Complaint: [redacted] I am rejecting this response because:The Au Pair was not trained Pursuant to the Department of States Requirements. Per Department of State 32 hours of training in child safety and development is required. I have proof that on May 11 at 11:44 AM she was only 50% complete in training. This means that she would have to complete 16 hours of training to complete the requirement. I have requested three times to provide proof of required training, and Great Au Pair has ignored my requests. [redacted] and Great Au Pair are in breach of contract. Great Au Pair for failure to perform obligations under contract and [redacted] for posting my children's photos and photos of my vehicle with license plate exposed on Facebook. I have completed all my obligations under the contract and have requested a full refund of the fees paid to the Agency, but they have refused. The 4 weeks prior to me firing [redacted] and then forced to keep her in my home for 2 weeks, was disastrous. She left my children on the playground, she crossed train tracks while the gates were down, committing a crime and putting all lives in danger. She lied to my family about her ability to drive, she did not cook, clean or help with homework, she took pornographic photos on the phone I provided for work purposes. She had strange men come to the house to pick her up (she was involved with three men during the short period of time). She considered fleeing my home to become an illegal immigrant, a friend skyped her to talk her out of it. My children were put through extreme trauma and danger under her care, I have had to resign from my position I accepted in April, and planned on having dependable childcare for a year. The emotional and monetary damage is far beyond the entire fee I am requesting to be refunded. If this is not done in good faith, I will proceed to with legal action to sue for damages. The Agency is a sham, and not following regulations. Upon research all other Agencies bring the Au Pair to the US and require 4 days of training before the Host Family is allowed to pick them up! They failed to obtain required references for the Host Family. The failed to confirm that Au Pair had a private enclosed bedroom before arrival of Au Pair. The list of negligence on the Au Pair's part and the Agency's part is extensive. I will forward documentation, and if any of you are parents, you will understand that what my family had to endure to their incompetence and negligence should be corrected based on good faith and plan correct moral action! Company’s Response:Complainant contracted with GreatAuPair on December 16, to recruit, screen and train au pair candidates forComplainant’s considerationAfter performing his due diligence, Complainant chose to match with a J-au pair fromthe PhilippinesIn order to match with a Filipino au
pair, all host families must follow the procedures of the ‘RedRibbon’ Authentication Process, as promulgated by the Philippines’ Department of Foreign Affairs, which requiresnotarized agreements be submitted to the Philippine consulate prior to issuing a visa.The Red Ribbon Process requires additional screening and vetting, above and beyond what GreatAuPair typicallyprovides for candidates from any other countryAs a matter of supporting Complainant in his choice to host hischosen Filipino au pair, GreatAuPair provided additional support and services to Complainant as required to facilitatethe issuance of his au pair’s visa, which was approved, resulting in Complainant’s au pair arriving in March of 2016.GreatAuPair ensures that applicants meet the J-Au Pair Program acceptance criteria and that all applicants have therequisite experience as outlined by the US Department of StateGreatAuPair’s Filipino Partner agency also confirmedthat the Complainant’s selected au pair met all Department of State requirements for program participation, and thatthe au pair was properly screened and vetted prior to her entrance into the J-Au Pair ProgramThe results of the aupair’s screening were clearly documented and provided to Complainant in the au pair’s profile on the GreatAuPairUSA website prior to Complainant’s final selection of his au pairPrior to selecting his au pair, Complainant had theopportunity to further vet the au pair personally via Skype video conference at least times, as is required by policyand US Department of State regulationsThe Complainant host family is the employer and is therefore the finaldecision maker in hiring/hosting the au pair of their choiceGreatAuPair denies that Complainant’s au pair was notproperly vetted or suitable for the J-Au Pair Program as evidence proves suitabilityGreatAuPair also calls attentionto the fact that a U.Sconsular officer in the Philippines evaluated and verified said au pair’s credentials and ability toparticipate in the J-Au Pair Program prior to issuing the au pair’s visa.Per GreatAuPair’s Host Family Agreement, it is the host family’s responsibility to confirm that a prospective au pair is June 14, 2016, prior to the family’sextended