contract, which was broken numerous times by client, I comtinued to attempt to make good on my part, only to have work critiqued, and made to do over, even though it was perfectly fine.  After an entire month on the project, it was finally completed to customers satisfaction. I was then called a few weeks later with demands to return all monies, followed by threats of litigation. I have been in contact with an attorney in this m[redacted] and expect to be vindicated of this gross abuse by a homeowner who obviously had issues with every contractor who worked on this project.

I have reviewed the response made by the business in reference to complaint ID# [redacted], and have determined that my complaint has NOT been resolved because:
The contract was not breached. Any “adjustments” such as A/C vent and toilet bowl replacement (wrong one was installed), were additional charges. The A/C vent was an additional $200 and the installation of the correct toilet was $175. What transpired was after the job was completed.  We walked on the tile floor and noticed that tiles were loose and grout was cracked between the tiles. When we contacted Kenneth V[redacted] regarding this problem and some other items on a “punch list”, we were told we were not a priority and to bring someone else in.  This was not acceptable.  He did the work, he has to fix the problems.  He returned on 9/**/15 which was one month after the completion of the job.  He spent part of the day attempting to fix the problems.  However, as stated in the complaint, he did not properly make the repairs. For instance he tried to adhere the loose tiles with silicone instead of using the proper adhesive in addition to leaving previously crack tiles instead of replacing them.  He was contacted regarding same and we felt that he was not qualified to properly fix the problem as it was getting worse. After getting multiple bids from qualified licensed tile companies all concluded that the overall job was done poorly and did point out many unacceptable tiling errors ( refer to original complaint), and the consensus regarding the problem with the floor were all the same. We contacted Kenneth V[redacted] the sole owner and operator of Working Class Heroes, Suffolk County New York License #[redacted] by phone and text to try to work out a financial arrangement to cover the cost of the necessary rip out and reinstallation of the bathroom floor, vanity, countertop radiator and  toilet. The best quote I got was $3,000. He would not agree to any arrangement. My lawyer contacted him in writing to broker an arrangement through the law firm to avoid litigation.  He did not respond to my lawyer.  We filed a lawsuit to recover the cost of the rip out and reinstallation of the bathroom floor. No one I know would rip out a brand new tile floor which should last 40 years, spend money on materials i.e.; tile grout etc. and go through the contractor mess, 7 work days to complete the job unless it was absolutely necessary. So it was obviously was NOT “work that was perfectly fine”. I hold the owner and operator of Working Class Heroes, Kenneth V[redacted] responsible to do the job he agreed to take on professionally and correctly.  It is our house, materials and money that were abused.  This has caused us tremendous time, energy, inconvenience and money. Kenneth V[redacted] should consider himself lucky that we are only suing for the floor and that we did use the lowest bid for the floor or it would be $2,000-$3,000 more. Kenneth V[redacted] you need to review the original “Description of the Complaint”. To be resolved means I am refunded all costs.
