>I went to try a 'free' month training at Gracie B[redacted] University Brazilian Jiu Jitsu club.
Mr [redacted] and I had a lengthy consultation at the time he...

signed his contract.  As I stated to Mr. [redacted], In order to receive 30 days of free training, he would be required to sign up for a one year contract.  Mr [redacted],  informed me that he may only be staying in Hawaii for "one semester" at University of Hawaii and thus signed the 6 month contract instead.  Thus, he was notified early on that he was not eligible for the extra 30 days Free.
>On the first night they pushed me to sign a membership agreement (and did not supply me with a copy of it).
I can't remember whether a copy of the contract was given to him or not.  However a scanned copy of the contract was always available upon request, as it is standard practice for our school to scan and send copies of the contract to our third party billing.

>They took my payment details off my card which they had asked me to bring for 'identification purposes'.
Driver's licenses are required for identification.  Credit and Debit cards are only taken upon sign-up,  we do recommend bringing a credit/debit card to their first class to make signing up easier.  But at no point before signing the contract do we take possession of the student's credit or debit card.
>They made me pay $156 for the 'free' trial and said I could get this money back if I was not happy with anything.
At no point, in our literature nor in our conversation is a "30 day trial" discussed.  And we have never made anyone pay for a trial.  However, We have an evaluation period upon the signing of the contract that states that the student has a "30 day money back guarantee".  If terms are met and the student is not completely satisfied, then they would contact billing and request a refund of payments made.  The terms are simple,  a student is required to attend (8) Eight classes within the first (30) days of their sign-up.  The first 30 days is a chance for the student to fairly evaluate our program by attending at least the minimum number of classes in one month.  Mr [redacted] instead attended four (4) classes during his first month and in fact attended another four (4) shortly after his initial 30 days evaluation period had elapsed.
After a month I decided I could not afford the $156 dollars a month to continue.
>I was then told that since I was now 5 days over the 30 day 'free' trial period that I would have to pay a $195 registration fee in order to discontinue the training. This fee they had initially waived when I signed up for the 'free' trial.
As an incentive to signing up for our school,  our school waives the registration fee of $195 at their initiation.  However it is written in the contract that if the students asks for early termination after the 30 day evaluation period,  that student is then required to pay back the registration fee of $195 as a cancellation fee.
 >I emailed the trainer Gavin then followed up in person to explain my concerns and I have now twice emailed their billing department but as yet I have no replies. Also they have deducted another month worth of fees ($156) from my account after my email to Gavin saying I wished to discontinue training.
Mr. [redacted] signed the contract on 8/27/2015, starting the evaluation period which would have ended on 9/26/2015.  I received an email on Oct. 2nd stating that he wished to discontinue training.  Mr [redacted]'s automated recurring bill date was set for 10/4/2015, as it was set to automatically deduct from his account every 4th of the month.  We then met on May 5,  I offered him the opportunity to train at our academy in exchange for "cleaning services" (sweeping and mopping the training area once or twice a week) as is an option many of our students take advantage of.  He declined that opportunity and instead wanted to cancel and emailed billing to cancel.
However, on Oct. 4th the payment of $149 + tax = 156.02 was deducted from Mr. [redacted]'s account.  Since Mr [redacted] notified Gracie B[redacted] nearly 1 week after his evaluation period ended, he was deemed to have been in his contact past the initial 30 day period.  As I stated earlier, Mr [redacted] would then have to pay a cancellation fee of $195.  I personally requested that the cancellation fee of $195 be waived.  It was approved today. And no other charges will be made on his account.  He is officially cancelled from billing.  And his last day he is eligible to train at our academy, whether he takes advantage of it or not is 11/4/2015.
Please contact me if there are further questions on this matter. A copy of the contract is available upon your request. Thank you for understanding.