Summer travel to their home near Los Angeles, CAThe Complainant then requested that the au paircontinue to provide childcare services until June 14, The au pair provided said childcare until June 14, 2016, atwhich point the au pair left the family’s home, as requested by Complainant.In the event that an au pair leaves the J-Au Pair Program, GreatAuPair immediately reports this departure to theappropriate governmental entities, Department of State and US Immigration and Customs Enforcement (ICE) and/orthe Department of Homeland SecurityPlease note, contrary to Complainant’s statement, the au pair is not a fugitivefrom the Immigration and Naturalization Service, as the entity known as, “Immigration and Naturalization Service” hasnot existed since as it was replaced by the U.SCitizenship and Immigration Services.The Host Family Agreement clearly defines the terms and conditions for credits and refundsComplainant waseligible for a replacement au pair within the first months of his program termGreatAuPair offered to provideComplainant with a replacement au pairComplainant declined a replacement and asked for a refundSo accordingto Section on page of the Host Family Agreement, the Refund Policy, to which Complainant agreed, states thatComplainant may receive a refund of $per month for unused service, less any balance due on the I am rejecting this response because:This is the same explanation provided earlierGreat Au Pair provides a standard contract, and does not layout a reasonable remedy should the au pair fail to meet the contract for their J-visa and service time.Great Au Pair wants to profit as the provider of the Au Pair, but not share in the risk, once they fail to perform.Additionally, the contract that was signed did not specifically lay out a remedy should one of their Au Pair's becoming AWOL and break their J-Visa with State Dept.Great Au Pair and specifically the owner MrPitts has been difficult to work with in obtaining a fair and reasonable pro-ration of their fees as was laid out in my complaintAt the very least, it is important for any prospective customers of this business understand exactly how they operate before they use their service

I am rejecting this response because:The Au Pair was not trained Pursuant to the Department of States Requirements.  Per Department of State 32 hours of training in child safety and development is required.  I have proof that on May 11 at 11:44 AM she was only 50% complete in training.  This means that she would have to complete 16 hours of training to complete the requirement.  I have requested three times to provide proof of required training, and Great Au Pair has ignored my requests.  [redacted] and Great Au Pair are in breach of contract.  Great Au Pair for failure to perform obligations under contract and [redacted] for posting my children's photos and photos of my vehicle with license plate exposed on Facebook.  I have completed all my obligations under the contract and have requested a full refund of the fees paid to the Agency, but they have refused.  The 4 weeks prior to me firing [redacted] and then forced to keep her in my home for 2 weeks, was disastrous.  She left my children on the playground, she crossed train tracks while the gates were down, committing a crime and putting all lives in danger.  She lied to my family about her ability to drive, she did not cook, clean or help with homework, she took pornographic photos on the phone I provided for work purposes.  She had strange men come to the house to pick her up (she was involved with three men during the short period of time).  She considered fleeing my home to become an illegal immigrant, a friend skyped her to talk her out of it.  My children were put through extreme trauma and danger under her care, I have had to resign from my position I accepted in April, and planned on having dependable childcare for a year.  The emotional and monetary damage is far beyond the entire fee I am requesting to be refunded.  If this is not done in good faith, I will proceed to with legal action to sue for damages. The Agency is a sham, and not following regulations.  Upon research all other Agencies bring the Au Pair to the US and require 4 days of training before the Host Family is allowed to pick them up!   They failed to obtain required references for the Host Family.  The failed to confirm that Au Pair had a private enclosed bedroom before arrival of Au Pair.  The list of negligence on the Au Pair's part and the Agency's part is extensive.  I will forward documentation, and if any of you are parents, you will understand that what my family had to endure to their incompetence and negligence should be corrected based on good faith and plan correct moral action!

To Whom It May Concern, GreatAuPair requires all participants to enter a formal and legally binding contract prior to hosting an au pair. This contract was provided to Ms. [redacted] in writing and discussed verbally, prior to her decision to hire her selected au pair. The terms of this agreement...

