Our Leasing Consultant, ***, denies Mr***s written assertion that she lied, misspoke or otherwise
misrepresented the rental policies of The Covington while interacting with Mr*** and Ms***
The above referenced Complainant and *** *** did apply for tenancy at The Covington, American Boulevard W in Bloomington, MN on December 29,
Prior to submitting his application, Ms*** and Mr***, and indeed all those interested in living at The Covington, are provided with The Covingtons Statement of Rental Policy and asked to sign the document prior to formally submitting their application and before presenting a Reservation Fee to hold" a specific apartment throughout the application processThe SRP clearly states, in paragraph 3, that a Reservation Fee" is required with the application to hold an apartment throughout the approval process."
The applications completed and signed by Ms*** and Mr*** also clearly state, in paragraphs and respectively, If accepted, Applicant agrees to enter into rental agreement applied for within one (1) business day of being notified of acceptance." "If Applicant, after being accepted, fails to enter into a rental agreement as provided in paragraph (above), Management will retain all of the security deposit as reimbursement for any rent lost due to Applicants failure to enter into the rental agreement." Both parties were telephoned by our Leasing Consultant, ***, on January , 2015, upon her receipt of an ACCEPTED" background check by the MCC Group, to advise them that they were approved for tenancy and needed to come into The Covington to sign their lease*** was notified at that time that Mr*** had lost his job and that he and Ms*** were unable to move in to The Covington
That is consistent with the fact that the return address on Mr***s complaint is the same as the current address shown on both of their applications
Mr*** came into the ManagementLeasing Office and was subsequently told by our Community Manager, ***, that because he and Ms*** did not enter into a lease agreement with The Covington once their application for tenancy was approved, Management opted to retain their Reservation FeeSecurity Deposit as per the policy noted in paragraph of both of their applications
Further, it is our company policy that forfeited" Reservation Fees are immediately deposited once management determines that the Applicants) will not follow through with their commitment to lease the committed" apartment

whatever it stated in the papers we signed quickly she should've been honest and said up front u won't get your deposit back if you don't move in or move inwe would've been okay with that answerinstead of saying that we "hold" and deposit it on your move in datethan most likely we would've not taken
