Complaint: ***I am rejecting this response because:
This response is loaded with partial truths, and outright lies. I am literally floored that this is the response I am receiving. Here are the facts as I remember them.
-The ORIGINAL plan was to convert a car garage into bedrooms and a living space with the bathroom being reconfigured to code so the electrical panel was on the outside of the bathroom, leaving a car garage
-The original plan was complicated and the building department would not approve the plans with the number of windows we wanted to install.
-We simplified the plans so we could meet code, and use a legal number of windows and decided to follow existing beams to create a theater room, and bedroom, on one side, and a bedroom where the living space would have been on the other side. The bathroom was still to be brought to code. There are no walk in closets, just a large closet that was ALWAYS going to be there (just changed to a bedroom closet instead of a linen closet). You were happy with these changes that were made at the beginning of the project, because you said yourself, it was going to be simpler and cheaper
-The window placement that you are describing was moved to the 2nd location only once and took a couple of hours to completeI was here when it was done.it
-The large 4'X8' window that was supposed to be installed in the bedroom was not installed and instead we came home to 4'X3' windows installed in it's place. Rather than make them redo them, we accepted the mistake!
-The incident you are referring to as "the homeowner demanding that an entire bedroom be done in one week prior to her return" is an out and out lie! After being forced to live in the unfinished upstairs portion of the house while the construction was continuing LONG PAST the stated time, the foreman of the job was working hard to get a bedroom completed. Upon a conversation I had with him, I quietly said that this was a very stressful week long visit to the children's hospital for my son and I, and that he would be seeing different specialists all week and would be finding out if the chemo was working or his brain tumor had recurred for a fourth time. I also told him that we were returning on October 30th which would be a very difficult day for my son, as he lost his best friend to cancer on that day and he was very emotional over it. I said to the foreman, that if there was any way he thought the bedroom could be completed by that day, it would be a wonderful surprise for my son and might help to take his mind off of the trauma of the week. He responded that he didn't see any reason that it could not be completed and that he would do his best. There was ABSOLUTELY no demanding of ANY KIND!
-As far as the electrical work we were doing was concerned, I do not accept that as being the reason that the work was not completedIn fact, you were not showing up on the job at all for weeks at a time
-I DID fire the cabinet refinisher, but you yourself said that the work was terrible, and I gave him several opportunities to fix it. Then you tried to fix them yourself and even had them installed with major damage done to them. Everyone who has walked into my home is horrified at what they see
-I did NOT fire the painter. That is another lie. I did however tell you that the paint job and drywall needed repairs and neither you or the painter showed up to fix anything. In addition, the painter was showing up here begging me to pay him because you had not due to a lack of resources
-I have not received a single receipt to date for a single supply purchased or a single man hour paid for
-After carefully reviewing the contract and going through every item, I have come up with a detailed list of everything that was completed and everything that was not completed. I will attach the file to this complaint and am also sending it in with my complaint to the CCB. The amount of work that was completed comes to $34,428.20. (and that is even with me GENEROUSLY allowing full bid price for the shoddy drywall, paint and damage to the doors, windows and uneven baseboards. Keep in mind, that I have DATED photo evidence to PROVE EVERY ITEM IN THIS COMPLAINT.
-In addition to all of this, your business BLAMED ME for being unable to pay your subcontractors by flat out stating to the plumber, that you could not pay him, because I had not paid for siding! That was an outright lie as well! I even called the office to call you on it with the plumber standing feet in front of me and was apologized to. So don't you DARE feel like you can shift the blame to me after I gave you MONTHS of understanding (even though it was costing us a fortune to maintain two homes and we missed the prime opportunity to sell our other home) because I felt sorry for you and the workers. I gave you a TON of time to get it sorted out knowing that your business was struggling and even PROTECTED you when people asked about how the job was going, so as not to cause you to lose any business!
So the way I see it, the original bid was for $82,596.69 deduct the remaining work that was eliminated, left undone or must be redone or repaired which comes to $48,leaving a balance we should have paid you of $34,428.20. We paid you $64,which means you owe us a refund of $29,571.80. This does not include the massive amount of money we have lost due to you not sticking to your timeline, you hiring incompetent employees and sub-contractors, or you mismanaging the project from the start. You abandoned this job because I notified you that I was filing a complaint (which was long overdue) and because I demanded a structural inspection which I was unaware had not taken place until I was told there would be no inspection by the foreman. Why did we have a permit if you did not plan to have an inspection done. If this matter is not settled immediately through the CCB, I DO intend to sue youAnd not only will I be suing for a refund that we are absolutely entitled to, I will also be suing for the cost all of the things we have had to pay due to your mismanagement (extra costs for interest on loans and credit cards that would have been paid off if we had been able to convert to a conventional mortgage, money lost by not being able to list our other home because we were months behind schedule, the cost of keeping homes going at the same time, and the severe emotional distress you have put our entire family under in having to deal with all of this.) I was SO wrong to have trusted you and was an it to have tried to protect you. I don't know what you are thinking when I have ALL of the evidence! I hope that you will think about that and decide to be reasonable about this, because I would just LOVE to hear what you have to say when you are under oath, if it comes to that

