in a home. The Central Ohio Building Industry Association manual clearly states "NO DRYWALL INSTALLATION CAN COMPLETELY CONCEAL ALL JOINTSREGARDLESS OF WORKMANSHIP, JOINTING CAN BE DETECTED UPON CAREFUL INSPECTION OR IF THE LIGHTING IS ANGULARSLIGHT IMPERFECTIONS SUCH AS NAIL POPS, SEAM LINES AND CRACKS ARE COMMON IN DRYWALL AND NOT WARRANTED".The seam in Mr***'s home is being caused by sunlight at a certain time of day and year being cast over the ceilingAny further repairs on touch up would exacerbate the matter.Finally, no further action will or should be taken.Respectfully,Jack M*** ***Westport Homes, Inc

*** *** submitted my application in June I use Westport in how lender they reported directly to Westport not to me they had meetings every Thursday referring to what was going on with each Builder they told me that everything should be approved and they said the reason why the loan was not approved was because underwriter they also said that loan was not approved because late payment on the car Westport knew every step of what was going on they were the one dealing with *** *** concerning every loan they did not say that the loan was not approved in JanuaryI did not sign an application for the loan until the end of June the application was not submitted to the underwriters until JulyI continue the process with the housing putting more money into the house because they never said the loan was not approvedI only found out any of this information after having to contact *** *** to find out what was going on they continue to tell me that everything was going fine all the way up till the disapproval I am saved everything that I was told to do by *** *** and Westport

The fountain will be installed this spring as committed last yearThe electric for the fountain was just installed this past fallWestport Homes has just approved a contract to replace all of the entry feature lightingThe installation of the new lighting should begin within the next days.With regard to the replacement of the walking path, taking it from mulch to crushed stone, this matter is under review and we are obtaining bids.Jack

When the *** Flak Jacket issue was first brought to our attention in late July of this year, *** was offering two forms of remediation for the homes constructed with the Flak Jacket product.The first form was a "Top Coat Solution" This option was the quickest way to remediate the affected basements while preserving the existing fire protectionOnce begun the process could take up to days to completeThe latex paint used to apply the top coat is water based and contains no heavy metalsIt includes compounds that react with the formaldehyde to permanently change it from a gas to an inert non-formaldehyde solid*** is providing a transferable lifetime warranty on this solution in addition to the original warranty on the TJI JoistsPost remediation air sample analysis conducted by independent third-party laboratories demonstrated results below the World Health Organizations guideline of parts per million.To date, *** has used the Top Coat Solution on over homes with the affected I-Joists throughout the United States.The second form of remediation offer in July was a "Replacement Solution"This option involved removing most or all of the affected joists and replacing them with new joistsThis option was available for homes in the early stages of construction, however for some completed homes the replacement option was not feasible because of the structural damage that would result from the joist removal.In mid August, *** introduced a third remediation solutionIt was called "Coating Removal Solution"This option required more specialized equipment and labor than the top coat solutionOnce begun this option could take up to weeks to days to complete in unfinished basementsThe process involved removal of the Flak Jacket protection coating using mechanical methods, such as dry-ice, scraping and micro-planingOnce the coating is removed the joists may need to be painted with the top coat solution to address residual formaldehyde emissionsThe warranty for this option is the same as the top coat solutionBecause this option removes the original fire protection, the basement ceiling may need additional measures, such as drywall, to meet the fire code requirementThis solution was not available the first time I had a discussion with Ms***.It is my understanding that representatives from *** have contacted Ms*** about the Coating Removal Solution and she is contemplating this solution at this time.Again, this is a most unfortunate "recall" of a product, but I believe *** is addressing this matter with the nearly homes affected throughout the country as aggressively and expediently as possible. I apologize to Mrand Mrs*** for all of the confusion associated with the installation of their appliancesBecause I was not party to any of the discussions regarding venting the range hood and the cutting of the cabinets for them to install their appliances, purchased outside of the agreement, I cannot comment on what was communicated. However, I understand that both their Realtor and Westport Homes participated in making the correction to the venting system of their range hood and this matter is resolved.With respect to select cabinets being stolen prior to the ***'s closing, I only mention this because the base cabinet of the wall oven cabinet was missing at the walk through and has since been replaced.At this time, it is my understanding all of the noted issues have been resolved and the ***'s have their appliances installed as well the range hood is vented to their satisfaction.Again, I'm sorry for the inconvenience Mrand Mrs*** have experienced thus farWe look forward to having them as a customer for years to come.If they would like to discuss any further matters, I can be reached at ###-###-####.Respectfully,Jack LM*** ***Westport Homes, Inc

