not willing to give cash back because the customer did eat the rest of the food.

The delivery driver picked up the Italian sub so I did not eat that at all. I did eat the remainder of the food purchased. All I am requesting is my $5 back. I ordered at work and I have coworkers as witnesses that seen the delivery driver pick up the sub sandwich that I did not eat. This is theft because I did not receive the $5 back for a sub that was returned to the store. I will get the police involved if I have to.
