Complaint: [redacted] I am rejecting this response because:Mr [redacted] "team" has already been emailed regarding this issueI do not wish to meet with them because as cited in the last correspondence of this complaint, I was threatened and misquoted by one of his executives during our last meeting.? ? MrGoff stated he is concerned that the engineer's solution "may violate" the approved drainage plan for the communityHe can forward the drainage plan to me and I will have [redacted] and [redacted] review it.? My thoughts are that this will not happen, because as shown in previous correspondence in this forum, representatives from Graham Hart Home Builder refuse to answer questions or provide information.? ? Complaint: [redacted] I am rejecting this response because:The response made by Graham Hart Home Builder is inaccurateFirst, the engineer and city inspector mentioned approved new home construction drainage prior to the completion of our home, so it is irrelevant in regards to the damage done by the last repair Graham Hart Home Builder attemptedSecondly, Graham Hart Home Builder's proposed plan requires the approval of our neighbor, as they will need to dig up his/her yard as well, including tearing down and replacing our shared fenceWe have repeatedly asked Graham Hart Home Builder if they have contacted our neighbor about the repair and their correspondent refuses to answer or ignores our question, which leads us to believe that approval has not been grantedIn the Graham Hart Home Builder response, it is stated that the repair is ready to move forward, but this is a statement if the approval from our neighbor has not been receivedIt is very odd that they refuse to answer this specific questionLastly, we asked for the name of the contractor Graham Hart Home Builder plans to hire to conduct the repair and again, the correspondent refuses to answerWe feel this is due to a conversation we had with the irrigation specialist that the general contractor for Graham Hart sent to our home, without notice, and was "caught" sneaking into our backyardIt is his professional opinion that a French drain would be the only way to fix the issueThe contractor also stated that with his experience working with/for Graham Hart Home Builder that they most likely would not fix the large trench created in our backyard by the last repair attempt AND pay for the installation of a French drain, so we should be prepared to settle for one or the otherAre we supposed to feel comfortable with a contractor who states that in his professional opinion the only repair that is likely to work is a French drain attempting a repair that he has already stated will fail? We have also asked the correspondent from Graham Hart Home Builder to explain how the opinions of the three professionals we spoke to, including the contractor mentioned above, are wrongWe have asked these specific questions in writing several times and have yet to receive any answers to these questions. I am rejecting this response because:Graham Hart Home Builder is again making inaccurate statementsThe reason they were even speaking to us is because it was discovered by the companies we paid that Graham Hart Home Builder had improperly installed pipes into the ground that are contributing to our drainage problem and will eventually damage the foundation of our homeThe company did not believe this and wanted representatives to see it for themselvesThe last time I spoke to anyone from Graham Hart Home Builder was last Friday, May 4, 2018, at 11:AM, to discuss the in-ground pipes which the two representatives they sent out confirmed were installed incorrectlyOne of the representatives tried to discredit our independent engineering report stating, "I could pay someone to write one of those in my favor." The representatives were provided with page two and page five of the independent engineering report, both of which pertain to the drainage problemThose pages were explained in full detail. Neither of them asked for any other pages and I have not heard from anyone sinceI would be more than happy to provide the three other pages which include the foundation report and the disclaimers for servicesThe representatives' last words were that I would hear back from someone by Friday, May 11, 2018, as to whether or not Graham Hart Home Builder would conduct the repair in the independent engineering report that was provided to themJudging by the response that was given, "We still stand ready to make corrections as previous stated an await the complete report to review", it seems as if Graham Hart Home Builder has already made their decision regarding whether they will conduct the repairs in the independent engineering reportIt should be noted as well that the representatives at our home on May 4, 2018, confirmed that Graham Hart Home Builder has been denied access to our neighbor's yard which means that the previous repair mentioned by the respondent for Graham Hart Home Builder cannot be conductedOn Friday, May 4, 2018, one of the representatives made it clear that the reason we had not heard from them prior to calling them out was because we had filed a complaint against them with the Revdex.com.

We have met with the home owner to discuss the options they have received from other sources. We left with their engineering report and since have requested the entire report for review. We still stand ready to make the corrections as previously stated an await the complete report to review

I am rejecting this response because:We paid an independent engineer, along with a professional foundation repair company, to review the proposal Graham Hart Home Builder has put forthThe engineer, and the foundation repair company, both stated that the solution proposed by Graham Hart Home Builder would not be sufficient to fix the problem, especially if our neighbor's yard cannot be graded at the same timeGraham Hart Home Builder as of the time of this email, has not answered any of the questions posted in the original complaint, that have been asked on multiple occasionsThis leads us to assume that they do not have permission to dig up our neighbor's yard, cannot stand behind their proposed solution, and plan to use a company that had a representative confirm the solution would failWe are willing to accept answers in this forum.

When the home was closed there were no outstanding items that needed to be addressed (I have attached our closing affidavit).? We have reworked the drainage swales on both the right and left sides? of the home and have documented the fall necessary to have proper drainage per our
standards.? It is not uncommon for swales to remain moist after a rain event or frequent watering.? This information was documented and provided to the home owner upon closing (I have attached that as well).? We are currently trying to get a meeting on site to inspect the issue.? ?