I am in receipt of the complaint filed by Mrand Mrs*** and *** ***.As a clarification, Mr*** is not party to the contract agreement with Westport Homes, as he was removed from the agreement via a contract addendum dated July 7, See the attached contract addendum.On July
7, 2015, Ms*** entered into a purchase agreement to purchase Wetsport Homes model home in *** *** in *** ***, Ohio.The home the ***'s purchased had been Westport Homes model home for the past 1/yearsThe home began construction in and was completed in January of This home acted as our model home until the ***'s purchased the home in July.Because the ***'s were purchasing an existing home from Westport,, they chose to make the contract contingent upon a satisfactory home inspection to be performed by a vendor of their choosing.Attached is the contingency addendum dated 7/7/15, stating such.On July 12, *** *** *** completed the attached Home Inspection report on behalf of the ***'sThe findings of the report was forwarded to my attention.I reviewed the report and gave it to our construction staff to address all items prior to the ***'s closing on August 14, 2015.As you will see, the home inspection report was very thorough in investigating both the structure and cosmetics of the home.All of the noted items from the report were addressed to the ***'s satisfaction, prior to their closing.Also, the ***'s completed a customer orientation on the home prior to closingFive items were noted and completed prior to their closingSee the attached Customer Orientation Form, dated 8-14-15.About late August, Mr*** contacted our construction team stating he could see a few seams in the drywall of the loft ceiling and asked that we re-texture the ceiling in the loft, second floor hallways and two story foyer.We informed Mr***, that this matter could be typical on a nearly year old home, with the proper angle of lightingPer the Central Ohio Building Industry Association Homeowners manual, it states" No drywall installation can completely conceal all jointsRegardless of workmanship, jointing can be detected upon careful inspection, or if the lighting is angularThe acceptable building standards are that slight imperfections such as nail pops, seam lines, cracks or the failure of a corner to be exactly square caused by the beading out of the corner are common in drywall and are not warranted...."This situation in the ***'s home is being caused by the sunlight coming across the ceiling at a particular time of day and time of year.As a result, no further action will be taken with this matterFactually, any attempt to correct the situation could exacerbate the issue.If you have any questions or would like to discuss the matter, please contact me at ###-###-####.Jack M*** ***Westport Homes, Inc

Mrand Mrs*** purchased their home on 5/24/and subsequently closed on the home at the completion of construction on 12/29/17.At the signing of the agreement the ***'s purchased a gourmet style kitchen that included the cabinetry, but chose not to purchase the appliances from
Westport Homes, that were offeredThey chose instead to purchase their own appliances outside of our agreement and have them installed by their own supplier.Because Westport Homes was not affiliated with their appliance transaction, we had no idea as to the dimensions, size or style of appliance's they were purchasingAt the construction conference the ***'s were informed by our construction superintendent that Westport Homes would not be responsible for cutting the openings in either the countertop for their cooktop or for the double wall oven, they were purchasing outside of our agreement since we did not have the sizeThis was again discussed at their final walk through just prior to closing, when the ***'s questioned whether Westport Homes was going to cut the openings for their appliancesThis was verified by their Realtor *** ***With regard to the oven cabinet, our superintendent informed the ***'s the base for the wall oven cabinet along with several other cabinets were stolen before closing, thus there was not a base in the cabinet for the oven/microwave to be installed properlyThe cabinet has since been delivered and should accommodate the ***'s double oven.To address the opening for the cooktop, we gave the ***'s the contact info for one of our vendor's that specializes in cutting openings in countertops for cooktops so they could provide him the information and size to cut the openingThe ***'s were to pay them directly.Again, if one of our buyer's choose not to purchase the appliances offered by Westport Homes and purchase them outside of our agreement, we disclose that we will not incur the liability of cutting the openings for their specific appliances, nor can we be responsible for installation.The ***'s were made aware of this policy on at least two occasions. Our superintendent did do a visual inspection of the exterior of this home on Wednesday the 27th but we want to look at the interior of the home to best evaluate the situation. Our Production Manager called homeowner today (4-28-16) and left message to call him back to schedule a time to meet and...

I have reviewed the attached correspondence and photo's provided by Mr. [redacted].As Mr. [redacted] stated, he purchased an inventory home that was completed for several months prior to his closing. The home, including the deck, was built in the prior year to his closing. The discoloration noted on the deck is a function of the natural aging of the cedar wood used to construct the deck. There is nothing structurally wrong with the deck. What we are seeing is simply the natural aging process and drying out of the wood.Westport Homes never committed to staining Mr. [redacted]'s deck, nor was it ever made part of his contract to purchase the home. However, we did commit to power washing and resealing the deck, which was noted and completed prior to the closing.Again, the reason we did not commit to staining the deck is because it was not included in his offer price for the home. It was only after the contract was written that Mr. [redacted] inquired about the staining. Since there was not contractual obligation to stain the deck it was not done.Wood decks do require annual maintenance by the homeowner, of which may include stain and or sealant. This is a homeowner responsibility and not one of the builder.Again, no further action will be taken with this matter.If you have any further questions I can be reached at ###-###-####.

Since they have been nice about everything else on my home repair list I am going to let this one slide. (Please note my dis-satisfaction with the front porch and its discoloration work in progress) I did ask Karen H[redacted] Westport sales rep about this prior to closing and she said it shouldn't be a problem. I am still confused as to why Westport did not use an all in one stain and seal which would had been the same amount of work for them and would have avoided this entire discussion.

I reviewed the response made by the business in reference to complaint ID [redacted], and find the resolution is satisfactory to me as long as the entry lighting is repaired or returned to good working order within 45 days. I would like to reference back to Jack's previous response where he stated the lights were in working order, if this were the case why are they suddenly replacing all the entry lighting? If the fountain is not installed by the end of May, I will be contacting you again regarding these matters. I would like to believe Westport Homes has good intentions to resolve these issues but the past speaks for itself.
