The tax preparer improperly filed my 2013 taxes resulting in a bill from the IRS.For the 2013 tax year, the tax preparer committed an error by omitting a column of interest income from my federal tax return. As a result, I recently received a bill from the IRS for a substantial sum of money. [redacted], the owner and tax preparer offered no remorse in his mistake and has offered only limited compensation, but says I must sign an "agreement not to sue." I do not plan on suing, as it is not worth my time or expense. I simply do not want to sign this agreement just to receive the refund that I feel is due to me for his mistake. I also want other potential clients to be aware that he does not take responsibility for his mistakes as a good business owner should. I understand mistakes happen, no one is perfect, but an "I'm sorry" or "It was my fault" would go a long way. Furthermore, he offered no advice on how to deal with the IRS bill. Business Response I agree that I made an error (left off an item of income) on the taxpayer's return that resulted in a prior year tax obligation being postponed (but not increased) until the following year. As per industry best practices I wrote the taxpayer a check for not only the interest the IRS charged for the tax obligation but a year's future interest, as well, in case it took him some time to pay his tax bill. I also offered to refund the taxpayer the cost of preparing the return. I was under no obligation to refund his fee but made the offer as a gesture of good will. I did ask the taxpayer to sign a "waiver of liability" in return for the refund. If he believes he has suffered a loss (he has not) then he is free to sue me. But I will not write a check that I'm not obligated to write and then be sued for my efforts. He can pick one or the other. He can't have both.Consumer Response My argument is not that my tax liability was increased nor that I have suffered a loss. I have never expressed those concerns so please stop bringing that up. I did however receive inferior service and I would like a refund due to the inferior service (that is industry best practices). I would compare it to going to any other store, buying a product, having a defect in that product and returning it to receive a full refund without having to sign a piece of legal documentation. Imagine if [redacted] asked you to sign a "waiver of liability" every time you returned something to their store. I have no desire or time to sue. I simply want a refund that any other legitimate, worthwhile business would provide when inferior services were provided. I simply want to be done with this situation that has cost me a great deal of my personal time doing research and talking to the lovely IRS on the phone.
