I have included another copy of the checking statement that I provided you on January 9, 2015.As I explained to you on the 9th , the statement copy you received from the branch was for your 590, when it should have been for the The statement provides you the detailed information you had requestedIn regards to your address being changed, along with your phone number, I also explained to you on January 9, that I was able to confirm with our IT Department that you, or someone who had your user id and password, had logged into Online Banking on August 1, and changed the address to our corporate address, and changed the home phone number to our corporate numberEven in doing so however, you would have received written notification of the overdrawn checking account as I stated in my previous correspondence since the change was not made until after your statement cutoff date.Attached please find his July 1, - July 31, Statement of Account

Dear [redacted] I am writing in response to your recent complaint referenced above, filed with the Revdex.com As you are aware, we spoke on February 26, when you called and requested an explanation as to the repossession of your vehicle I explained to you on this day, that the payoff quote was provided to [redacted] Federal Credit Union (***) on November 18, 2014; and included in that quote that posted the same day, was an ACH payment in the amount of $debited from your [redacted] account On November 19th we were notified by ***, that payment was returned indicating “UNABLE TO LOCATE”; thus the payment was reversed from your loan Beginning on November 24, several letters were mailed to your home address notifying you of the past due status of your loan A representative from Telhio Credit Union (Telhio) was able to speak with you on December 3, and made you aware of the returned payment, and advised you that your loan was past due for November 18, as a result, you refused to make arrangements to satisfy the balance, and insisted the loan was paid in full We contacted you again on December 16, 2014, but you again refused to satisfy the outstanding balance that existed As a result of your refusal to satisfy the outstanding balance on your loan, your vehicle was assigned for repossession on January 30, 2015, your loan was days past due Our repossession agent made contact with you on February 17, and also made you aware of the account status, and that the vehicle had been placed for repossession, yet you still refused to satisfy the outstanding balance on your loan On February 26, you called in due to the repossession of the vehicle in question and I explained all of the previously outlined factsI also quoted you the sum of $1,to payoff your loan in full, which included your returned payment plus repossession fees This amount was received from [redacted] on February 27, to payoff your loan in full Because you refused to satisfy the outstanding balance on your loan, after being made aware of it prior to the repossession of your vehicle, Telhio is unwilling to refund you any of the additional costs incurred as a result Should you have any further questions, you may contact me direct at ###-###-#### Sincerely, [redacted]

I have attached a copy of your December statement that
reflects the returned item from your financial institutionThis statement was
e-mailed to you during the first week of January Unfortunately, if you
want anything further pertaining to the returned item in question, then as
previously directed, you need to visit your primary financial institution (***)
where you originated the ACH
As to the additional fees you incurred as a result of the
repossession, I have attached a copy of your executed Note. Please see
the “Default” provision on the back of your contract, it specifically states
what costs you are liable for in the event of defaultPlease also read item
number 7, under the “Security Agreement” which also provides clarification
pertaining to Telhio’s right to repossess the collateral in the event of
default. You were made aware of the default by speaking to one of our
representatives on three different occasions prior to the repossession; in
addition, written correspondence was also mailed to you on seven different
occasions prior to the repossessionDespite both the verbal and written
notifications you were given, you elected to not resolve the delinquency by
satisfying the returned payment you originated through ***, and therefore,
obligated yourself to the additional repossession costs that were incurred as a
result of Telhio having to take possession of the collateral to resolve the
delinquency

I am rejecting this response because: They are still not willing to investigate the situation nor are they willing to account for the most recent statement that was received by their office 1/8/showing a zero balance To me that means the account is zero and no balance is due Why do they keep showing a statement from back in July I need a current statement showing the balance in which they are attempting to collect on An official statement This business is avoiding the original complaint and just beating around the bush I demand that all fees (NSF) be waived and the account be brought back to zero Finally, remove the information from Chex Systems My next step is to take this to the Ohio Attorney General office and the media

