dispute with the warranty. The contract states that WTD would provide a 5 year labor warranty, which means that any damages that occurred due to improper installation would be covered for 5 years. That’s does not include any damages resulting from manufacturer defects, weather, lack of maintenance, or improper use. The customer contacted WTD saying the manufacturer stopped by under the manufacturer warranty for a crack in the bathtub. The customer told WTD that the manufacturer said the crack was caused by an unsupported bathtub. The entire space of the pan was rested in liquid concrete and the front lip was caulked/adhered to the tile. The only part of the bathtub that did not have support was the threshold to the tub, which was intended to be stepped over not stepped on. The tub was intended to be used by an elderly handicapped woman, and the damage came from a wheelchair being repeatedly pushed up against the tub or multiple people standing on the threshold. WTD witnessed in home nurses helping to take care of the woman, assisting her in and out of the bathtub, so the homeowner would not have realized when the damage occurred. The bathtub was manufactured with this threshold attached to it and had nothing to do with WTD’s installation. The crack should either be covered by the manufacturer of the bathtub or they should have it fixed because it was improperly used. WTD will not repair the damage to the tub because it was cause by improper use and does not fall under the warranty. Shortly after the edition was completed, Hurricane Sandy hit. The cap was blown off the top of the roof, WTD came by to make the repair and received no compensation for the repair because the customer assumed that it was part of the warranty, but as stated above weather damage is not covered under the labor warranty. The other incident of the roof leaking was caused by the hurricane and the intense storms that followed shortly after (Hurricane Sandy’s winds superseded the shingles wind tolerance). Several roofs (all being installed by different contractors) on the same street were damaged by the storm. The customer is confusing the labor warranty with a maintenance warranty. Two years after the job was completed the customer called WTD out for a leaky gutter. WTD arrived to look at the problem and saw that the gutters were not cleaned in 2 years. WTD told the customer that the problem was due to lack of maintenance and proceeded to clean the gutters, but received no compensation for the work. WTD sent an employee and an employee of a roofing company, [redacted] to inspect and diagnose the problems with the roof and the gutters. They told WTD that the roof lifted up and fell back down due to the high winds and heavy rains, and the gutter was full of leaves and debris. These issues were caused by weather and lack of maintenance, not by installation error. The customer was made aware that these issues were not covered by the labor warranty. WTD is not returning for either repair because they do not fall under warranty. After WTD made the customer aware that they were not making the repairs, the customer repeatedly contacted WTD saying that it was under warranty. In one instance, WTD was at another job site when the complainant arrived stating that the bathtub was not supported properly, the homeowner that I was doing work for at that time was present during the installation of the bathtub and stated to her that the bathtub was submerged in concrete.
