case. She obviously never responded to the insurance company's repeated requests to comply with the audit in 2015. But she claimed that she never received any notice (please see the attached text message communication in attachments, #1 - #12). But it is known that insurance company always diligently sent several notices before taking action Such as policy cancelation due to non-compliance of audit.Due to the policy cancellation resulting from this audit non-compliance by the insured, [redacted], she received a penalty letter from Commonwealth of Virginia. She signed the letter and sent back on 2/22/2016 to Commonwealth of Virginia acknowledging her mistake/responsibility and to pay a fine of $500 in violation of Workers Comp laws in the State of Virginia. Only after the facts, she contacted our office in June 2016, 4 months after she acknowledged her responsibility to the State of Virginia, and sent us all the correspondences she had had with Commonwealth of Virginia. And we explained that if she had not signed the letter admitting her responsibility and agreeing to pay the fine of $500, we could have tried to address this issue to Commonwealth of Virginia. But since she had already signed it and agreed to pay the penalty, we told her that it is her responsibility to pay it.Weeks later in July 2016, she sent us text message saying that if the policy was cancelled, it was due to insurance agency mistake whereas it was her own responsibility for the policy cancellation due to her non-compliance of audit in 2015 and, also 5 months before, in February 2016, she had already admitted her responsibility and agreed to pay the penalty to Commonwealth of Virginia on her own by signing an acknowledgement letter to Commonwealth of Virginia. But she kept on insisting in July 2016 that it was salesman's mistake which was totally irrelevant and illogical. There was no relationship whatsoever between her own audit non-compliance act resulting her policy cancellation and insurance agent ("salesman" according to her expression)For the recently renewed policies, the renewal date was 175/2017. But as seen on the attached document of insurance company website record (attachment #**), the payment was made Only on 119/2017, 4 days after the renewal date, with her credit card. In the meantime, the certificate holder (her general contractor in this case) was to be notified in general 10 days before the date of renewal date if the payment was not made on time. That's fiduciary duty of insurance agency vis-a-vis certificate holders. So if her Certificate holder received the policy non-renewal notice, it was because the insured ([redacted] in this case) did not renew the policies on time. It was her responsibility to renew them on time. But as seen in the letter written by [redacted] that you sent us, the insured ([redacted]) was blaming insurance agent agency for not renewing her policies on time whereas it was her responsibility to pay on time, and for performing our fiduciary duty as insurance agent of sending the certificate of insurance cancellation notice to the certificate holders.In conclusion, first, the policy cancellation on 8/9/2015 was due to insured's noncompliance of the audit in 2015. Second, she herself agreed to pay the penalty to Commonwealth of Virginia by admitting her responsibility of violating the Workers comp laws in the state of Virginia with her own signature in February 2016. Third, she did not pay the renewal of the policies on time on or before 1/5/2017 and consequently her general contractor (the company according to her expression) received the certificate of insurance cancellation notice.All of these incidents occurred due to her own action and inaction. We as agent/agency have absolutely nothing to do with it. The only thing we did was trying to help her understand what happened with her policies when she did not comply with the audit and performing agent agency's fiduciary duty of sending out certificate of insurance cancellation notices on time to the certificate holders. Of course, once we were requested to send the updated certificate of insurance after the policies renewal was confirmed even with late payment, we sent out the updated certificate of insurance immediately to the holder.Thank you,SK L**President of Greater Washington Financial Group