require that a family consult with GreatAuPair before removing an au pair from their home, and in the event a family travels with their au pair outside the local community and a problem arises, the family is responsible to make arrangements, at their own expense, to promptly return the au pair to their community. GreatAuPair and its representatives were aware of Ms. [redacted] concerns and were actively assisting to resolve any miscommunications. After thorough evaluation, several GreatAuPair representatives determined that Ms. [redacted] family was in no immediate danger and her au pair was not threatening to harm the [redacted] family in anyway. Ms. [redacted] had no reasonable basis to violate the terms of the contract and disregard her au pair’s personal safety by removing her from the vacation residence as outlined below. While we acknowledge that there were various miscommunications between Ms. [redacted] and her au pair, GreatAuPair representatives, including the Local Coordinator, Program Advisor, and Regional Manager were actively mediating these issues with both Ms. [redacted] and her au pair. Despite these interventions, Ms. [redacted] decided to take her au pair on vacation to California and kick her out of that residence three days before the Christmas holiday. The au pair was in an unknown city, in a foreign country, and with no local contacts or support. GreatAuPair arranged last-minute transportation, and housing for the au pair, but the timing and reasons Ms. [redacted] removed her au pair were unreasonable and doing so violated the contract. GreatAuPair tried to negotiate with Ms. [redacted], but ultimately, on December 22, 2017, Ms. [redacted] refused to negotiate further or consider reasonable alternatives to kicking the au pair out immediately. There was no demand that Ms. [redacted] continue housing the au pair for 14 days. Instead, GreatAuPair requested that Ms. [redacted] work with GreatAuPair to secure suitable accommodations for the au pair until after the Christmas holiday (3 days) and return the au pair to her home community in Portland, OR. Ms. [redacted] refusal to work with GreatAuPair, failure to consider her au pair’s personal safety, and violation of the reasonable terms of GreatAuPair’s contract resulted in Ms. [redacted]'s removal from the au pair program and forfeiture of any refund. At this point I am not sure what to comment on Greataupair and I don’t think this conversation is going anywhere. I don’t understand why it is so hard to admit that Greataupair send me a disqualified au pair. In every business there are unqualified employee which I am sure it is understandable and I am hereI am here talking to you to get the issue resolved.However, now the problem is no longer a disqualified au pair but the hosnesty of your business. I have provided all the text message in true and real and I original format. I will also provide the full text message chain for reference for the public to judge. I am sure with a company like Greataupair, there are more dirty business and worse insistence than mine. I am leaving it to Revdex.com and the public to judge. The text message I provide with Greataupair local cordinator [redacted] Green is all true and real. But so far the company has falsified so much information. If the company provide the recorded conversation of mine and [redacted] Oconer, everyone will see how she threatened me to keep the au pair for 14days. But sadly I am the customer and does not have access to the recording as the company does. But, [redacted] Green’s text message and phone no on top is real and easy for everyone to judge. There’s even one message [redacted] mentioned the au pair is crazy and would not response to her...Well, I guess it does not matter any more if Greataupair falsifying all the information and even denying the true and legitimate copy of the text message.Greataupair is a dishonest and shady business to work with. I am rejecting this response because:1)  I did not receive a voicemail from the business -- they either did not call or called someone else2)  We paid close to $1600 for less than a week of childcare which is unacceptable 3) American Express did not rule in the businesses favor, it is a clerical error4)  Two employees of the business verbally told me their would be a refund if it did not work out within 30 days5) The business sent an Au Pair to our home without a Local Childcare Coordinator in our area6) The Au Pair was outside of J-1 visa regulations when she arrived on October 20.  The last day for her to arrive legally at my home from the prior families home was October 18, so the Au Pair contract should be void as she was not a legal Au Pair.7) I will settle for a refund from the business of $988 --  which excludes my sunk costs of the Au Pair plane ticket $391 and the pay to the Au Pair that I paid directly of $200 and certainly does not cover my time wasted, hassle and scrambling to find a back up childcare provider when the Au Pair left with no notice.

