This is a reply in regards to *** *** *** complaint id #***.Please be advised of the following:This project was a simple removal and replacement of existing asphalt drivewayin other words no base reconstruction or placement was performed only a new inch asphalt wearing course was
installed*** *** is claiming that the asphalt is rising, this would only be possible if water was percolating from beneath the surface or a broken water pipethere is and was no evidence of water whatsoever prior to placement of the new asphalt and if so this would not be our responsibility and would be beyond our control*** *** is insisting that the asphalt is rising, we see no evidence of this either, upon our returned visitsour conversations regarding this issue has yielded no results in any amicable wayi explained to him that asphalt does not rise on its ownWe did go back to do some minor work which only took about minutes just to appease him, we never performed any patch work on driveway which he claims we did The driveway is in excellent condition and I stand by itWe have returned several times to look for this mystery rising asphalt and still nothing has been foundhe is also claiming that the area that has risen is still growing, that is unheard of in the industryIn over years of business I have never and will never make a threat involving customer relationships, I take my reputation very seriouslyPlease keep in mind that *** *** did not per-pay for this job, he paid after completion upon visual approval of the work performed.Hope this will sufficeThank you,*** ***

It is obvious to me and to anyone in the industry that *** *** has no knowledge of the work involvedHes using terminology not applicable to the issue at handCompaction was already in place, the ground was as hard as a rockAfter removing the existing asphalt wearing course, the existing stone base was never disturbedNo compaction is required of any significance to an undisturbed areaRolling of the base is merely done to smooth out any pebbles left behind by removal procedure, all this does still not address the rising issue which *** *** is complaining aboutThe locations he has identified gouge marks are blemishes which is a occurrence in asphalt pavingI invite *** *** to get another opinion from an engineer who's involved in asphalt pavingAs you can see by his demeaning tone and sarcasm that he is not one to be pleased with any continuing efforts. Therefore, my position stands the sameWe have tired to resolve this issue which I don't think we can, I stand by my workThis is the first complaint I have ever received. Thank you,Angelo G***

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:

[redacted] believes that he can do no wrong and attempts to intimidate and bully when he is shown to be incorrect.  I have lived in my home for 36 years and have no water problems. This is my third driveway and the only one with a serious installation problem. When I showed [redacted] the installation problems he responded by saying "[redacted]".  I noticed that [redacted] was not wearing his glasses (if he is willing to wear them at all.I have attached the following pictures. Even though, they are not as close up as one would see in person, one does not require glasses to see the severity of the problems. The first picture shows the 5 foot diameter rise in the driveway.  There is another rise elsewhere.  There is a flat board and a level at the top of the mound.The second picture is a close-up. Please note that the bubble on the level is in the middle of the level which means that the level is on a straight surface. On the right side of the picture is a tape measurer showing a 2" gap between the ground level and the top of the mound. The next group of pictures show [redacted] equipment tire marks that are embedded into the asphalt. This should never happen!!!!. The next picture shows some sort of tar left on the asphalt with a work boot imprint embedded into the driveway. The next picture shows one of the many gauge makes 12" - 18" long and 1/4" - 3"8 high. These pictures are not  close-up and are just a few of the problems that are occurring.