It is quite obvious that the integrity I thought your business had, was well misplaced.  You are indeed telling outright lies in this response.  I am in absolute DISBELIEF that anyone can be so dishonest, but then again, my husband has always accused me of being naïve. Apparently there will be no reasonable response from you, so I will be pursuing further action in order to complete my house. 
If you think for one moment that you are getting another dime from me for an unfinished house, you are sadly mistaken.  I have had contractors review your work, as well as the bid, and there is not a person on that planet that is going to say you even remotely deserve half of what you have already been paid. 
There is also not a person on the planet who would say I have an ounce of dishonesty in me. I am not at ALL the person you are making me out to be!  I hold my honesty, integrity, and kindness to others above all else.  Nobody could say otherwise.  Oh and by the way, MOST of the changes we made, were because they were suggested by someone who was working for you as being a better plan!  I take responsibility for moving one of the windows, but like I said in my last response, it literally took them a couple of hours to move it, I was HERE at the time! 
As far as the subcontractors being paid, I was just in contact with the plumber this week and he had still not received payment from you. No idea if you have paid the drywaller and painter or if you paid the granite supplier, tile supplier, or [redacted]. When we meet with the CCB mediator, please bring your detailed receipts and check stubs for all suppliers and labor paystubs for [redacted], [redacted], [redacted], [redacted], [redacted], [redacted]'s assistant, and the three other employees who worked here whose full names I don't know, [redacted], and the two others. 
 
I think that my level of understanding up until this point, as well as my kindness, are something you have misinterpreted.  If you thought that you could act tough and intimidate me into letting it go, you are wrong.  I am kind and understanding when things are going wrong and I am under the perception that you are doing everything you can to fix them.  The second you crossed over into dishonesty, that has all gone out the window.  I honestly believe you should lose your license for this. I don't wish this horror on ANYONE!Sincerely,

The time frame for completion was 6-8 weeks with most of the delays being caused by others, such as cabinet refinisher (Whom the home owner fired), electrician which held the job up until November and a painter how was also fired by the home owner. Most delays were due to home...

owner change orders or electrical work not completed. A deposit and progress draws are common practice with all contractors. Many of the delays were created by the home owner such as putting a window in, taking it out a few days later only to put a totally different window in 1 month later. Original plan was converting a 4 car basement garage into a two bedroom, one bath (already existing) and a living space leaving one stall as a garage. This layout changed several times over a several month period. The latest version rendering 2 bed rooms, enlarged 1 bath, large walk in closet and a home movie theater.
As of August 21st, total material and labor costs were $63,348.30. Material cost alone since Aug. 21st are $12,083.42
Job site inspection would be for the electrical work done in walls prior to sheet rock going up. Since the electrical is not complete, an inspection cannot be performed. In note to that, the home owner demanded a bedroom be completed in week following here return home. Working with only one plug in the entire downstairs proved to be a struggle. The home owner is bound by the contract set forth by the CCB.

The response is not partial truths and lies.
There will not be a refund of any amount of the signed contract that has been paid to date.
We have receipts totaling $44,373.68 and labor costs that exceed that number. We are not asking you to pay anything over the original amount of $82,596.68 of the original contract. We anticipate that you uphold your end of the agreement. Should this agreement not be met we will be asking for the full amount of cost and labor for change orders that exceed the original contract.
We have gone above and beyond to satisfy your requests. Every time that you state you didn't like something and would like it a different way, that's a change order and we would did it. Change orders cost material and more importantly labor.
Another example - Adding a movie theater in place of a bedroom and adding a bedroom to the living area is not simplifying a plan. It makes it more complex. Addition material, additional labor, sound proofing, seating platform, additional wiring etc. This is not simplified or cost effective. I could continue on about each change order and you can argue that some things were taken out to save cost but simultaneously changes were made on almost a daily basis. There are standards in every industry and we have met or exceeded those standards for our industry. Because your standards are higher (perfection) than the industry standard doesn't make you right. Nothing in this world is perfect.
Finishing your sons room was a demand by you, not a lie by me. There were several individuals in the room when you made the comment. The foreman stated he believed he could have it done when you returned. Your statement was that it will be done or we would be dealing with your husband if it wasn't. True statement, witnesses present.
The electrician is the #1 reason for delay with change orders being #2. An inspection can not be performed until the electrical is done. Once approved for electrical, then insulation and sheet rock can be installed.
In respect to sub contractors getting paid. Had your electrician finished his job 6 weeks earlier, the down stairs left as the original drawing we would have been completed, a draw received form you and subs paid. Once again it comes back to the electrician and change orders.
No refund as you are asking for.
Contract amount to be paid in full.
If arbitration or litigation occurs, full amount of all materials and labor exceeding the original contract amount for all change orders will be added to the final invoice.
At this juncture we are satisfied with our response and do not anticipate any additional information from complainant.
