January 16, – Began email correspondence with Client/Claimant January 20, 22, 23, 24, 25, 26, 27- Email Correspondence with Client/Claimant February 2, 3, 4, 6– Email CorrespondenceOn Feb 6th, Client/Claimant asked if I would be available to work 2/or 2/I responded that I would keep her job as a priorityFebruary - Email correspondence: Client/Claimant gave her idea of what she would like the schedule to be: 17-20° House empty, any work can be done 21st - furniture moved into house by noon (master bedroom, dining, living, some office furniture upstairs but not much) 21-– both homes available 3/– Port Hueneme tenants move in February 12, - Email Correspondence February 17th and 18th – No work (hours per day = hours lost time) February — Received keys to home, met with Client/Claimant to go over paint colors, Client/Claimant gave me a handwritten map of where paint colors were to be appliedFebruary - Tear out closet, start patching, setting up paint area in garage, working on closet, rolling in fill, layout for split wall, painted 1st coat on dining room wall so Client/Claimant could move dining set into placeSpent time cutting in and painting master tone colorClient/Claimant came by and commented that she was pleased with the progressFebruary -Started painting in the morning, Client/Claimant was pleased with the workWhen the movers came, we took our lunch breakMovers came in and were taking furniture up and down the stairs, Client/Claimant was having a BBQ and her friends were walking around the house (within our work areas) commenting on the work and messing with the crewHer friend was on his knees inspecting one corner of the baseboard in the master bedroom, following me around, asking what kind of roller knap I was using, whether or not it was synthetic, etc and making comments that his painter was supposed to do the painting, but he was out of town when the project started, but now he was back in townThis was hindering productivity and decreasing morale, so we had to leaveFebruary – Started painting two upstairs bedrooms, coats, masking off, did some touch up in Master Bedroom and Common Area Hallway, worked our way down the stairwellClient/Claimant stopped by and commented on how good the work was and how quickly it was goingShe emailed photos of what she would like the backyard fence fence to look like, indicating that she was interested in continuing a working relationship with meFebruary – Went back to the store to purchase touch up paint for master bath and semigloss for master bath, met with Client/Claimant in Port Hueneme to remove shelving from wall, took several hours, lots of brackets/ boltsPainting of common areas and entryFebruary - Showed up early to paint, started final coat in Master Closet, first coat in Master Bath, had to stop to meet with electricianWent to the models with the electrician to discuss where to move the plugs (this was what Client/Claimant should have been doing) installed the doggie doors as instructed using materials supplied by Client/Claimant, but the bolts were too long, so they needed to be cut and did not have my grinding wheel with me, so I left them long and planned to cut them the following dayPainted upstairs bathroom a second coat, touched up master bedroom and baseboards, painted kitchen and cut in red accent wall in daughters room so her son could paint it while I was back in Port Hueneme picking up shelvingDrove to Port Hueneme to load and transport shelving, but shelving was already loadedClient/Claimant had my drywall mud and asked me to patch the holes in the wallsI patched 20holesI did not need to be thereI wasted time driving, taking down a cabinet, etcso I drove back to the new house to finish pick upThe electrician was still there working on the fans upstairsI locked up at 7pmFebruary 25- took the day off, spoke to Client/Claimant in the evening to plan the next day, I told her that I had arranged for 2-painters to come out the following day so that we could finish fasterClient/Claimant said she had gone back by the house with her friend and was unhappy with the work so maybe it would be better if she got a different painter to finishAt this point, she had threatened this about different timesI assumed that she wanted her friend to finish the painting, so if she wanted him to finish the painting and I would do the carpentry, it would be fine with meWhen I agreed that she could get another painter, she freaked out and told me it would take another month to get another painter| offered on several occasions to finish the project, stating that it would be more cost effective for both parties involved, if she would allow me to finish the projectShe did not allow me to do soSince the contract prices were based on completion of each project, I told Client/Claimant that I would prepare an invoice strictly based on time and materialsShe did not object to this proposed resolutionI sent her an invoice on 2/26/Upon receipt of the invoice, Client/Claimant countered with an email claiming numerous issues that she had with the work performed and alleged that there was thousands of dollars of damage done to her property including scratches in her flooring, paint tracks on her flooring, etcand that her doggie door was installed in the wrong place, resulting in her having to pay to have it movedWith so many of her friends milling about the house during her BBQ, while it was being painted, in addition to movers being present moving furniture up and down the stairs, etcI would be hard pressed to take the blame for any alleged damages to her flooring, etcIn addition, at the time I finished work on Tuesday Feb 24, believed that I would be returning to work, therefore her complaints of paint on baseboards, and left behind supplies, equipment, etcis also a mute point, because I was not allowed to finish the project and therefore was not allowed to clean upHer claim that her doggie door was installed in the wrong place is also invalid, because both the electrician and I took the instruction directly from Client/Claimant as to where she wanted it installed, and though she was advised by both myself