Improper grading leading to inability to grow and maintain a backyard of a brand new house. The builder refuses to take any responsibility for it. We purchase the house May 20th for 246,000. The backyard was suppose to be seeded twice per the company it was not. We voiced our concerns on the final walk-through ( May 18th) and were advised it would be taken care of. On or about July 8th, Gray Wolf and [redacted] Construction buried all of our down spout in an effort to resolve rain water run-off. They made us split the cost with them; costing us $325. This did not remedy our problem. We submitted several pictures and videos documenting the erosion and excessive water flow. We were told they going to resolve the problem on or about the first week of August. They were coming together to get a plan together. After three weeks of unresponsiveness and being ignored, they decided nothing would be done ( Wednesday August, 24th) and it was our problem and our fault. On Saturday, August 27th, we purchased 8 shrubs and several bags of soil, and other yard supplies to help with the erosion in our backyard totally 455.00. We also purchased 2 yards of river rock in effort to deter the water flow. That cost 180.00. Due to the fact that Gray Wolf gave us the run around and now refuses to do anything, our floors and the inside of our house constantly has red dirt and red dirt dust throughout. We purchased 5 throw rugs totally well over 400.00 to help keep the floors clean. They had the nerve to blame the dogs for the mess. If they would have not gave us the run around, we could have been more proactive and started working on the yard. Now, our floors are more damaged and my family is breathing in this dust which IS NOT HEALTHY!!! I am appalled that someone can spend this type of money on a house and a builder turns their back on them. This property was properly graded and constructed to meet all applicable building codes and industry standards with respect to surface water drainage. The back yard was seeded and straw applied properly prior to your purchase of the property. Gray Wolf is not responsible for maintaining the grass after you take possession. Gray Wolf has attempted in good faith to work to find solutions to your concerns, including contributing payment for landscaping work that has been done, directed by you. [redacted], with [redacted] Public Utilities, has inspected the property, and found the construction met applicable standards and drainage was proper. In addition, it is evident from an inspection of the property that you have made alterations to the lot have been performed that have disturbed the soil and grading, including the construction of a wooden fence, the burial of the pipes attached to the downspouts, and a trench has been dug across the back yard, leading to erosion and improper surface water flow. Gray Wolf did not recommend, nor authorize or implement any of this work. These changes and work were done at the direction and decision of the property owner.Gray Wolf works hard to provide quality construction and ensure their new home customers are satisfied with their purchase. However, Gray Wolf is not responsible for changes you make to your property and hope you understand these changes affect both your and your neighbors' property.Sincerely,[redacted]Consumer Response The reply from Grey Wolf's attorney is very much inaccurate, Grey Wolf was informed about the grading issue prior to us moving into the home or making any alterations to the property. Regarding the downspouts, Grey Wolf actually paid to have their landscaper install the corrugated piping to help deter the erosion from the property. Regarding the fence, there was already a fence at the back of the yard and since water runs down hill putting up sides would not cause water to run across the yard. There is literally an 8 to 12 inch wide flow of water across the back of our home every time it rains. I have documentation to invalidate that entire letter but there is nowhere for me to attach it on this site. When this whole thing started Grey Wolf was taking responsibility for the issue stating we know it isn't correct, we just aren't sure what we are going to do at this time, please bear with us why we come up with a solution. Regarding the [redacted] inspector they reference he verbally advised us differently, however he wouldn't put anything in writing. It is very easy to pass hear say in a letter, I would like to see him stand behind what he states in writing. In conclusion between pictures, videos, and an independent third party report there is more than enough evidence to show that this property was not graded seeded properly.
