Response to Sorenson complaint: [redacted] signed a legally binding contract March of for years with an agreement to pay one of four enhancement fees of $last one being in March of Then at the end of her term to start paying $monthly until she gave us a written notice to cancel her membership I the Owner of Greeley Health & Fitness nor my employees at the gym ever called and made threatening calls to her The Gym's billing company called her on several occasions being unsuccessful [redacted] returned the call to the billing company on 04/26/asking why she was being called They stated to her that she owed her enhancement fee ($29) and one month ($19.95) and a late fee ($9) she let them know she wanted to cancel and was told to stop in and cancel at the gym [redacted] came into the gym yesterday evening and spoke to me, letting me know she wanted to cancel I let her know of her know about her past due balances and that she needed to catch those up then we would cancel she said ok, paid the $and cancelled her membership There was no badgering, there was no rebuttal on her part she just paid, signed the cancel form and leftThis Morning at 8am 04/28/her Mother (***) came in, threw her daughters credit card on the counter and told the employee she must refund her daughters credit card $57.95, threatening that if it wasn't refunded she would be in contact with all local news outlets and use all online reviews possible to ruin the business The employee stated that she didn't have that authority and she would need to wait till I the Owner came in When I arrived, I printed out her contract and reviewed it with [redacted] letting her know it was legally binding and there was nothing we could do about it At that point she for the first time told me that her daughter was ill and couldn't make decisions for herself, [redacted] also stated that [redacted] never told her about the contract signed in until recently My final conversation with [redacted] was, the terms of legally binding contracts cant be twisted or broken whether used or not Just like when buying a car, you have to pay for it whether you use it or not [redacted] continued to make threats, trying to bring religion into the mix, stating I was mean and a Pharisee and that she would make sure that the whole gym would fail due to this issueWe do not discriminate against anyone here and as for her having an illness that was never disclosed to us by her or others until this morning (04/28/2016) in hopes of getting her out of money owed because of sympathy After the conversation with [redacted] was ended she yelled at the front desk so all members could hear how angry she was and stormed out the door I went to the back room, as I was back there she reentered the gym and demanded a copy of the contract I discussed with herThe employee at the front said, "let me get the owner so he can get you a copy of exactly what you're wanting." Hi, The customer account that was charged has been refunded and the account has been terminated with no further obligation

When it comes to all contracts that are signed, we follow the CCPA which states that we will cancel any health club agreement within days of purchase. I am assuming that *** did not come in within days of the agreement being signed to cancel because *** did not mention a date that
He came into cancel and still has the membership with us. I am willing to cancel the membership due to move if we are supplied with adequate proof of move, ienew drivers license of state ID with new address, one utility with *** name and the new address and a lease or mortgage agreement with the new address and a one time $150 moving cancel fee. The current amount owed is over $so this $fee is a very reasonable offer

Greeley Health & Fitness acquired the conditioning spa members July 1, 2017. With the acquisition that was being negotiated in June, the Conditioning Spa agreed to inform all members of the Greeley Health & Fitness Acquisition. Conditioning Spa has inform us that they did inform
its members thru emails, social media posts and sign posted in the conditioning spa weeks before their doors closed June 30, 2017. I cannot speak for what was said over the phone when *** or her mother called the number for our billing company but they do not have the contracts at the billing company so she would need to get that from the gym.*** came in Tuesday evening around 6-6:30pm demanding her mothers membership be cancelled, a retroactive refund and a copy of her mothers membership. I (Daniel, Owner)came up to the front desk during my workout after I was done working for the day to help with the situation because she was screaming and flailing her body at the front of the gym. I told her that I will get the membership pulled out the locked files the next day and we will be able to give her a accurate answer as to what can be done with her membership but most likely she will not get a refund. She asked me to tell her what email and phone was on file. I told her there was not a email on file and please tell me the last four digits of her phone number and Id confirm if that's what I had on file. She refused to do so, just demanded that I read her info to herWe don't just hand out information about clients to we weren't able to please her.She was also asked to fill out a cancel form to discontinue any future payments which she also refused to do.So as of today, We are still willing to show her mother, the contract holder, her membership if she wants to come in and see it. Which I also told her that night and again the next day in her *** post when she was bashing us for not giving her the membership that night.I only asked that she let me know when she will be coming in so that I can have it ready for her and be available to help her.-Daniel R***

My reference to religion was inappropriate; however, since the business advertises on the front door that it is closed on Sunday for "Church", I would think the owner would have some compassion for a young woman who had a head injury. I will be sure to avoid this business in future and will be sure to make sure others know our story.