and the electrician NOT to put it in its current location, she decided to have it installed thereI asked her to please email me photos of the alleged damages, which she claims to have photographed, and I have never received anyI never refused to return her key and in fact, sent her an email on 226, telling her that we were going to be out of town that evening, but we could meet her the next day to return the keyIn each email response, Client/Claimant continues to add complaints and additional allegations of damages to her propertyShe also threatens to complain to the CSLB, the Revdex.com, my bond company, etcI believe that she is doing this in an effort to avoid paymentAfter sending her the initial invoice for time and materials on 2/26, spent additional time corresponding with Client/Claimant from 2/27-3/4, trying to come to an amicable solutionHowever, she continues to challenge every invoiceWhen she asked me to email receipts and said that she would send a check, she received the receipts and then said that she needed me to highlight the invoicesShe continues at every step to cost me more money in wasted timeThe final invoice, which I sent with the lien notice, includes all labor hours, materials and time lost due to collection costs [redacted] , Owner Graham Finish Carpentry

With regard to Ms [redacted] previous response, I can only say that as time goes on, the allegations of damage to her home seem to gradually get worse and worse, yet my requests for photos of the damages have been deniedAccording to her most recent response, she stated that she is now experiencing extreme duress, sleeplessness, panic attacks and high levels of anxiety.” It seems almost comical that someone who just moved into a brand new home, could be experiencing so much emotional turmoilI am a blue collar worker who is struggling to pay rent and bills and feed my family, which has been made quite difficult due to Ms [redacted] refusal to payShe has also contacted my Bond Company and The Contractors State Licensing Board, in addition to the Revdex.com, in an attempt to avoid paymentAny and all of these could be potentially detrimental to my livelihoodIf anyone should be experiencing the emotional suffering that Ms [redacted] is claiming, it should be meOnce again, in an effort to resolve the matter, I offered Ms [redacted] a settlement amount of $2000.00, (which was less than the original invoice) on Thursday, April 2, Instead of returning with a negotiated settlement, Ms [redacted] immediately digressed into allegation of damagesThis is making peaceful resolution very difficult as she continues to drag the situation out and waste more and more of my time, which is precious since I am trying to make up for the significant financial loss that I incurred by doing work for Ms [redacted] At this point, I am not interested in continuing to debate her version vsmy version of the events that led to where we areI am only interested in resolving the matterSo if Ms [redacted] would like to negotiate a fair settlement, I would be more than willing to entertain itThank you for time, [redacted] Graham Finish Carpentry

I am rejecting this response because:In response to Mr***'s settlement offer of $2,000, I immediately responded to him via email with two questions: Is he willing to accept responsibility for the damage he did to my home? If not, I asked him to please forward me the contact information for his liability insurance so that I could file a claim I am not able to evaluate his settlement offer without knowing whether I will be compensated for the damages and poor workmanship to my home The bond claim for poor workmanship is still pending; the claim to his bond company for liability was denied due to the fact that he does not have liability coverage through that company He has thus far ignored those two questions, leaving me unable to respond to his offerMr*** never asked me for the photos, the only reference was in an email where he stated: "feel free to send any pictures you may have...." Review: Mr. [redacted] agreed to complete several home projects for me, including painting the interior of the house, removing and reinstalling shelving, renovating a closet, and installing a doggie door. In the 6 days he worked in my home, he did not finish one project, and did thousands of dollars worth of damage to my home. He gouged and scratched my wood floor and in the process of installing a doggie door he cut the stucco hole too large, requiring repair to the wall and movement of the doggie door. He dripped and ground paint into the flooring in every room and hallway of the house, he dripped paint all over the baseboards, vinyl window frames, and ceilings, he refused to use tape, and, when it became apparent that he was not going to be able to complete the job satisfactorily and the arrangement fell apart, he refused to return my house key upon request. He then sent me an inflated invoice. After I asked for more detail to the invoice, the names of his employees who worked in my home, and copies of his receipts, he filed a lien on my home. The receipts he ultimately sent me included items that he had previously agreed to pay for, including re-usable brushes, buckets, etc. He left bullying voicemails for me telling me I needed to pay him and threatening to file a lien, alternating with messages that he needed the money to feed his kids. I have to hire new painters to fix all of his mistakes as well as other contractors to fix the doggie door and flooring. The lien paperwork that I received on 3/16/15 contained a second invoice that was double the amount of the previous invoice and contained no justification or details for the charges whatsoever. This smacks of extortion.Desired Settlement: I have an open claim with his bond company in hopes that they will negotiate a settlement. I have also filed a complaint with the CSLB. I hope to recover the cost of repairing the damage to my home and the cost of the lien he filed against my home. The total damages I am seeking amount to $7796.07, plus the cost of repairing the flooring. An estimate is in progress for that.