It has still not provided the electronic statements requested in every single conversation I have hadNor does it solve the issue of the fines and fees being in excessI was charged almost double what was owed in feesThis is not fair under the terms of the agreements signed between both parties

On Monday the 16th of February I deposited a check for Being that it was Presidents day the bank was closed, so I put it in the drop boxOn Tuesday morning it showed on the online banking that the funds were availableI paid my gas bill and withdrew money to pay for daycareLow and behold they said the money was pending and AGAIN charged me dollars in over draft feesWhen I called the woman said it is because I elected to have over draft protectionI do not believe that when the money said available that it should be changed to say pending as I and my wife both checked that it was available before making any transactions then to be charged overdraftThis is the 2nd time in weeks that I have been hit with dollars in overdraft fees from this bank when money was availableThe check was from *** *** and reputtable companyIt is not my fault Telhio does not have an ATM deposit and then held the money which led to the OD.I would like the dollars back...clearly I can NOT afford OD fees as it will be gas and food money next week

Telhio received notification of the returned item the following
day, on November 19thYour financial institution, *** Federal
Credit Union, can provide you evidence of the returned item against your
account

Telhio ATM have a 2-day business hold. We encourage our members to have
available funds in their account prior to authorizing any transactions with
merchants. When logging into the online banking portal, it reflects member
balances and available balances. Please ensure that you are using the available
balance ledger to determine what is available for use. Please refer to your
Funds Availability Policy and Truth-In-Savings disclosure that Telhio provided

I am writing in response to your recent complaint referenced

As you are aware, we spoke on February 26, 2015 when you

A representative from Telhio Credit Union (Telhio) was able to speak
with you on December 3, 2014 and made you aware of the returned payment, and
advised you that your loan was past due for November 18, 2014 as a result, you
refused to make arrangements to satisfy the balance, and insisted the loan was
paid in full.  We contacted you again on
December 16, 2014, but you again refused to satisfy the outstanding balance
that existed.  As a result of your
refusal to satisfy the outstanding balance on your loan, your vehicle was
assigned for repossession on January 30, 2015, your loan was 72 days past due.  Our repossession agent made contact with you
on February 17, 2015 and also made you aware of the account status, and that
the vehicle had been placed for repossession, yet you still refused to satisfy
the outstanding balance on your loan.  On
February 26, 2015 you called in due to the repossession of the vehicle in
question and I explained all of the previously outlined facts. I also quoted
you the sum of $1,065.36 to payoff your loan in full, which included your
returned payment plus repossession fees. 
This amount was received from [redacted] on February 27, 2015 to payoff your
loan in full.  
 
Because you refused to satisfy the outstanding balance on
your loan, after being made aware of it prior to the repossession of your
vehicle, Telhio is unwilling to refund you any of the additional costs incurred
as a result.

detailed information you had requested. In regards to your address being changed, along with your phone number, I also explained to you on January 9, 2015 that I was able to confirm with our IT Department that you, or someone who had your user id and password, had logged into Online Banking on August 1, 2014 and changed the address to our corporate address, and changed the home phone number to our corporate number. When a title is
transferred out of state it is the responsibility of the owner of the vehicle
to provide the correct address to the BMV in that state. It is also the
responsibility of the owner to provide the [redacted] BMV the odometer reading
at the time of title transfer.   Telhio does not have
the authority to change an address with any State's BMV .
 
This title is not
useless because of an address or an Odometer reading.  A BMV will not
update any information on a title until you transfer a title out of State or
sell the vehicle.

I have requested the date timestamps of the call to provide the payoff amount, the receipt of payment in question, the rejection, and the payment in full. This does not appear within the statement.The question is the large amount. The fees charged by your institution are not in line with industry standard. Price gouging is not acceptable. Also if you check my file I have on hand a request to never speak with your company. I requested to oly receive written communication as I found your institution untrustworthy. I removed my note as soon as I was able which I believe all of this was in retaliation to. Any call if you review I stated the amount was not owed and requested written documentation which was never at any time sent. I am still not receiving it now thatihave requested it even on this site.