I am rejecting this response because: the business owner in question went as far as to take pictures of the letter in question, but could not our information even though he had access to the accountAny business that is taking automatic payments should have signed authorization on file at hand for situations such as this, this business however did not and still has failed to provide such documentationThe contract with the conditioning spa had expired prior to the facility closing, so this business had no authority to continue said membership past it's contract end dateFurther more the "owner" in question went on to berate us on a public *** post, of which we have documented evidence were he clearly admits to laughing at ones face when questioned of the contract and recurring payment formWe continue to request a full refund of unauthorized payments and a retroactive cancellationPlease let me know of there is a way to submit photo evidence of the *** conversationThank you.

Hi, My name is *** ***, I am responding to this complaint on behalf of Greely Health & Fitness as my company Fitness Promoters, Incis conducting the promotion. It sounds like our marketing agent did not handle herself honestly and I'd like to apologize to everyone involved
for that. I have not been able to nail down who called the customers (from our organization) or when we called. If it is possible to provide the phone numbers we called and the approximate date I can do a further investigation and take disciplinary action to prevent this from happening again

--------------------------------------------------------------------------------... recieving this message I contacted [redacted] to ensure the pending $120 had been removed from the account they made in my name, and they did not intend to report me to a collection agency.[redacted] confirmed over the phone they would not take me to collections for the $120.  However, they denied to provide this information in writing.  After further discussion, they agreed to talk to their billing Manager to draft me a "special email" to include the requested information.I then called Greeley Health and Fitness to speak to the Management.  I was informed by the Management that the owed balanced WOULD remain in place, and WOULD be reported unless I closed all complaints and investigations I have pending against the business.  See copy/paste below (I will forward original email seperately);--------------------------------------------------------------------... I will make an exchange with you.  once you remove any and all negative reviews of my business including Revdex.com complaints that you have filed and provide me proof of the removal, then I will forgive the debt that you currently owe GH&F/Conditioning spa.Also once that is done and I remove the balances, no new negative reviews about Greeley Health & fitness or its affiliates are allowed to be posted by you are your affiliates. -------------------------------------------------------------------... I am extremely uncomfortable of this threat to hold my credit hostage in this poor attempt of extortion...I will gladly close all complaints and investigations ONCE I have in writing, all previous charges have been waived, the remaining balance has been waived, and there will be NO attempt to report my name to collections.--------------------------------------------------------------------... would also like to cite Colorado Revise Statute (C.R.S.) 6-1-704 (1)(c)(V)(1) A person engages in a deceptive trade practice when, in the course of such person's business, vocation, or occupation, such person engages in one or more of the following activities in connection with the advertisement or sale of a membership in a health club:(c) Fails to allow the buyer, or the estate of the buyer, to cancel the membership contract when:(V) The seller permanently discontinues operation of the health club or sells the health club and the sale results in substantial alteration of the quality of health club services or facilities or the nature of benefits so that they no longer conform to the provisions of the membership contract, but there shall be a thirty-day "right to cure" during which the fees payable by the buyer under the membership contract shall be suspended and the health club may bring the services, facilities, and benefits into conformance with the provisions of the membership contract------------------------------------------------------------------------... is the main reason [redacted] dropped me as a member, and did not contend my justifycation when I requested to be removed.  Greeley Health and Fitness is in clear violation of  C.R.S. 6-1-704 (1)(c)(V) and has absolutely no right to retain ANY of the memberships aquired through The Conditioning Spa.I hope these updates are helpful.  Please contact me with any questions, or any updates from your end.  Thank you VERY MUCH for all your support.Respectfully,[redacted]