The complainant asserts that 1) GreatAuPair’s Regional Manager refused to assist her family and did not consider all of the evidence prior to removing her family from the au pair program;2) GreatAuPair refused to provide complainant with a refund of program fees, and 3) the au pair did not meet her expectations. Complainant’s selected au pair arrived on November 18, 2017. GreatAuPair’s Regional Manager became aware of concerns in the placement on November 30, 2017 through the Local Coordinator. At that time, the Local Coordinator was addressing all issues with both complainant and her au pair. In an effort to further address the issues, the Regional Manager reached out to GreatAuPair’s partner in China on December 1, 2017, and asked they connect with the au pair to get more information about the issues reported and help resolve any outstanding issues. The Local Coordinator advised that the issues were resolved and that the placement had greatly improved. This improvement was reported via email and through GreatAuPair internal reports on November 30th and again on December 5th. Additional concerns arose on December 14, 2017, and the Regional Manager connected with the Local Coordinator to address those concerns and resolve any outstanding questions. On December 22, 2017, the Local Coordinator contacted the Regional Manager and reported that intervention was needed. The Local Coordinator was unable to speak with the family due to personal travel plans. However, the Regional Manager was not on vacation, and promptly contacted the complainant at 10:10am on December 22, 2017 to discuss her concerns. In that call, GreatAuPair learned that despite previous concerns with her au pair, complainant had decided to take the au pair on vacation to California for the Christmas holiday and complainant and the au pair were no longer in the Portland area (the complainant’s home). After several conversations with the Regional Manager on December 22nd, the Complainant refused to continue housing the au pair and demanded that the au pair leave immediately. GreatAuPair’s Regional Manager asked the complainant to house the au pair through the Christmas holiday and assist in returning the au pair to complainant’s home in Portland, OR, where should could claim her personal belongings and stay with the assigned Local Coordinator. There was no request or demand that complainant house the au pair for 14 days. Complainant’s assertion that she was willing to house the au pair for any period of time beyond December 22, 2017 is simply untrue.GreatAuPair and its representatives were fully aware of the facts leading up to complainant’s removal of her au pair on December 22, 2017. GreatAuPair and its Regional Manager had been aware of concerns since the placement started. However, all previous issues had been discussed and resolved. Despite the prior issues, GreatAuPair did not agree with complainant’s decision to remove her au pair on December 22, 2017. GreatAuPair and its representatives made an informed decision to remove complainant from the au pair program because of her unreasonable demands and refusal to work with staff to find suitable accommodations for the au pair. Prior to deciding to remove the au pair, complainant was informed that her decision to do so was a breach of the Host Family Agreement and the consequences of that decision would be her family’s removal from the au pair program.Despite complainant’s assertions that her selected au pair was “crazy”, the au pair was fully vetted and approved pursuant to GreatAuPair and Department of State guidelines. Additionally,  complainant conducted several one-on-one interviews with the selected au pair before deciding to match and bring the au pair into her home. Additionally, both complainant and theau pair admitted that the au pair made no threats against complainant or her family. Instead, the au pair was requesting that complainant provide her with a schedule of work hours that day. Complainant refused this request and demanded the au pair work for an undetermined period.GreatAuPair does not and cannot guarantee a host family’s satisfaction with their selected au pair as the decision is solely based upon numerous subjective factors including the host family’s childcare needs, au pair and family personality, au pair experience, both party’s expectations, among others.Finally, in support of her position, complainant attaches several text messages purportedly establishing that the Local Coordinator agreed that complainant’s selected au pair wasunsuitable. GreatAuPair has researched and verified that the Local Coordinator did not send those text messages to complainant. Either complainant fabricated the messages to support her position or someone other than the GreatAuPair Coordinator sent those messages to complainant. Regardless, complainant’s use of fabricated messaging to support her claims in a public forum is an egregious act of dishonesty, one which could carry serious legal consequences.GreatAuPair and its representatives go to great lengths to assist program participants in experiencing a mutually beneficial relationship. In this case, as in every case, GreatAuPair andits representatives made every effort to achieve a positive outcome for all parties. Unfortunately, complainant refused to work with GreatAuPair and consider the safety andwelfare of her selected au pair. Due to this behavior, complainant was removed from the au pair program.
